Ministry of Construction
of 28 June 1965
on training, competence and registration of operators of construction machinery
In agreement with the participating ministries, other central bodies and the Central Council of Trade Unions, the Ministry of Construction provides, pursuant to Article 27 (1) of Act No. 65 / 1961 Coll. on Safety and Health at Work:
§ 1
Scope
1. Construction machinery referred to in paragraph 2 (hereinafter referred to as "construction machinery") may be operated only by those to whom the Ministry of Construction or the authority authorised by it has authorised to operate in the context of the implementation of land works *) or other works.
2. The authorisation referred to in paragraph 1 shall be subject to:
(a) dozers and tractors of wheeled vehicles above 50 k;
(b) railway wagons and tractors,
(c) special tractors for construction mechanisms,
(d) shovel excavators for belt, automotive and wheeled;
(e) turnovers,
(f) turnovers;
(g) drainage milling machines and paddlers,
(h) wheel and belt loading and unloading machines over 35 k;
(i) self-graders and griffearners,
(j) motor trunks,
(k) pantry with belt tractor,
(l) truffles,
(m) road cylinders;
(n) narrow-track locomotives for portable rails,
o) special motor snow machines,
(p) compressors with an operating pressure above 5 atmosphere and 300 m3 / hour,
(q) construction machinery, as defined by the Ministry of Construction by a special measure. *)
3. Without permission to operate, only those who, with the agreement of the machine operator, are allowed to operate the construction machine under the direct and permanent supervision of a professional teacher or trainer for the purpose of obtaining prior experience under Section 5.
§ 2
Authorisation to operate construction machinery
1. Authorisations to operate construction machines may be granted only to those who:
(a) has reached the age of 18;
(b) be physically and mentally capable and reliable to such service;
(c) have received the required training;
(d) has demonstrated competence by examination.
2. If the construction machine also has the character of a motor vehicle or steam engine, only those with an appropriate driving licence * * may be granted a licence or a licence to operate steam engines (boilers). * * *)
§ 3
Detection of physical and mental capacity
The physical and mental ability to operate construction machinery shall be determined by a medical examination to be carried out by the candidate for the licence to operate construction machinery before training begins. In order to carry out a medical examination, the regulations of the Ministry of Health issued to determine the physical and mental capacity of applicants for a driving licence shall apply mutatis mutandis. * * * *)
§ 4
Reliability to operate construction machines
1. It is not reliable to operate construction machinery
(a) who does not have a good working ethic and does not guarantee the safe and economical operation of his work and behaviour;
(b) who often consume over-alcoholic beverages or consume narcotic drugs;
(c) who are prohibited by court from operating construction machinery.
2. The certificate of reliability for the operation of construction machinery referred to in points (a) and (b) of paragraph 1 shall, with the agreement of the ROH Committee, be issued by the organisation proposing the candidate to be assigned to the training establishment.
§ 5
Training
1. The applicant for authorisation to operate construction machinery must:
(a) to obtain prior experience in the operation of a construction machine under the direct and permanent supervision of a professional teacher or trainer to the extent specified in the Annex;
(b) have undergone professional training in a training facility of the Ministry of Construction or a training facility set up with the approval of the Ministry of Construction.
2. Training in training facilities shall be conducted according to syllabus issued or approved by the Ministry of Construction.
3. The training establishment shall issue a certificate to the graduate.
§ 6
Selection of applicants for training facilities
1. Candidates for the training equipment of construction machinery operators are designed by an organisation which uses construction machinery in its operation, mainly from applicants who are trained in the machinery or related field and also have professional experience in these fields.
2. An application to include a candidate in a training establishment shall be supported by the organisation:
(a) a declaration by the applicant that he is not prohibited by the court from operating construction machinery and that he agrees to be included in the training;
(b) a certificate from the organisation certifying the reliability of the tenderer for operating construction machinery;
(c) medical evidence of the physical and mental capacity of a candidate to operate construction machinery;
(d) confirmation of prior experience in the operation of the construction machine,
(e) other documents justifying the application for inclusion of the candidate in the training establishment.
3. The documents referred to in paragraph 2 shall be returned by the training facility to the tenderer after successful completion of the training, unless it is transmitted directly to the authority responsible for carrying out the professional examination.
§ 7
Application for professional examination
1. The application for a professional examination shall be submitted by the candidate for the certificate of use of the construction machine through an organisation in which he is employed or, where appropriate, through a training facility, the Ministry of Construction or an authority authorised by him.
2. The application shall contain:
(a) the name and address of the tenderer;
(b) date and place of birth and identity card number;
(c) the dates of the driving licence, the licence to operate steam engines (boilers) if such a licence is required under special regulations;
(d) a declaration by the tenderer that he is not prohibited by the court from operating construction machinery;
(e) a certificate from the organisation on the reliability of the tenderer for operating construction machinery;
(f) a medical certificate of the physical and mental capacity of the candidate to operate construction machinery;
(g) a certificate of prior experience in the operation of the construction machine within the prescribed range;
(h) a certificate of successful completion of vocational training;
(i) a photograph of the candidate's head measuring 3 x 4 cm.
3. On the basis of the application, the Ministry of Construction or the Authority shall determine the duration, place and composition of the examination committee.
§ 8
Expert test
1. The professional competence of a candidate for a licence to operate construction machinery shall be ascertained by a professional examination, separately for each machine group and type of propulsion.
2. The expert examination shall take place before a test committee composed of at least two test Commissioners. The examination may be attended by a representative of the organisation with which the candidate is employed and a representative of the trade union organisation.
3. The technical examination shall consist of a theoretical and practical part and shall demonstrate that the candidate has knowledge of the operator and maintenance of the construction machine and has mastered the substance prescribed by the curriculum.
4. The results of the expert examination shall be evaluated by the Examination Panel as follows:
(a) competent to operate a construction machine of the type:....................
(b) unfit to operate a construction machine of the type:..................
5. The test committee shall draw up a separate minutes of the result of each candidate's professional examination, which it shall submit to the authority responsible for issuing the certificate of use of construction machinery.
6. If the candidate has not been recognised during the test to be operated by the construction machine, he may apply for a repeat of the test within the time limit set by the examination committee. If the applicant fails to pass the re-test, the test may be accepted only after repeated training.
§ 9
License to operate construction machines
1. Candidates who have demonstrated their competence through a professional examination shall be granted by the Ministry of Construction or by an authority designated by it, a licence to operate the construction machinery (s) and shall issue a certificate thereof.
2. The authorisation may be extended to other construction machines after completion practice and test.
§ 10
Obligations of the licence holder
1. The holder of the licence shall have the right to keep the licence properly and shall have it when operating the construction machine and submit it to the inspection authorities upon request.
2. The licence holder shall not make any entries, changes or modifications to the licence.
3. The holder shall report the loss of the licence immediately to the authority which issued the licence or to the authority which is responsible for issuing the authorisation.
§ 11
Withdrawal (detention) of a licence
1. The Ministry of Construction may revoke the licence to operate the construction machine and withdraw the licence issued if its holder is mentally or physically unfit or unreliable for such service.
2. The inspection authorities may temporarily withhold the certificate if the operation of the construction machine would jeopardise safety and health at work.
§ 12
Test Commissioners
1. The Chief Executive shall be appointed by the Ministry of Construction to office in agreement with the head of the organisation for which the proposed Examination Commissioner is in employment.
2. The probationary commissioner shall be called upon to carry out a trial activity in such a way as to interfere with his / her working time for an organisation in which he / she is employed only to the extent strictly necessary, which shall not exceed four working days per month.
3. For the duration of the probationary activity, the probationary commissioner shall be entitled to leave and pay as an obstacle to work for reasons of general interest. In addition, it shall be entitled to reimbursement of travel expenses and to remuneration for carrying out tests to the extent specified by specific provisions. *)
§ 13
Approval of the Ministry of Construction
1. Ministry of Construction
(a) carry out central supervision of the teaching and expert tests of the operating of construction machinery;
(b) approve (issued) the curriculum for training equipment for operating construction machinery;
(c) determine the mass and / or individual checks on the operation of construction machinery, where appropriate, additional training and conditions for its execution;
(d) maintain a central registration of operators of construction machinery.
2. The Ministry of Construction
(a) instruct other authorities to carry out tests and to issue operating authorisations for construction machinery;
(b) in exceptional cases of special justification, allow exemptions or concessions from this decree.
§ 14
Authorisation to operate construction machinery in the armed forces
Specific regulations shall apply to the training, competence and registration of operators of construction machinery in the armed forces. The authorisations thus obtained shall be valid for the exercise of the service even outside the armed forces if the Ministry of Construction or the authority authorised by it makes its registration at the request of the holder of the licence.
§ 15
Transitional provisions
1. Authorisations to operate construction machinery granted by the Ministry of Construction before the Decree is effective remain valid.
2. Only personnel appointed under this decree may perform the functions of test Commissioners.
§ 16
Final provisions
The Directives are hereby repealed. *)

