on repeated projects
The Federal Ministry of Technical and Investment Development provides, pursuant to § 53 (a) and (b) of Act No. 133 / 1970 Coll., on the jurisdiction of federal ministries, and § 130 of Act No. 50 / 1976 Coll., on zoning and construction regulations (Construction Act):
Purpose of the Order
In order to ensure the rationalisation of the pre-project and project preparation of the buildings and their implementation, and to stabilise the budgetary costs of the buildings, the Decree sets out a uniform method for the re-use of implementation or one-stage construction projects and operational files.
Scope
The decree covers project preparation of building buildings and operating sets of buildings, the preparatory and project documentation of which is secured according to special regulations; 1) it does not apply to project preparation of building objects for which an obligation to apply the type of building objects.2)
Definition of terms
(1) A reproducible project is an implementation or one-stage project of a building building or an operating file, adapted in accordance with § 4 (4) (a) and (b), which is included in the central register of reproducible projects (hereinafter referred to as "central register").
(2) The repeated project is a reproducible project used for the processing of project documentation, supplemented by a project solution of an unrepeatable part of the building or operating file.
(3) The Authorising Organisation is an organisation which has developed an implementation or one-stage project of a building or operating complex (hereinafter referred to as the "project") selected for repetition.
Project selection and adaptation
(1) The selection of projects suitable for repetition must be carried out by the central investor body for which the projects have been processed on its own initiative or on the proposal of the other central authorities. If the central investor body is the Regional National Committee, it shall discuss the appropriateness of the selection with the relevant sectoral central body. The selection proposals may also be submitted by project, investment and supply organisations through their central bodies.
(2) For repetitions, projects implemented or completed that have been agreed on sales costs and whose technical and economic parameters are progressive compared to the approved system of technical economic indicators and, if not published, data and indicators of progressive domestic and / or foreign building buildings and operating sets of the same type or their projects may be selected. Only projects for which pre-sales prices have not been used in the agreed sales costs or have already been replaced by wholesale prices may be selected.
(3) The projects selected must be adapted for the purpose of repetition. The modification shall be made by the copyright organisation at the request of the central investor body making the selection. The implementation of the adjustment is ensured by an economic contract.
(4) The author organisation in the project modification:
(a) identify and identify in an effective manner in the project the reproducible part thereof;
(b) the allocation of the basic costs of the agreed sales costs for the renewable part of the project; If the sales agreement has changed, in particular for defects in the project, it shall adjust the costs allocated taking into account these factors,
(c) draw up a draft fiche on reproducible project3) (hereinafter referred to as the fiche), which contains in particular identification data on the selected project, a general description, technical characterisation4) reproducible part of the building or operating file, its user, technical and economic parameters 5) and the sales costs allocated under (b);
(d) processing the registration task.3)
Valuation
The evaluation of repeated projects and activities by the author organisation pursuant to Article 6 (3) shall be governed by specific rules. 15)
Deciding discrepancies
Disputes between construction participants as to whether and how a reproducible project is to be used shall be resolved by their central authorities, unless agreed upon by their superior authorities. If no agreement is reached between them, the Federal Ministry of Technical and Investment Development shall decide definitively where at least one of these participants is an organisation subordinate to a federal central body. In other cases, according to the investor's jurisdiction, the Ministry of Construction and Technology of the Czech Socialist Republic or the Ministry of Construction and Technology of the Slovak Socialist Republic shall decide.
Transitional and final provisions
(1) The central investor authorities are required to provide documentation for the establishment of central records; to this end, pursuant to the provisions of Section 4 of this Decree, they shall select projects suitable for repetition, ensure their adaptation and enter them in the central register referred to in Section 5 by 31 March 1978 at the latest.
(2) For the selection referred to in paragraph 1, the central investor authorities shall also use lists of reproducible projects drawn up under specific measures16) and summaries of reproducible projects issued prior to the application of this decree. 17)
(3) If the central investor authorities select to repeat a project that has been agreed on sales costs at the price level valid until 31.12.1976, they shall ensure that the costs allocated pursuant to Paragraph 4 (4) (b) are recalculated to the price level applicable from 1.1.1977 and that the costs recalculated are discussed with the supplier organisation designated by the competent central authority.
For the construction of a specific part of the state plan, projects shall be included in the central register only if they are entered by the competent central investor authorities in accordance with the procedure laid down in Section 5 (3) of this Decree.
The Decree shall take effect on 1 January 1978, with the exception of Article 6, which shall take effect on 1 May 1978.
