DECLARATION
of 16 March 2010
on measures to ensure protection against the introduction and spread of Potato PWN and Yellowish PWN and amending Decree No 332 / 2004 Coll., on measures to ensure protection against the introduction and spread of potato cancer agent, Potato PWN and Yellowish PWN
According to Article 88 (2) of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the Amendment of Certain Related Acts, hereinafter referred to as "the Act ', as amended by Act No. 249 / 2008 Coll., for the implementation of § 71 (1) (h) of the Act:
MEASURES TO PROTECTION THE PROTECTION AGAINST THE INSTALLATION AND DISSEMINATION OF THE BRAMEBOURY HATTLE AND THE NATURAL HAT
Subject matter
This decree implements the legislation of the European Union1) and provides for measures to be applied in the Czech Republic against the introduction and spread of Potato PWN (Globodera rostochiensis Woll.) and Yellowish PWN (Globodera pallida (Stone) Behrens) ("PWN ').
Terms
For the purposes of this decree:
(a) host plants - potato plants Solanum tuberosum L., plants with roots of capsicum spp., tomato of edible Solanum lycopersicum L. and eggplant of egg plant Solanum melongena L.,
(b) suspicion of the presence of PWN - a condition following the detection of symptoms of its possible presence on the host plant or on soil or other growing medium (hereinafter referred to as "soil"), pending confirmation or refute by expert investigation,
(c) expert investigation - verification of the presence of PWN, including the verification of its pathotype, identification of the origin of PWN, assessment of the possibilities for its dissemination and possible implementation of the demarcation survey;
(d) the presence of PWN - the detection of at least one cyst of PWN in a sample of soil the life of which has been demonstrated by a biological test or the finding of live embryos or larvae of that PWN in a cyst, or the detection of at least one PWN infested plant or part thereof;
(e) an aggressive pathogen of PWN-PWN, capable of attacking and reproducing potato varieties resistant to Potato PWN (Globodera rostochiensis Woll.) of the Ro1 pathogen,
(f) a potato variety resistant to a particular pathogen of PWN, a potato variety which, when grown, causes a natural annual decline in the population of that pathogen,
(g) land - the natural part of the agricultural land defined by the type of land or separated from neighbouring land by the interface between the use of the land;
(h) contaminated land or object - land or object on or in which PWN has been detected and verified;
(i) land or object suspected of being infected - land or object likely to have spread or may spread PWN;
(j) an officially established area - a cadastral territory outside a closed growing area (2);
(k) a large catering centre - a mass catering facility in which the treatment of waste in accordance with point C (b) of Annex 6 to this Regulation is ensured when consumable potatoes are used from the territory concerned by the exceptional plant health measures ordered because of the presence of PWN.
Preventive measures
(1) Propagating material (3) of potato intended for marketing may only be grown on land on which, in accordance with Article 10 (1) of the Act, a survey of the presence of PWN has been carried out since the last potato harvest for the production of propagating material, by collecting and testing soil samples from the land referred to in Annex 2 to this Decree. The carrying out of this survey and its negative result are one of the requirements for the characteristics of the parcel on which potato propagating material will be grown and is a condition for the recognition of potato propagation under another law (4).
(2) Farmer's potato seed (5) can only be grown on land on which, in accordance with Article 10 (1) of the Act, a survey of the presence of PWN has been carried out since the last potato harvest for the production of the crop, in accordance with Article 10 (1) of the Law, by collecting and testing soil samples from the parcel in accordance with Annex 2 to this Decree.
(3) Plants intended for cultivation listed in Annex 1 to this Regulation and intended for marketing may be grown only on land on which, in accordance with Article 10 (1) of the Act, a survey of the presence of PWN has been carried out between the harvest of the last crop on the parcel and the planting of plants listed in Annex 1 to this Regulation with a negative result, by sampling and testing of soil samples from the parcel referred to in Annex 2 to this Regulation. The survey may be carried out earlier if it is documented by confirmation that the presence of PWN has not been detected by this survey and that host plants have not been grown on this parcel since the survey was carried out. For plants intended for cultivation referred to in point 2 of Annex No 1 to this Decree, this survey may be replaced by a verification that:
(a) there is no record in the last 12 years of the presence of PWN on that plot based on the results of the relevant officially approved testing; or
(b) there are crop records according to which host plants have not been grown on that parcel in the last 12 years.
