of 14 March 1990
laying down a new version of the military oath and of the official oath of members of the National Security Corps and of the Correctional Education Corps, adjusting the name of the Czechoslovak army, adjusting the proper leave of soldiers in the basic service and amending Act No. 40 / 1974 Coll., on the National Security Corps
The Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
The name "Czechoslovak People's Army" turns into "Czechoslovak Army."
Where the name "Czechoslovak People's Army" is used in legislation, this means "Czechoslovak Army."
Act No. 100 / 1970 Coll., on the service relationship of members of the National Security Corps, as amended by Act No. 63 / 1983 Coll., is amended as follows:
1. In Article 4, the following paragraph 4 is added:
"(4) Members shall be suspended from membership and activity in the political parties for the duration of the service.
2. Article 5 (3) reads as follows:
"(3) The official oath shall be:
"I, a member of the National Security Corps, solemnly declare my loyalty to the Czechoslovak Socialist Republic.
I'll be an honest, brave and disciplined member of the National Security Corps. In the performance of my duties, I will abide by the Constitution and the laws and protect the constitutional establishment of the Czechoslovak Socialist Republic, the rights of citizens and public order.
To do that, I am prepared to spend all my strength and ability and put my life on the line.
I swear! "
(1) A member of the National Security Corps or of the Correctional Education Corps who has taken an oath in accordance with its current wording shall be required to submit an oath in accordance with this Act within two months of the date on which the law takes effect, the member being granted a period of one month to consider whether he will take an oath in accordance with that law. If a member refuses to take an oath under this law, his service shall end on the day on which the refusal occurred. If a member does not take an oath at the time specified for his consideration, his service shall end on the last day of that period. In the event that the member of the service cannot take the oath for serious reasons within the prescribed period, he shall run a new period of one month after the failure to take the oath. The termination of the service in such cases shall be considered as termination of the service on serious personal grounds.
(2) An occupational soldier, (3) a soldier in another service4) and a retired soldier called temporarily to an active service5) (hereinafter referred to as "soldier") who has taken a military oath in accordance with its earlier wording, the commander is required to submit a military oath under this Act within two months of the date on which the act takes effect; the soldier must be given a period of one month to consider whether to take a military oath under this law. In the event that the soldier could not take the military oath for serious reasons within the prescribed period, he shall be running a new period of one month after the lapse of the reasons for which he could not take the military oath. If a soldier refuses to take a military oath under this law, he will be released from service by the Secretary of National Defence.
Act No. 40 / 1974 Coll., on the National Security Corps, is amended as follows:
Article 51 (2) and (3) reads as follows:
"(2) In order to carry out the tasks of the National Security Corps while maintaining national security in the event of a violent attack against the constitutional establishment of the Czechoslovak Socialist Republic, the Government of the Czechoslovak Socialist Republic may call on soldiers in active service.
(3) Soldiers in active duty called pursuant to paragraph 2 shall have the same rights and obligations in the performance of the tasks of the National Security Corps as members of that Corps, unless the Government of the Czechoslovak Socialist Republic decides otherwise. "
2. Paragraph 52 is deleted.
3. In § 53, the words "soldiers listed in § 52 and z 'are deleted.
Decree No. 67 / 1977 of the Federal Ministry of Interior Coll., on the occupation of members of the People's militia to carry out the tasks of the National Security Corps, is hereby repealed.
This Act shall take effect on the day of its publication.
