DECLARATION
Czech Mining Office
of 22 January 2002
on reserved electrical equipment
Pursuant to § 8a (8) (a) and (c) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, as amended by Act No. 124 / 2000 Coll.:
Subject matter
(1) This decree sets out which technical installations in mining and mining activities and those carried out in the mining and works related to these activities are considered to be dedicated electrical installations.
(2) The Decree further sets out the conditions for the competence of organisations (1) operating dedicated electrical equipment in terms of the necessary technical equipment and competence of their staff.
Reserved electrical equipment
(1) The reserved electrical equipment is:
(a) electrical equipment (2) in areas with a risk of explosion of gases and vapours, electrical equipment in areas with a risk of fire or explosion of dust or explosives, electrical equipment in areas with a view to the risk of electric shock of particularly dangerous (3) and electrical equipment in flowing mines (4) and coal mines, as well as equipment providing protection against lightning and the dangerous effects of static electricity in relation to such spaces and mines, 5)
(b) electrical power equipment (6) in and with other areas related to switching and control equipment; (7) control and safety circuits shall be considered as switching and control equipment.
(2) The following shall not be regarded as reserved electrical equipment:
(a) electrical equipment held in hand8) up to a voltage of 400 V AC or 440 V DC, unless this is firmly connected to the electrical network;
(b) electrical equipment portable 9) up to a voltage of 400 V AC or 440 V DC, unless this is firmly connected to the electrical network;
(c) electrical equipment not portable 10) or fixed 11) up to a voltage of 400 V AC or 440 V DC, unless this is firmly connected to the electrical network;
(d) movable connections and lines for electrical equipment up to 400 V AC or 440 V AC voltage In DC, having a phase or extreme conductor cross-section of 6 mm2 or less, unless they are firmly connected to an electrical network.
Professional competence requirements of organisations and the way in which they are examined for the issue of authorisations
(1) An organisation which complies with the requirements to ensure safety and health at work and safety of operation in the operation of dedicated electrical equipment laid down by special legislation (12) is competent for the installation, repair, revision and testing of dedicated electrical equipment and which has a valid authorisation for such operation by the district mining office. 13)
(2) An application for authorisation shall be lodged with the local central mining office in whose jurisdiction 14) the organisation shall have its registered office or place of business, as the case may be, or the natural person undertaking the place of residence. 15) If there is no such place on the territory of the Czech Republic, jurisdiction shall be governed by the place of intended activity to which authorisation is required.
(3) An organisation requesting the verification of professional competence and the issue of an authorisation for the installation, repair, revision and testing of dedicated electrical equipment shall demonstrate, as an alternative to the required scope of authorisation, at the latest when verifying the competence that:
(a) it has a competent person to manage works on a dedicated electrical installation, 16) where appropriate;
(b) it has the necessary technical equipment and facilities to operate;
(c) it shall ensure that the installation, repair and prescribed checks, tests and revisions of dedicated electrical equipment are carried out by a competent person with appropriate electrical expertise. 17)
(4) In the application for an organisation approval, it shall indicate the scope of the authorisation requested, the data demonstrating compliance with the requirements of paragraph 3 and thereafter:
(a) the trade name or name if it is a legal person, or the name and surname if it is a natural person;
(b) the registered office and, where applicable, the place of business of the legal person and, where appropriate, the address of the place of permanent residence of the natural person;
(c) the identification number, if any, or the date of birth of the natural person;
(d) the name and surname of the person responsible for the management of the work and the address of his place of permanent residence, including his / her certificate of competence and the date of birth.
(5) The Circular Mining Authority shall verify that the conditions for issuing the authorisation are met, otherwise it shall not issue the authorisation.
(6) The District Mining Authority shall indicate in the authorisation:
(a) the trade name or name if it is a legal person, or the name and surname if it is a natural person;
(b) the registered office and, where applicable, the place of business of the legal person and, where appropriate, the address of the place of permanent residence of the natural person;
(c) the identification number, if any, or the date of birth of the natural person;
(d) subject matter (assembly, repair, revision, testing),
(e) in the registration number, the scope of the activity referred to in the Annex;
(f) the date of issue of the authorisation and the period for which it is issued.
(7) The authorisation shall cease to be valid if the organisation fails to comply with the conditions set out in paragraph 3.
Transitional provisions
(1) Authorisations for the activities referred to in Article 3 (1), issued under existing legislation18) before 1 January 1993, remain valid until 31 May 2003.
(2) Authorisations for activities referred to in Article 3 (1), issued under existing legislation after 31 December 1992, remain valid until 31 May 2005. However, after 31 May 2003, the scope of the authorisation issued shall be considered to be within the scope of C 0 under this Order.
(3) Where existing legislation has not required a professional qualification for certain activities on dedicated electrical equipment, organisations may continue to carry out such activities without authorisation, but no later than 30 September 2002.
Efficacy
This Decree shall take effect on 1 April 2002.

Distinguishing characters of the scope of approval for installation, repairs, revisions and tests of dedicated electrical equipment
The authorisation shall contain the following distinguishing marks for that purpose:
I. Depending on the operating voltage of the dedicated electrical equipment:

Note:
For dedicated electrical equipment referred to in points (a) to (g), if the organisation requires a multi-range approval, a distinguishing mark corresponding to the highest range required shall be indicated in the approval. This shall not apply to electrical equipment referred to in points (h) to (j) for which the authorisation shall bear a distinguishing sign of all ranges for which the authorisation is issued.