(4) The survey referred to in paragraphs 1 to 3 shall be carried out at its expense by the propagator of potato propagating material, the farmer of potato seed or the grower of plants intended for cultivation listed in Annex 1 to this Regulation, including the timely delivery of samples to the place of analysis. Soil sampling shall be carried out under the direct supervision of an official of the Central Control and Examination Institute of Agriculture (hereinafter referred to as "the Institute ') who shall seal the samples taken with an official seal.
(5) The survey referred to in paragraphs 2 and 3 shall not be required for the parcel where the plants intended for cultivation are to be grown to be planted within the same place of production in an officially designated area or for the parcel where the plants listed in point 2 of Annex No 1 to this Regulation are to be grown, to be subjected to the officially approved measures referred to in point A of Annex No 3 to this Regulation.
(6) The possession of PWN shall be prohibited in accordance with Article 7 (1) of the Act, except for the retention for scientific, breeding or diagnostic purposes permitted by the Institute pursuant to Article 8 (1) of the Act, provided that the protection measures in the presence of PWN are not affected or there is no risk of spreading it.
(7) The Institute confirms the resistance to the PWN pathogens listed in Annex 4 to this Decree for varieties and new breeding of potatoes registered for the testing of potato varieties for registration, carried out by the Institute under the Law on the circulation of seeds and seeds6).
(8) Data on the resistance of potato varieties against PWN, including its pathogens, which have been confirmed by testing in accordance with paragraph 7, are published by the Institute in the List of Varieties registered in the Czech National Variety Book, issued under the Law on the circulation of seeds and seeds7). The data on resistance of potato varieties against PWN shall also be communicated by the Institute to the European Commission ("the Commission ') by 31 January each year by the reporting of species, pathogens, groups of virulence or populations against which the varieties are resistant, the degree of resistance according to the scale referred to in point A of Annex 4 to this Decree and the year when the resistance was determined. The Institute shall publish, by 1 March each year, data on the reaction of potato varieties against PWN (including its pathogens) in the Bulletin on the basis of testing carried out in accordance with paragraph 7 and data received by the Institute from Member States.
Detection and registration of PWN
(1) The occurrence of PWN is detected by the Institute by surveys in accordance with Section 10 (1) of the Act and by systematic plant health checks in accordance with Section 15 (2) of the Act, namely:
(a) control of host plants; or
(b) taking and testing soil samples.
(2) The scope and manner of inspection of host plant crops and the method of sampling of plants and soil and methods of analysis or testing them and the scope of application of these methods are determined by the Institute by an official communication in the Bulletin on the basis of scientific and statistical principles and biology of PWN, taking into account host plant production systems and the current situation in the occurrence or risk of introduction of PWN. On land where seed potatoes are grown, the size of the PWN survey shall be at least 0,5% of the area of the seed potatoes in the relevant year.
(3) The Institute shall notify the other Member States and the Commission in writing once a year of the results of the PWN survey in accordance with Section 10 (5) of the Act. The results of the survey on parcels where seed potatoes have been grown shall be notified annually to the Commission by 1 April for the previous growing season.
(4) The suspected or confirmed occurrence of PWN due to failure or change in the effectiveness of resistance of a resistant potato variety related to an exceptional change in the composition of the species, pathogen or group of PWN virulence shall be notified to the Institute in accordance with Sections 9 and 13 of the Act. The Institute shall ensure that the PWN species and, where appropriate, the pathogen or group of virulence are examined and confirmed. Detailed information on these occurrences shall be transmitted in writing to the Commission and the other Member States by 31 December each year.
Measures to detect suspected presence of PWN
(1) In the event of the detection or notification of suspected presence of PWN, the Institute shall verify the presence in the framework of the expert investigation provided for in Section 76 (2) of the Act by a method based on scientific and statistical principles and on the knowledge of the biology of the harmful organism in order to confirm or refute that suspicion.
