THE LAW
of 19 April 1995
on the increase of pensions paid and pensions granted in 1995
Parliament has decided on this law of the Czech Republic:
REDUCTION OF COMPUTED PENSIONS AND PENSIONS GRANTED IN 1995
Percentage increase in pensions awarded before 1 July 1995
Old-age, invalidity, partial invalidity, in service of the years, widower's and orphan's pensions awarded before 1 July 1995 shall be increased by 5% from the payment of the pension due after 30 June 1995 to the amount of the pension belonging to the citizen on the date on which the pension increases; the amount of the pension for this purpose means the monthly amount of the pension without increasing it by a fixed amount under a special law. 1)
Percentage increase in pensions granted from 1 July 1995 to 31 December 1995
Old-age, invalidity, partial invalidity, in service of the years, widower's and orphan's pensions granted from 1 July 1995 to 31 December 1995 shall be increased by 38,6% from the date of the grant of the pension to which the citizen was entitled on the date of the pension; the amount of the pension for this purpose means the monthly amount of the pension after any adjustment under Section 56 of the Social Security Act. 2)
Increase in widower pensions
(1) The amount of the widower's pension according to Section 48a of the Social Security Act 2) CZK 1100 per month.
(2) Widower pensions paid on the effective date of this Act are increased by CZK 100 per month from the payment of the pension due after 30 June 1995. Widower pensions, which are paid at an amount adjusted according to § 56 paragraphs 3 and 6 of the Social Security Act, 2) are increased by CZK 50 per month from the pension payment due after 30 June 1995.
(3) The second sentence of Article 4 (1) applies mutatis mutandis to the total of the widower's and other pensions, including the increase in the helplessness pension.
Common provisions on percentage increases in pensions and increases in pension schemes
(1) The increase provided for in paragraphs 1 to 3 shall also be above the highest rates of pension or total pensions and above the highest rates laid down for the coexistence of pension or total pensions and the increase in pension for helplessness. However, the amount of the pension or the sum of the pensions, including the increase in the pension for helplessness, may not exceed CZK 5100 per month after the increase provided for in § 1 to 3.
(2) Paragraph 2 (4), § 5 (1) and (3) and § 6 to 8 of Act No. 46 / 1991 Coll., on the increase of pensions shall apply mutatis mutandis.
(3) Widows' and orphans' pensions are not increased in accordance with Sections 1 and 2 if they have been calculated from pensions raised under these provisions.
Increase in pensions by fixed amount
(1) Pensions of old-age, disabled, partial invalidity, in service of years, widows, widows, orphans and wives which were awarded before 1 July 1995 are increased by a fixed amount of CZK 680 per month from the payment of the pension due after 30 June 1995. At the same time, as from the payment of the pension due after 30 June 1995, the right to an increase of the pension will cease to exist for these pensions by a fixed amount of CZK 420 per month under a special law. 1)
(2) Old age, invalidity, partial invalidity, for service of years, widows, widows, orphans and wives granted from 1 July 1995 to 31 December 1995 are increased by a fixed amount of CZK 680 per month from the date of granting.
(3) Where a pensioner receives two or more pensions, only one pension shall be increased in accordance with paragraph 1 or 2, namely an old-age, invalidity, partial invalidity or service pension. In the event of a combined entitlement to a widow's or widower's pension and an orphan's pension, the widower's or widower's pension shall be increased. When the pension rights are combined, the entitlement to an increase as referred to in paragraph 1 or 2 shall cease to exist in respect of a pension to which that increase does not fall under the preceding sentence. If entitlement to a pension is lost which has been increased in accordance with paragraph 1 or 2 and paid with another pension, that other pension shall be increased in accordance with paragraph 2.
(4) The increase in the pension by a fixed amount referred to in paragraph 1 or 2 shall also be above the highest rates of the pension or the total of the pensions and above the highest rates laid down for the combined pension or the total of the pensions and the increase in the pension for the helplessness.
(5) The increase in the pension by the fixed amount referred to in paragraph 1 or 2 shall be due in full, even if the pension is reduced for other income or income.
(6) If a pension is paid to a pensioner calculated in the light of an international agreement or reduced in accordance with Paragraph 58 (1) of the Social Security Act (2), according to the ratio of periods completed in the Czech Republic to the total completed period (hereinafter referred to as "partial pension '), the amount of the increase in the partial pension shall be fixed in proportion to those periods, unless otherwise provided for by an international contract. If at the same time the conditions for entitlement to the payment of more than one part of the pension are met, an increase of a fixed amount shall be paid only in respect of the part of the pension to which the increase belongs in excess. If the conditions for entitlement to the payment of part-income and other pension from the Czech pension are met at the same time, an increase of the full amount of this other pension shall be paid and no increase of the fixed amount shall be paid for the part-pension.
(7) In calculating the pension, the amount of which shall be determined from the pension plus a fixed amount, such increase shall not be taken into account.
Increase in the highest rates of total pensions (benefits)
The highest rates of the total amount of pensions paid (benefits) referred to in § 56 paragraphs 2, 4 and 5, § 64 paragraphs 5, § 70 paragraph 2 and § 139 paragraph 1 of the Social Security Act (2) and increased pursuant to § 6 of Act No. 255 / 1993 Coll., on the second increase in pensions in 1993 and on the increase in pensions awarded in 1994, and § 7 of Act No. 183 / 1994 Coll., on the increase of pensions paid and pensions awarded in 1994 and 1995, are further increased by CZK 300.
Increase in pensions that are the only source of income
(1) The boundaries of pensions, which are the only source of income, are CZK 2720 per month under § 54 (1) and § 68 (1) of the Social Security Act (2) and § 54 (2) and § 68 (2) of the Social Security Act (2) CZK 4880 per month.
(2) Pensions paid at the date of application of this Act, which have been adjusted as a single source of income, will be increased without application from the payment of the pension due after 30 June 1995.
(3) The pensions of old-age, disabled, widower, widower and orphan children who have not yet been adjusted as a single source of income and even after the increase provided for in paragraphs 1, 2, 3 and 5 are below the level laid down in paragraph 1 shall be adjusted on request at the earliest from the payment of the pension due after 30 June 1995.
Increase in social pensions
(1) Social pensions awarded before 1 July 1995 will be increased by CZK 260 per month and CZK 520 per month, if a member of the family is also dependent on such a pension, from the payment of the pension due after 30 June 1995. However, if the recipient of a social pension or his family member receives a pension which has been increased in accordance with paragraphs 1 and 5 or with paragraph 5, the social pension shall be increased only if the increase in accordance with paragraphs 1 and 5 is lower than the amount indicated in the first sentence; the amount of the increase shall in that case be set at the difference between the increase referred to in paragraphs 1 and 5 and the amounts indicated in the first sentence.
(2) The amount of the social pension awarded after 30 June 1995 under Paragraph 52 (2) of the Social Security Act (2) shall be no more than CZK 2720 per month for the individual and no more than CZK 4880 per month, if a member of the family is also dependent on such pension.
AMENDMENT OF THE LAW 183 / 1994 Sb., ON THE EXTENSION OF REVENUE AND PENSIONS GRANTED IN 1994 AND 1995
Act No. 183 / 1994 Coll., on the increase of paid pensions and pensions granted in 1994 and 1995, is amended as follows:
1. In Paragraph 3, "31 December 1995 'is replaced by" 30 June 1995'.
2. § 6 is deleted.
Efficacy
This Act shall take effect on 1 July 1995.
