on the return of Czechoslovak citizenship to persons of German and Hungarian nationality.
The Government of the Czechoslovak Republic hereby orders, pursuant to § 3 of the Constitutional Decree of the President of the Republic of 2 August 1945, No 33 Coll., on the modification of the Czechoslovak citizenship of persons of German and Hungarian nationality (hereinafter referred to as the Constitutional Decree):
General provisions on the acquisition of Czechoslovak citizenship shall apply to the return of Czechoslovak citizenship to persons who have lost them pursuant to § 1 of the Constitutional Decree, unless the constitutional decree otherwise implies or otherwise provides for.
The application for the return of Czechoslovak citizenship is decided within five years of the end of the deadline for the submission of applications (§ 3, sentence of the first constitutional decree). However, the request may be granted validly only if three years have elapsed since the date of expiry of the time limit for submission of applications.
(1) Czechoslovak citizenship can only be returned to an applicant who has not violated the obligations of a Czechoslovak national, has not acquired another nationality and has permanent residence in the Czech Republic.
(2) An applicant who has completed or no later than the last day of the period laid down for the submission of applications shall complete the 14th year of age shall also demonstrate to his proportions adequate knowledge of Czech or Slovak. In cases of consideration, the Ministry of the Interior may waive, in whole or in part, the filing of this licence.
Czechoslovak citizenship can also be returned to the applicant, who does not have a home right in a village of the Czechoslovak Republic or does not have the property or earnings needed to feed his or her family.
(1) An applicant who has submitted an application for the return of Czechoslovak citizenship within the time limit which has not been found to have infringed the obligations of a Czechoslovak national citizen and who, according to his behaviour, can be expected to become a proper Czechoslovak national citizen, the locally competent district national committee may issue a certificate certifying that it is considered to be a Czechoslovak national citizen before the application is processed.
(2) The District National Committee may withdraw this certificate at any time.
(3) The Regional National Committee shall exercise the powers referred to in paragraphs 1 and 2 under the Directives of the Ministry of Interior.
(1) The provisions of § 2, § 3, § 2 and § 5 do not apply to applicants who have submitted an application for the return of Czechoslovak citizenship within a period which began with the Order of the Minister of the Interior of 25 August 1945, No 51 Coll., on the deadline for applying for the return of Czechoslovak citizenship for the wives and children of Czechoslovak citizens.
(2) The provisions of Sections 2 and 5 do not apply to applicants who have submitted an application for the return of Czechoslovak citizenship within a period which was established by the Order of the Minister of the Interior of 20 December 1946, No 254 Coll., on the deadline for the submission of applications for the return of Czechoslovak citizenship to a husband of Czechoslovak state citizens.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Home Secretary in agreement with the participating members of the Government.