(2) If there is a risk of delay, the Institute shall, pending any refusals of suspected occurrence or of the regulation of emergency plant health measures on the basis of the result of a professional investigation carried out in accordance with Article 76 (2) of the Act,
(a) prohibit the movement of all lots of plants and soil coming from parcels or objects from which samples have been taken with a reasonable suspicion of PWN and from parcels or objects suspected of infestation likely to have spread or may spread PWN, with the exception of lots of plants which do not pose a identifiable risk of spreading PWN or which are subject to measures under the supervision of the Institute which excludes that risk; or
(b) order other appropriate measures appropriate to the degree of estimated risk of further possible spread of PWN in order to prevent such spread and ensure the supervision of the movement of all other lots of host plants placed on the market.
Measures following confirmation of PWN
(1) If, on the basis of the verification of the suspected presence of PWN pursuant to Article 5 (1), the Institute confirms the presence of PWN, it shall carry out, pursuant to Article 76 (2) of the Law and under other legislation8), a technical investigation with a view to assessing the facts set out in Annex 5 to this Decree, including a verification of whether the PWN is an aggressive pathogen by a method established on the basis of scientific and statistical principles and biology of PWN and published in the Bulletin, where appropriate a demarcation survey of the presence of PWN on other parcels or objects suspected of its occurrence.
(2) Upon completion of the expert investigation referred to in paragraph 1 and in accordance with its outcome, and where appropriate on the basis of the result of the demarcation survey, the Institute shall designate the land or object as infected with PWN and the relevant potato or plant parts listed in Annex 1 to this Decree which come from the contaminated parcel or object or have been in contact with the contaminated soil as affected by the PWN.
(3) If the verification referred to in paragraph 1 establishes the presence of an aggressive pathogen of PWN, the Institute shall carry out testing for its virulence and identification by a method established in accordance with scientific and statistical principles and with the biology of PWN and published in the Bulletin. Information on this occurrence shall be transmitted to the Commission and the other Member States by 31 December each year.
(4) Where the presence of PWN is confirmed, the Institute shall define the territory in which it will include the contaminated land or object and where it is likely to be spread outside that land or object, as well as the other land or objects referred to in Article 5 (2) (a) (hereinafter referred to as "quarantine territory ') to a sufficient extent to prevent the spread of PWN outside that territory. In the quarantine area, the Institute shall order emergency plant health measures in accordance with Sections 7 and 8.
(5) If, on the basis of the outcome of the expert inquiry referred to in paragraph 1, the Institute finds that:
(a) host plants of PWN or plants intended to be moved to other parcels, grown on an infested parcel or in an infested object, shall not be placed on the market;
(b) the contaminated parcel or object is not or will not be used for the cultivation of host plants of PWN or plants intended to be transferred to other parcels, or used for storage in contaminated soil, with the intention of placing such plants on the market; and
(c) no further spread of PWN may occur from the contaminated parcel or object;
the quarantine area shall not be delimited and the regulations on emergency plant health measures shall be waived in accordance with Section 76 (6) (b) of the Act.
(6) Following the negative outcome of the PWN examination on all contaminated parcels and in all contaminated objects in the quarantine area pursuant to Section 8 (2), the Institute shall, in accordance with Section 76 (4) (b) of the Act, abolish exceptional plant health measures, indicating the facts underlying this Decision.
Exceptional plant health measures against the spread of PWN
(1) After confirmation of the presence of PWN, the Institute shall, in accordance with Article 11 (1) of the Act, order in the quarantine territory appropriate exceptional plant health measures under Section 76 (2) (a) of the Act.
(2) On contaminated land, possibly in contaminated premises in quarantine territory
(a) wild host plants must be sought and disposed of [Paragraph 76 (1) (a) of the Act];
(b) potatoes and plants intended for cultivation listed in Annex 1 to this Regulation shall not be grown, except in the cases referred to in (c), and plants intended for planting on other parcels, nor shall they be kept in such a way that their contact with contaminated soil may occur [Paragraph 76 (1) (a) of the Law];
(c) may be grown:
1. seed potatoes for the purpose of:
1.1. Hunting PWN pursuant to Annex 7 to this Decree [Paragraph 76 (1) (a) of the Act]; or
1.2. Possession of PWN for scientific, noble or diagnostic purposes by decision of the Institute pursuant to § 8 (1) of the Act;
2. in the event of the occurrence of Potato PWN (Globodera rostochiensis Woll.) of the Ro1 pathogen-free potatoes of resistant varieties against this pathogen at an interval established by the Institute, the grower shall always notify the cultivation of potatoes, including the variety of the Institute [§ 76 (1) (a) of the Act],
3. the plants listed in point 2 of Annex 1 to this Decree, provided that they are subject to the officially approved measures referred to in point A of Annex 3 to this Decree [Paragraph 76 (1) (a) of the Act].