Efficacy
This decree shall take effect on 1 August 1965.

Preliminary practice for each group of construction machines shall be determined to the following extent:
a)dozery a traktory kolové nad 50 k 400 hod.
b)dozery a traktory pásové 400 hod.

d)lopatová rypadla pásová, automobilová a kolová 400 hod
e)korečková rypadla 300 hod.
f)korečková hlubidla 300 hod.

h)nakládací a vykládací stroje kolové a pásové nad 35 k 400 hod.
i)autogrejdry a grejdrelevátory 400 hod.
j)motorové skrejpry 400 hod.
k)skrejpry s pásovým tahačem 400 hod.
l)truboukladčíky 300 hod.
m)silniční válce 200 hod.
n)úzkorozchodné lokomotivy pro přenosné dráhy 200 hod.
o)speciální motorické sněhové stroje 200 hod.
p)kompresory s provozním tlakem nad 5 atm. a 300 m3/h 200 hod.
q)u dalších stavebních strojů stanoví se rozsah předběžné praxe v opatření vydaném podle § 1 písm. q) vyhlášky
The period of prior experience shall be the period during which a candidate for a certificate to operate a construction machine shall drive the machine under the supervision of an expert teacher or trainer. The preliminary practice shall not include the preparation time or hours devoted to the maintenance or repair of the machine.
