on special additional leave for workers working in underground coal and lignite mines
The Government of the Czechoslovak Socialist Republic, in agreement with the Central Council of Trade Unions, hereby orders pursuant to § 105 (3) of the Labour Code No. 65 / 1965 Coll., as amended by Act No. 72 / 1982 Coll.
§ 1
Workers with a permanent place of work under the ground of deep-sea coal and lignite mines engaged in employment as defined in the pension regulations, (1) who work the shifts fixed in advance by the mining scheme for Saturday, (2) are entitled to a special additional leave of one day for each Saturday so worked.
§ 2
(1) The special additional leave is for the workers referred to in § 1 who work the entire shift, beginning with the Saturday fixed in advance by the mining scheme (hereinafter referred to as the "shift").
(2) For the purposes of special additional leave, the periods referred to in § 64 (1) and (2) of the Decree of the Government of the Czechoslovak Socialist Republic No 54 / 1975 Coll., implementing the Labour Code, shall not be considered as work. If the worker does not complete the shift due to an accident at work which is the responsibility of the organisation or because of a sudden illness during the shift requiring medical examination or treatment, the shift shall be considered as being worked for the purposes of the special supplementary leave.
§ 3
(1) The failure of the shift or part of the shift, where the organisation, in agreement with the race committee of the basic organization of the Revolutionary Trade Union Movement, does not excuse the absence of a worker at work, is considered as an unexcused absence in work.3)
(2) No entitlement to special supplementary leave shall be granted if the worker unconditionally misses a different shift in the calendar month in which the mining regime for the shift was fixed in advance for Saturday.
§ 4
When determining the taking of leave, an organisation may, with the prior agreement of the Race Committee of the Revolutionary Trade Union Movement, allow the use of a special supplementary leave covering the calendar year in whole until the end of the next calendar year, provided that it cannot, for serious reasons, determine its embarkation in such a way that such leave ends no later than 30 April next year.
§ 5
(1) Special supplementary leave is for the worker, even if he is entitled to supplementary leave under Section 105 (1) of the Labour Code, subject to the conditions laid down in Section 2 (1).
(2) No compensation may be granted for special additional leave; this leave must always be exhausted, preferably.
§ 6
Save as otherwise provided in this Regulation, special supplementary leave shall be subject to recovery leave provisions.
§ 7
This Regulation shall enter into force on 1 July 1982.

1) Part I of the Annex to the Decree of the Government of the Czechoslovak Socialist Republic No. 74 / 1982 Coll., on certain adjustments to sickness insurance and pension insurance for miners.
(2) The exchanges provided for by the mining regime for Saturday in deep-sea coal and lignite mines shall mean the shifts thus fixed in advance for the following calendar year and approved by the Group Director-General in agreement with the relevant trade union.