(3) The Institute shall authorise the cultivation of potatoes on an infested parcel or in an infested object as referred to in paragraph 2 (a) within the framework of the prescribed emergency plant health measures. (c) only if the risk of spreading PWN is excluded, in particular by ensuring that the conditions for the possible transport and use of harvested potatoes listed in Annex 8 thereto are met.
(4) Potato propagating material shall not be grown on other parcels or other objects in the quarantine area in the year following the year of detection of PWN. In subsequent years, only potato varieties resistant to locally occurring PWN pathogens may be grown on these parcels, but not more frequently on the same parcel than once every 4 years [Paragraph 76 (1) (a) of the Law].
(5) Potato lots identified as infected with PWN pursuant to Article 6 (2) may be used:
(a) after cooking or mating in a steam facility at a temperature of at least 80 ° C for at least 15 minutes for feeding or consumption in the holding or household of the owner of the land, or in another holding or household in the same quarantine territory [Paragraph 76 (1) (a) of the Act];
(b) for industrial processing [Paragraph 76 (1) (a) of the Act] in processing plants in accordance with point B of Annex 3 to this Decree, i.e. in plants which are equipped with sedimentation tanks for the installation of solid particles from floating and washing waters provided with a device (submersible wall) preventing foaming and light particles from draining from the pit;
(c) for consumption in large food centres, unless they come from an area contaminated by an aggressive disease type of PWN (§ 76 (1) (a) of the Act); or
(d) to be consumed by packaging prepared for direct delivery to the place of consumption and used without changing as table potatoes, but only if the early potatoes are of a resistant variety against PWN and do not come from land infested with an aggressive pathogen PWN [§ 76 (1) (a) of the Act].
(6) Plants referred to in point 2 of Annex No 1 to this Decree designated as infected with PWN pursuant to Article 6 (2) may not be grown unless they have been subjected to the officially approved measures referred to in point A of Annex 3 to this Decree [Paragraph 76 (1) (a) of the Law].
(1) Potatoes originating from other parcels or objects in the quarantine area with the presence of an aggressive disease type PWN may be used
(a) in the same quarantine area or in another quarantine area with the presence of the same pathotype of PWN for any purpose, with the exception of use for planting [Paragraph 76 (1) (a) of the Act];
(b) industrial processing [Paragraph 76 (1) (a) of the Act];
(c) for consumption in large food centres [Paragraph 76 (1) (a) of the Act]; or
(d) to be consumed by packing prepared for direct delivery to the place of consumption and used without repackaging as table potatoes [Paragraph 76 (1) (a) of the Act].
(2) If a new presence of PWN is found near the site where potato propagating material is produced and which is suspected of being infested in quarantine territory, potato propagating material from that site may be placed on the market only after examination of its ininfested status by the Institute by collecting and testing soil samples from the relevant plot [§ 76 (1) (a)].
(3) Potatoes, plants listed in Annex 1 to this Regulation, and plants intended for planting on other parcels, soil, manure and compost, may be moved from the quarantine territory only under the authorisation of the Constitution, issued at the request of the legal or natural person concerned and under the conditions laid down therein. The Institute shall only approve such sites and uses of the transferred material and shall lay down the conditions laid down in Annex 8 to this Decree in order to avoid the identifiable risk of spreading PWN [Paragraph 76 (1) (a) of the Act].
(4) The seed potatoes and host plants referred to in point 1 of Annex No 1 to this Decree designated as infected with PWN pursuant to Article 6 (2) may not be grown unless they have been decontaminated under the supervision of the Institute using the appropriate methods adopted in accordance with the procedure laid down in the European Community Regulation (9) which exclude the risk of spreading PWN [Paragraph 76 (1) (a) of the Law].
