DECLARATION
Ministries of Health and Justice of the Czech Socialist Republic
of 9 July 1981
amending and supplementing Decree No 32 / 1965 Coll., on the compensation of pain and the inconvenience of social application, as amended by Decree No 84 / 1967 Coll.
The Ministry of Health of the Czech Socialist Republic and the Ministry of Justice of the Czech Socialist Republic, in agreement with the Czech Trade Union Council and with the other participating central authorities, provide according to § 203 (2) of the Labour Code No. 65 / 1965 Coll., as amended and § 508 (1) of the Civil Code No. 40 / 1964 Coll.:
Decree No. 32 / 1965 Coll., on the compensation of pain and difficulties in social application, as amended by Decree No. 84 / 1967 Coll., is amended as follows:
1. Paragraph 2 (3) shall be deleted. Paragraph 4 shall become paragraph 3.
2. Paragraph 4 (3) shall be deleted. Paragraph 4 shall become paragraph 3.

Amount of compensation
(1) The amount of compensation for pain and for the inconvenience of social application is determined by the amount of Kčs 15, - per point.
(2) The total amount of compensation for pain and for the inconvenience of social application from one injury to health must not exceed the amount of Kčs 60 000; of which the compensation for pain may not exceed the amount of Kčs 18 000, even if the compensation provided for in Paragraph 3 (2) is added.
(3) In very exceptional cases of special consideration, the arbitration authority or the court of compensation may increase the compensation accordingly, even above the maximum compensation rates laid down. ';
4. Article 9 (4) reads as follows:
"(4) If it is an occupational disease, professional poisoning or other damage to health from work, (1) the assessment shall be carried out solely by the hospital's occupational ward (clinic) with the clinic responsible for the place of work of the injured person; If such damage is caused to health in the field of military administration, the assessment shall be made by a military hospital. ';

The report may be reviewed in accordance with the rules on decision making in the exercise of medical services.2) '.
6. The Annex to the Order is amended as follows in Part B:
(a) Section III is added as follows:
| „41b) | Onemocnění kostí, kloubů, šlach a nervů končetin z dlouhodobého, nadměrného a jednostranného zatížení | 30 – 150“, |
(b) in Section IV, item 100:
| „100. | Těžká nedoslýchavost až hluchota z hluku | 200 – 650“, |
(c) Section IV shall be added to headings 106 and 107 as follows:
| „106. | Profesionální asthma bronchiale | 200 – 1300 |
| 107. | Onemocnění kostí, kloubů, šlach a nervů končetin z dlouhodobého, nadměrného a jednostranného zatížení | 150 – 400“. |
Pain and difficulties in social application from damage to health arising before the date of entry into force of this Decree shall be assessed in accordance with existing rules.
This Decree shall take effect on 1 September 1981.
