GOVERNMENT REGULATION
of 20 March 2013
amending Government Regulation No. 147 / 2008 Coll., laying down the conditions for the grant of subsidies for the conservation of the forest-based economic population under the Natura 2000 measure in the forests, as amended
The Government orders pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll.:
Government Decree No. 147 / 2008 Coll., laying down the conditions for the grant of subsidies for the conservation of the economic population of forest land under Natura 2000 in forests, as amended by Government Decree No. 51 / 2009 Coll., Government Decree No. 83 / 2009 Coll., Government Decree No. 480 / 2009 Coll., Government Decree No. 369 / 2010 Coll., Government Decree No. 106 / 2012 Coll. and Government Decree No. 448 / 2012 Coll., are amended as follows:
1. In Article 2 (6), the words "in the manner described in the project for the title of conservation of the economic file, the elements of which are set out in Annex 2 to this Regulation 'are deleted.
2. in Article 3 (3) (a), the word "classified" shall be replaced by "whole."
3. In Paragraph 4 (3) (d), the words ", together with the application for the grant, the opinion of the Ministry of the Environment, issued under the Nature Conservation and Landscape Act (2) 'shall be replaced by the words" and occurred during the period from the date of submission of the application for the grant until 31 December of the relevant calendar year, shall be submitted by the Ministry of the Environment by 31 January of the following calendar year at the latest; where this change occurred between 1 January of the relevant calendar year and the date of submission of the application for the grant, the applicant shall submit the opinion of the Ministry of the Environment together with the application for the grant'.
4. In Article 5 (f), the words "in accordance with a project for the conservation of an economic file or with a notification pursuant to Article 7 (9) 'are deleted.
5. In Paragraph 7 (2) of the final part of the provision, "4 'is replaced by" 5'.
6. In Article 7, the following paragraph 3 is inserted after paragraph 2:
"(3) If the applicant demonstrates that during the relevant 20-year period there has been an increase in the total area of the selected grassland group included in the maintenance of the economic file in the decision referred to in Article 3 (4) on the basis of changes in the plan or an outline of no more than 15%, the Fund shall grant the subsidy to the applicant on the basis of an application for a subsidy in which the applicant indicates the increased area. '
Paragraphs 3 to 10 shall be renumbered paragraphs 4 to 11.
7. In Article 7, the following sentence is added at the end of paragraph 4: "If, during the relevant 20-year period, an increase of more than 15% of the area of the selected crop group is applied to the applicant on the basis of changes in the plan or outline, the Fund shall decide to exclude the selected crop group in order to maintain the economic file and the applicant shall repay the subsidy granted on the area of the entire selected crop group to which the condition has been infringed. '
8. In Article 7 (5), "areas' is replaced by" areas' and "or" 3 'is replaced by "points (a) to (c) or (e) to (g) or in paragraph 4'.
9. Paragraph 7 (6) reads as follows:
"(6) The applicant shall submit to the Fund, at the same time as the application for the grant for the calendar year in question, a request for a change to the classification indicating the required change to the designated area as a result of the facts referred to in paragraph 2, 3 or 4, except for the change notified within the time limit referred to in paragraph 5. ';
10. In Article 7, the following paragraph 7 is inserted after paragraph 6:
"(7) If, during the 20-year period in question, the applicant has a partial reduction in the area of the grassland group on the basis of factors other than those referred to in paragraph 2, the applicant shall submit an application for an amendment to the classification referred to in paragraph 6, which shall be supported by a certificate from the expert forestry operator that the newly included reduced area of the grassland group is identical to the area of the entire grassland group located on the ground. The applicant shall provide a visible indication of the actual boundary of the newly assigned reduced area of the crop group in the field. If the applicant fails to provide a certified forest operator or if it is found by an on-the-spot check that the whole crop group has not been included by this procedure, the fund shall exclude the crop group in order to maintain the economic file and the applicant shall repay the subsidy granted to the area of the whole crop group selected. ';
Paragraphs 7 to 11 shall be renumbered paragraphs 8 to 12.
11. in Article 7 (8), "4 or 5" is replaced by "5 or 6," "area" is replaced by "area" and "3" is replaced by "4."
12. in Paragraph 7 (11):
"(11) If, on the basis of a change in plan or outline, the selected crop groups are merged with the same year of commitment and the same type of crop group selected, or the distribution of the selected crop group, the Fund shall decide, on the basis of an application for a change in classification, to change the classification in the title of conservation of the economic file and to grant a subsidy to the area of the newly created crop group, or the sum of the newly created crop groups, with an identification from the new plan or outline in accordance with paragraphs 2 to 9. If the Fund finds that selected crop groups with the same year of commitment or the same type of crop set of selected ethnicity have not been merged, the Fund shall exclude the newly created crop group in order to maintain the economic file and the applicant shall return the subsidy granted to the entire selected crop group for which the condition has been violated. '
13. in Paragraph 8 (2), "area" is replaced by "area."
14. in Article 8 (3), the words "ensuring the visible designation of the border of the grassland group" shall be inserted after the words "Article 5 (f)"; and the words "or Article 7 (7)" shall be inserted after the words "Article 5 (f)."
15. in Paragraph 9a (4), "reduction" is replaced by "amendment" and "3" is replaced by "4."
16. in Annex No 2, point III is deleted;
Efficacy
This Regulation shall take effect on 1 April 2013.