(5) Machinery, means of transport, tools and footwear or other articles used
(a) on an contaminated parcel or in an infested object, the soil must be cleaned of the premises before being moved from that parcel or, where appropriate, the soil and, before being used on another parcel or object, washed with water in the quarantine area, at a place from which the PWN cannot be expanded; if they are a plot with an aggressive pathogen, they must be disinfected in accordance with the procedure laid down by the Institute in accordance with Annex 6 to this Decree [Paragraph 76 (1) (a) of the Law]; and
(b) on other grounds and in other objects in the quarantine territory, the soil (§ 76 (1) (a) of the Act) must be cleaned before being moved outside that territory.
The measures referred to in points (a) and (b) shall be taken by the user of the land or object concerned.
Review of contaminated land and objects
(1) Examination of the infestation of the land or object identified as infected with PWN shall be carried out by the Institute in accordance with Section 76 (4) (b) of the Act.
(a) not earlier than six years after the last finding of PWN on this parcel or in this building or the last potato cultivation; or
(b) at the request of the owner or user of the contaminated parcel or object, not earlier than 3 years after the last finding of occurrence on or in that site, if the contaminated parcel has been subject to the supervision of the Institute of their method of destruction referred to in Annex 7 to this Decree, or if its rendering has been carried out in the contaminated object under the supervision of the Institute or in this object used in the soil, the methods of destruction referred to in Annex 7 to this Regulation.
(2) If the presence of PWN is not detected during the examination of the plot or object, the inspected plot or object shall be considered to be uninfested and the Institute shall abolish the exceptional plant health measures ordered under Sections 7 and 8.
(3) The examination referred to in paragraph 1 shall be carried out in accordance with Annex 3 to this Order, point C, using the methods set out in Annex 2 to this Order. The results of the examinations shall be part of the PWN register maintained in accordance with Section 4 (4).
Transitional provision
The results of the surveys carried out before 1 July 2010 may be considered as results of the surveys referred to in points 3 (b) and (c) of Annex 2 to this Regulation.
Amendment of the Decree on measures to ensure protection against the introduction and spread of potato cancer, potato PWN and yellow PWN
Decree No 332 / 2004 Coll., on measures to ensure protection against the introduction and spread of potato cancer, potato nematodes and yellowish nematodes is amended as follows:
1. In Section 1, the words "Potato PWN (Heterodera rostochiensis = Globodera rostochiensis Woll.) and Yellow PWN (Globodera pallida (Stone) Behrens) 'are deleted.
2. footnote 1 shall read:
"(1) Council Directive 69 / 464 / EEC of 8 December 1969 on the protection against potato cancer."

Terms
For the purposes of this decree:
(a) cause of cancer - fungus [Synchytrium endobioticum (Schilb.) Perc.],
(b) host plants - potatoes (Solanum tuberosum L.),
(c) a suspicion of the occurrence of a cancer agent - a condition following the detection of symptoms of its presence on the host plant or in the soil lasting until the occurrence is confirmed or refuted by an objective expert investigation;
(d) expert investigation - verification of the occurrence of cancer, including the verification of its pathogen, identification of the origin of the cancer, assessment of the possibilities for its spread and possible implementation of a demarcation survey;
(e) the occurrence of a cancer agent - the detection of at least one cancer agent of an infected plant or part of it or the detection of permanent zoosporangia of a cancer agent;
(f) an aggressive pathogen - a pathogen of a cancer agent capable of attacking and reproducing potato varieties resistant to or resistant to the cancer agent of a pathogen,
(g) potato variety resistant to a particular pathogen of the cancer agent - potato variety which reacts to the infestation of the populations of that pathogen of the cancer agent in such a way that there is no risk of secondary infection;
(h) contaminated land or object - the property or object on which or where the occurrence of the cancer agent has been detected and verified;
(i) land or object suspected of infestation - land or object likely to have spread or may spread to the cancer agent;
(j) a large catering centre - a mass catering facility for persons in which the treatment of waste in accordance with point C (b) of Annex 6 to this Regulation is ensured when consuming table potatoes from the territory concerned by the exceptional plant health measures ordered because of the occurrence of the cancer agent. "
4. In Article 3, paragraphs 1 and 2 are deleted.
Paragraphs 3 to 5 shall be renumbered paragraphs 1 to 3.
5. In Article 3 (1), the words "and PWN 'and" or PWN' are deleted.
6. In Article 3 (2), the words "and Ro1 Potato PWN (Heterodera rostochiensis = Globodera rostochiensis Woll.) 'and the words" and PWN' are deleted.
