amending the Regulation implementing the Customs Act
The Foreign Trade Minister commands in agreement with the participating members of the Government pursuant to § 38 of Customs Act No. 36 / 1953 Coll.:
Čl. I
Paragraph 64 of the Order of the Minister for Foreign Trade No 31 / 1954 Coll., implementing Customs Act No 36 / 1953 Coll., is amended and read as follows:
„§ 64
Moved uppers
(1) Exemptions from customs duties shall be granted provided that their quantities are proportionate to the need of the converging persons and subject to the conditions set out below.
(2) Moved uppers are objects used by the moving person during his stay abroad for his own use in his household or profession (e.g. apartment, apparatus and tools, motor vehicles and other vehicles, live animals).
(3) Exemptions from customs duties shall also be granted for consumable articles in a quantity equal to the average annual consumption.
(4) In order to grant a customs exemption, it is irrelevant for the period during which the uppers moved abroad were used and whether they have signs of use.
(5) The customs exemption provided for in the preceding paragraphs shall be granted on condition that the exempted articles are further used or consumed by the moving persons and that they are not disposed of for 5 years, whether or not for a fee or free of charge, without prior authorisation of the customs authorities and without payment of customs duties.
(6) The persons moving shall be required to submit to customs a double list of the uppers moved and a declaration that the uppers moved are their property and that the duty-free uppers removed shall not be treated in a manner contrary to the provisions of paragraph 5. The persons referred to in paragraph 1 shall further demonstrate that they have been reported abroad for permanent residence and that they are moving to a permanent residence in the country or profession.
(7) The right to customs exemption is only applicable in respect of uppers which will be imported within two years of the entry into the country of the transferring person. Gradually imported uppers shall be exempt from customs duties only on condition that, on importation of their first part, all other uppers for which a customs exemption is claimed are notified to the customs authorities. A period of two years may be extended by customs for serious reasons.
(8) To the extent and under the conditions set out in the preceding paragraphs, the duties of the above-mentioned Czechoslovak nationals who, after their permanent residence abroad, move to the country for permanent residence shall be exempt.
(9) Moved uppers of Czechoslovak nationals who return from abroad after the end of their work or professional mission shall be released free of customs duties under similar conditions as referred to in paragraphs 1 to 7 but to the extent specified by the Central Customs Administration. '

This Regulation shall enter into force on the day of its publication.
