of 8 July 1969
on the State Fund for Land Fertilisation
The Czech National Council decided on this law:
(1) In order to increase the care and fertility of the land, a State Fund for Land Fertilisation (the Fund) is established for the Ministry of Agriculture and Nutrition of the Czech Socialist Republic.
(2) The Fund is managed by and acting on behalf of the Ministry of Agriculture and Nutrition of the Czech Socialist Republic (hereinafter referred to as the "Fund Manager").
(3) The Minister of Agriculture and Nutrition is responsible for managing the Fund's resources to the Government of the Czech Socialist Republic and the Czech National Council.
Management with Fund funds is controlled by the Ministry of Finance of the Czech Socialist Republic.
The Fund administrator shall draw up each year the budget and the accounts of the Fund which it submits to the Ministry of Finance within the deadlines set for the establishment of the State Budget and the State Final Account for consideration. The budget and the budget of the Fund shall be attached by the Ministry of Finance to the draft State Budget and the State Final Account submitted to the Government. The Government shall submit a draft budget of the Fund after any amendments it makes to it for approval to the Chamber of Deputies. The Fund administrator shall determine in the draft budget of the Fund its total expenditure as the amount notified to it by the competent administrator of the chapter under a special law. 1) At the same time as the closure, the Fund administrator shall submit an evaluation of the funds spent by the Fund.
The revenue of the Fund shall be:
(b) subsidies from the State budget.
Other revenue from the Fund shall be:
(a) interest on the funds of the Fund deposited with the Czechoslovak State Bank and on loans granted by the Fund to applicants;
(b) repayments of loans from applicants;
(c) repayments of loans and contributions by applicants where the agricultural use of the land has been prevented;
(d) income from the physical penalty of applicants in cases where the Fund's funds have not been used under the conditions laid down;
(e) other resources provided for in specific provisions.
For the financial management of the Fund, a Czechoslovak separate account shall be set up with the State Bank.
(1) Subsidies or loans may be granted from the Fund for:
(a) the construction, reconstruction, modernisation, maintenance and operation of the drainage and irrigation of agricultural parcels, as well as the necessary investments to enable the full use of such facilities;
(b) adaptation of watercourses, with the exception of watercourses of major importance;
(c) the establishment of small water tanks (3) as water sources for irrigation;
(d) the construction and restoration of ponds and their cleaning in connection with water treatment;
(e) the construction of silage pits, composting plants and facilities to increase the content of organic substances in the soil;
(f) the setting up of grazing areas;
(g) construction and modification of reinforced field paths;
(h) the setting up of fruit orchards, vineyards and hops;
(i) farm-technical adjustment of land, 4)
(j) further fertilisation work, namely:
1. recovery of unused land;
2. the reclamation of meadows and pastures;
3. reclamation and fertilisation of sandy and heavy soils;
4. reclamation and increase fertility of arable land;
5. anti-erosion measures, levelling of slopes and technical treatment of the soil (reclamation of old roads and pits, removal of shrubs, bushes, flights, stones and terrain inequalities),
6. mellioration liming,
7. land weighing by suitable natural or waste materials to improve soil structure and increase fertility.
(2) Fund funds are not granted for the reclamation of land carried out by an investor under the rules on the protection of the agricultural land fund. 5)
(1) The fund's use for the purposes set out in Section 7 is decided by the fund manager in accordance with the investment and subsidy policy of the Ministry of Agriculture and Nutrition of the Czech Socialist Republic.
(2) The resources provided from the Fund are assigned to them. The applicant is obliged to use them according to the specified conditions (§ 9 (1)).
(3) Funding for the intensification of the Soil Fund shall be provided either as subsidies or as loans.
(4) The amount and type of resources provided shall be determined on the basis of the efficiency and economic efficiency, taking into account the conditions of manufacture of the applicant and his ability to implement and exploit the actions envisaged.
(5) The subsidies granted by the Fund are contingent subsidies. If they are not used in accordance with the prescribed directives (Paragraph 9 (1)) in particular for the intensive and efficient use of the fertilisation work, the applicant shall be obliged to repay the subsidy or part thereof.
(1) The resources of the Fund are granted to applicants under the conditions laid down in the Directives issued by the Minister for Agriculture and Nutrition of the Czech Socialist Republic in agreement with the Minister for Finance of the Czech Socialist Republic. Applicants may be socialist organisations and, where appropriate, individual farm farmers who join in a one-off or permanent implementation of the agricultural land adjustment for the purpose of its fertilisation.

The balance of the Fund's funds shall not be forfeited at the end of the year.
This Act shall take effect on 1 January 1970.
