Decret of the President of the Republic
of 21 September 1945
on certain measures to accelerate the loading and unloading of goods in rail transport.
On the proposal of the Government and in agreement with the Slovak National Council, I establish:
Shippers of railway freight and their agents shall be obliged to load the goods into the railway wagon immediately after their arrival within the time limit fixed for loading.
The recipients of railway consignments and their agents shall be required to unload railway freight wagons immediately after the arrival of the goods (signalling) has been reported within the time limit for unloading of the goods by the railway fixed and taken care of - including public ports and the transhipment point - the immediate removal of the goods from the places serving transport. They shall be required to ensure in advance that the arrival report can be delivered at any time and that the labelled goods can be immediately removed.
The obligation to load and land (§ § 1 and § 2) also applies to noon hours, Saturdays, Sundays and holidays.
Any person intentionally or through serious negligence who fails to fulfil the obligation imposed on him by § 1 or § 2 shall be punished by the District National Committee (District Administrative Commission) for a penalty of up to 100,000 K and a sentence of freedom within 6 months. In the event of non-compliance with the fine, a replacement sentence shall be imposed at the rate of guilt within 6 months. In addition, on a proposal from the Railway Administration, the forced unloading of the goods may be provided, after its removal, for the danger and expense of the transporter.
This Decision shall take effect on the day of its publication; it shall be carried out by the Home Secretary in agreement with the Minister for Transport and the Minister for Labour and Social Welfare.
