laying down the technical conditions for the establishment, use and protection of mining works selected for use in crisis situations for the application of preventive, technical and security measures and the carrying out of checks
The Czech Mining Office provides pursuant to § 40 (3) of Act No. 240 / 2000 Coll., on Crisis Management and on the amendment of certain laws (Crisis Act) for the implementation of § 9 (3) (b):
§ 1
Scope
The decree covers underground spaces created for the performance of tasks arising from the Crisis Act, mining works and underground spaces originally set up for another purpose and subsequently selected for use in crisis situations, such as exploratory, preparatory and opening works, collectors, tunnels and underground facilities and the relevant parts of caves selected for that purpose ("special mining works') .1.
§ 2
Use of special mining works
(1) Special mining works must be selected in such a way as to ensure that persons are protected by their location and implementation against the potential danger of life, e.g. through natural disasters, environmental or industrial accidents.
(2) In the event of a risk of default, mining works built as part of mining or mining activities may also be used. Such mining works shall comply with the safety requirements set out in § 5 (1) to (6).
§ 3
Establishment and maintenance of special mining works
The establishment of special mining works intended for use in crisis situations shall be subject to general rules for the setting up of mining works 2) and to specific regulations.3)
§ 4
Ensuring the estuary of special mining works
The estuary of the special mine work on the surface shall be carried out in such a way as to withstand a natural disaster, an ecological or industrial accident that can be expected, or a breach of public policy that would jeopardise the safety of persons in a special mine work. In the event that the opening is secured by a door, this door shall comply with the requirements of the first sentence of Article 5 (8).
§ 5
Safety requirements for special mining works
(1) A special mine work must have a inclination from a horizontal plane of less than 20 °. For ventilation purposes and as an escape route, mining works with a bow may be selected.
(2) Special mining works must not be threatened by water and mud streams, sudden gasification, gas explosions, rock, coal and gas breaks, or by mining shocks.
(3) The reinforcement of the special mine, including, where appropriate, the sizing, shall be non-flammable and shall be safely resistant to expected mountain pressures. Only non-combustible material may be filled in free space for reinforcement.
(4) The special mining work must be continuously ventilated so that the content of pollutants in the air does not exceed the values laid down in the special regulation.4) In a special mine where the presence of methane cannot be excluded, ventilation must be ensured so that the concentration of methane in the air does not exceed 1%.
(5) Special mining work must be drained. In cases where increased water inflows to a special mine work can be expected, a sufficiently dimensioned pumping device shall be provided and a water pumping line installed.
(6) The floor of the special mine must be drained and free of inequalities and obstacles and made of material which ensures safe walking.
(7) The special mine work, including the escape route, shall be illuminated at the full length. In addition, emergency lighting lamps shall be installed in this mine. For lighting, an independent power source shall be provided for at least 72 hours of emergency lighting operation.
(8) The entrance doors to the special mine shall be designed to withstand the effects against which they are to provide protection or against which the special mine is to be protected. The entrance to a special mine must always be protected by a pair of entrance doors which open against each other. The door shall be at least at a distance from each other so that one is always closed when passing through with the stretchers.
(9) The underground access routes to or escape from the special mine shall comply with the requirements of paragraphs 1 to 6.
(10) Special mining work must be permanently separated from other mining works, underground spaces, or accessible parts of caves.
(11) A continuous measurement of CO2 and CO and, where appropriate, methane and other harmful gases likely to occur shall be ensured for the time of the emergency. The gauges or sensors shall be located where harmful gases can be expected to occur.
§ 6
Checks on special mining works
The technical condition of the special mine must be checked at least once every six months. This inspection shall check in particular the composition of the mine air in terms of the presence of CO2 and CO, or methane and other harmful gases, the state of the mine reinforcement, the state of the buildings separating the mine work from other underground spaces and the functionality of the entrance door, lighting including an independent source of energy, and, if a special mine work is equipped with it, the pumping system. A record of the results of the inspections shall be kept for at least 3 years.
§ 7
Efficacy
This decree shall take effect on the day of its publication.
