DECLARATION
Federal Ministry of the Interior
of 19 August 1971
on the Public Security Auxiliary Guard
The Federal Ministry of Interior provides in agreement with the Ministry of Interior of the Czech Socialist Republic and the Slovak Socialist Republic pursuant to § 11 (2) of Act No. 70 / 1965 Coll., on the National Security Corps:
§ 1
(1) Ensuring the protection of public order and security requires synergies of Public Security with citizens. The expression of this organised synergy is the Public Security Auxiliary Guard.
(2) Members of the Public Security Auxiliary Guard shall in particular assist in ensuring the protection of public order, the security of persons and property, the security and continuity of transport and the protection of national borders; In doing so, it has an incentive to avoid violations of public policy and to eliminate the causes that lead to it in good time.
§ 2
(1) Members of the Public Security Auxiliary Guard may volunteer for Czechoslovak citizens older than 21 who are committed to a socialist social and state establishment and enjoy universal seriousness and trust.
(2) Members of the Public Security Auxiliary Guard are appointed by the heads of the District Department of Public Security on the recommendation of national committees or national, economic and social bodies and organisations.
(3) Members of the Public Security Auxiliary Guard are active in the district of the District Department of Public Security in which they were designated. In exceptional cases, they may, with their consent, be used for the performance of their tasks even outside the district district.
§ 3
(1) Members of the Public Security Auxiliary Guard take the following oath in the hands of the head of the District Department of Public Security:
"I, a member of the Public Security Auxiliary Guard, solemnly promise to protect the Czechoslovak Socialist Republic, the interests of the working class, the working people and to actively contribute to the protection of public order, the security of people and property.
In my work, I will abide by laws and other laws and maintain national and professional secrecy. I promise! "
(2) After the promise has been made, a member of the Public Security Auxiliary Guard shall be provided with a public security Auxiliary Guard card and a sleeve of Public Security Auxiliary Guard.
§ 4
(1) In agreement with the relevant national committees, members of the Public Security Auxiliary Guard are formed by the Public Security Auxiliary Guard Units.
(2) The Public Security Auxiliary Guard Unit is normally managed by the Head of Public Security District through the Head of the Unit. The head of the unit shall be appointed by the head of the District Department of Public Security after consultation with the relevant national committees.
§ 5
(1) In the performance of their duties, members of the Public Security Auxiliary Guard shall be identified externally by the sleeve of the Public Security Auxiliary Guard. The sleeve is worn on the left back-up.
(2) The sleeve is of yellow colour, 105 mm wide, with blue letters "PS VB" of 35 mm height and 20 mm width and bearing a round stamp of the relevant District Department of Public Security.
(3) In the performance of their duties, members of the Public Security Auxiliary Guard shall be public officials.
§ 6
(1) The following powers are conferred on members of the Public Security Auxiliary Guard, if identified externally, from the rights of members of the National Security Corps:
(a) to call on the citizen to refrain from acts which undermine public policy or other illegal conduct;
(b) to warn a citizen who has violated public policy;
(c) in justified cases, invite the citizen to prove his identity;
(d) to present to the Department of National Security a person who cannot prove his identity in a credible manner or who violates public policy in a gross manner, in particular by disorderly conduct or other inappropriate behaviour;
(e) in justified cases, stop vehicles and require the documents prescribed for driving and operating the vehicle; it shall not stop vehicles outside the municipality under reduced visibility;
(f) prohibit the driving of a driver whose ability to drive is reduced by the influence of alcohol, or where the technical condition of the vehicle endangers the safety and continuity of operation;
(g) in order to provide evidence in the commission of a criminal offence, offence and offence to raise questions as to whether and which persons may provide information on them, until the National Security Corps authorities arrive;
(h) if there is a risk of delay, carry out the necessary actions to secure the crime scene and to identify the persons present.
(2) Where members of the Public Security Auxiliary Guard are serving with members of Public Security, they shall be entitled to use a baton or chemical tear agent under the conditions laid down by Act No. 70 / 1965 Coll., on the National Security Corps.
(3) In carrying out their tasks, members of the Public Security Auxiliary Guard shall apply primarily the means of education and prevention. They only perform the procedure if it is absolutely necessary and if they think it will succeed.
§ 7
Members of the Public Security Auxiliary Guard shall:
(a) maintain laws and other laws in the performance of their duties; in the course of the negotiations, they must act with discretion and politeness and respect for the seriousness, honor and dignity of citizens and their own;
(b) actively perform the tasks of the Public Security Auxiliary Guard, enhance its political and expertise and demonstrate preparedness for the performance of the tasks to a specified extent;
(c) maintain confidentiality regarding the facts which they have become aware of in connection with the performance of the tasks of a member of the Public Security Auxiliary Guard and which require, in the general interest or in the interests of the parties concerned, that they remain secret from unauthorised persons unless they are expressly exempted from this obligation.
§ 8
(1) Everyone is obliged to obey the instructions and calls of the members of the Public Security Auxiliary Guard, which they issue in the performance of their tasks.
(2) Upon request, members of the Public Security Auxiliary Guard shall, in the performance of their duties, be shown with a public security Auxiliary Guard card.
§ 9
The members of the Public Security Auxiliary Guard may receive benefits in kind and in cash for the exceptional performance of the service and the results at work.
§ 10
(1) A member of the Public Security Auxiliary Guard must be released from the Public Security Auxiliary Guard by the head of the District Department of Public Security if he so requests.
(2) A member of the Public Security Auxiliary Guard may be deprived of his / her membership of the Public Security Auxiliary Guard if he / she fails to fulfil his / her duties properly or if he / she commits an act incompatible with the function of Auxiliary Guard member of Public Security.
§ 11
The provisions of Section 13 of Act No. 70 / 1965 Coll., on the National Security Corps shall apply to the damages to members of the Public Security Auxiliary Guard who have suffered in or directly related to their activities.
§ 12
Decree of the Minister of Interior No. 56 / 1962 Coll., on the Auxiliary Guard of Public Security is hereby repealed.
§ 13
This decree shall take effect on the day of its publication.
