requiring means of transport for an exceptional economic period.
On the proposal of the Government,
§ 1.
(1) During the exceptional economic circumstances, the district national committees are entitled to require means of transport for particularly important economic purposes, for example, for the sugar industry campaign, for potato harvesting and for the transport of coal.
(2) Means of transport means horses and other towing animals, vehicles for animal cover, lorries and suitable vessels (all and with accessories).
§ 2.
(1) Any holder of a means of transport, if not exempted under this Decree, is required to register his means of transport under the Ordinance of the District National Committee and is either to be surrendered for use at a specified time and place of use, or to carry out his own means of transport, or to carry out orders.
(2) The holder is the owner of the means of transport and, if the means of transport is not with him, the person in his power. The holder of a foreign nationality shall also be liable.
(3) Means of transport will not be drawn up and called upon,
(a) held by persons enjoying the rights of exteritoriality;
(b) which are in the use of military power and friendly armies;
(c) belonging to the State, to state undertakings and to the institutes, to the local authorities and to postal operators.
§ 3.
(1) In agreement with the Ministry of Interior and the Ministry responsible for economic conditions and after hearing the Single Union of Czech Farmers, the Ministry of Transport is responsible for the establishment of the General Directive on the occupation of means of transport. In doing so, care shall be taken according to the possibility of a uniform load of individual districts.
(2) The means of transport will be called upon for the need of local national committees, other bodies, persons or undertakings under the general directives to do so.
(3) If means of transport are needed for the need for defence power, it is necessary to satisfy its requirements in particular.
§ 4.
(1) Issue of means of transport, after removal, shall normally be in writing to the holder.
(2) Means of transport should also be provided with accessories, including, in particular, harness, saddles, fuel and standard equipment.
(3) When storing such supplies, account shall be taken, as far as possible, of uniform stratification throughout the district or part thereof adjacent to the transport centre and of the risk to the operation of the holding or holding of the holder, in particular where the undertaking is an undertaking relevant to the public.
§ 5.
(1) It is for the authority or person designated by the district national committee to take over the means of transport. If the holder is not known or is not present by himself or a representative authorised by him, the means of transport shall be taken over in the presence of a representative of the local national committee.
(2) Means of transport should be returned to the holder after the cessation of the need. If, for any reason, it is not possible to return the means of transport, it shall, for the time being, be left to the local national committee for the cost and danger of the former holder.
§ 6.
(1) The District National Committee, acting on a proposal from the holder for the use of a means of transport or for carrying out an ordered removal, shall fix a refund of a reasonable amount according to local circumstances and within the limits of the applicable price regulations.
(2) The rights and obligations of the holder and of the person for whose benefit the means of transport has been used or carried out shall be assessed in accordance with the general Civil Code.
§ 7.
The decisions of the District National Committee under § § 1 to 4 are final and enforceable by political execution.
§ 8.
If the offence is not more severe, he will be punished by the District National Infringement Committee by a fine of up to 100,000 K or a punishment on the loose within six months or both:
1. who, at the request of, made in accordance with this decree or regulations issued pursuant to it, does not declare the means of transport or make incorrect indications thereof;
2. who infringes the obligation to hand over the means of transport or to carry out or to carry out their means of transport the transport ordered, as well as who endangers or thwarts the proper performance of that obligation;
3. Who does something that could make it difficult or jeopardise the purpose of this decree.
§ 9.
Where this decree refers to the District National Committee, this includes the District Administrative Commission or the Local National Committee, which exercises the jurisdiction of the District National Committee.
§ 10.
This Decision shall take effect on the day of its publication; It shall be implemented by the Home Secretary in agreement with the Ministers involved.
