on a State inspection of the quality of food and agricultural products
The Government of the Czechoslovak Republic orders, with the agreement of the President of the Republic pursuant to § 1 of Constitutional Act No. 47 / 1950 Coll., on adaptations to the organisation of public administration:
§ 1
Food and agricultural products are a basic source of nutrition for the population and their quality directly affects the level of human nutrition. Care, which is devoted to the continuous improvement of the standard of living of our working people, requires workers to be provided with the best quality food and agricultural products. The quality control of food and agricultural products shall be carried out by the State Inspection of the Quality of Food and Agricultural Products.
§ 2
The State inspection of the quality of food and agricultural products shall consist of:
1. Central Inspectorate based in Prague, subordinate to the Minister for Food and Agricultural Products.
2. Regional inspector based in Bratislava, subordinate to the food industry and the purchase of agricultural products.
3. Inspections in the regions, subordinate to the Central (Regional) Inspectorate.
§ 3
(1) State inspections of the quality of food and agricultural products (hereinafter referred to as "State inspections") carry out in particular the following tasks:
(a) monitor and verify the quality of the products of the food industry and of the raw materials used for their manufacture, storage and ensure compliance with their prescribed quality; monitor and verify the quality and storage of the agricultural products purchased;
(b) carry out analyses of food and agricultural products and, on the basis of the values found, issue assessments and quality certificates;
(c) verify the quality of food and agricultural products on importation and export to the extent specified by the Minister for Food and the Purchase of Agricultural Products in agreement with the Minister for Foreign Trade.
(2) The State Inspection shall cooperate with the control authorities of central offices and other organisations and with the executive authorities of national committees.
(3) The State Inspection is working closely with the authorities of the Revolutionary Trade Union Movement and is based on active synergies and workers' initiative.
§ 4
(1) In carrying out their activities, State inspection personnel are entitled to enter all production and ransom undertakings and establishments which manufacture or store the products referred to in Article 3 (1) and to the undertakings which transport the products (hereinafter referred to as "undertakings"). Undertakings shall be obliged to allow inspection operations to be carried out in their establishments.
(2) Staff of the State Inspection are entitled to require the necessary documents, data and explanatory notes in the course of their activities. The relevant staff of the undertaking shall be obliged to provide them with such documents, particulars and explanatory notes.
(3) Workers of the State Inspection have the right and obligation to require the undertaking's responsible staff to take the necessary measures to remedy the deficiencies identified and their causes.
§ 5
The opinions, analyses and certificates on the quality of food and agricultural products, issued by the State Inspection Authorities, shall be binding on the participants as well as on the authorities and other public administrations, but not on the courts and authorities of the State Arbitration.
§ 6
As regards seed and lard, the authorities of the State inspection shall examine only the taking-over, preparation, storage and disposal of seed and seed in undertakings subordinate to the Ministry of Food Industry and the purchase of agricultural products; otherwise the provisions of this Regulation shall not apply to seed and lard.
§ 7
(1) Details of the organisation and scope of the State Inspection will be provided by the Minister for Food and the Purchase of Agricultural Products with the Government's approval.
(2) The implementing rules for this Regulation shall be issued by the Ministry of Food and Agricultural Products in agreement with the central offices and authorities involved.
§ 8
Government Decree No. 8 / 1953 Coll., on State Quality Inspection, and the provisions issued for its implementation, are hereby repealed.
§ 9
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Minister for Food and Agricultural Products in agreement with the participating members of the Government.
