DECLARATION
Federal Ministry of Transport
of 27 July 1981
amending and supplementing Decree of the Ministry of Transport No. 133 / 1964 Coll., on road transport schedules
The Federal Ministry of Transport, in agreement with the participating central authorities, provides, pursuant to § 57 (1) of Act No. 68 / 1979 Coll., on Road Transport and National Postal Service, and § 392 (3) of Economic Code No. 109 / 1964 Coll., as published under No. 37 / 1971 Coll.:
Decree of the Ministry of Transport No. 133 / 1964 Coll., on the Road Transport Regulations, is amended as follows:
1. In Article 40 (6), the words "on Sundays and holidays' are replaced by the words" on Saturday, if it is not a working day, and on the day of work, 1) '.
2. In Paragraph 50 (1), the words "on Sundays and holidays' are replaced by the words" on Saturdays if it is not a working day and on a working day '.
3. In Paragraph 50 (2), the words "on Sunday or on holiday 'are replaced by the words" on Saturday if it is not a working day or on a working day'.
4. Article 59 (7) reads as follows:
"(7) Organisation involved in transport as a transporter
(a) refuse, without right, to forward the consignment to or take it from the carrier;
(b) the unauthorised disposition of the consignment makes it impossible to surrender it to the carrier designated by the transport contract or under legislation, 2)
(c) fails to comply with the obligation to lodge or withdraw a consignment (§ 50)
1. on a working day from 6 am to 16 pm,
2. Although she was given a prior report by the carrier during her working time,
- on a working day between 16 and 22 hours,
- on Saturday, unless it is a working day between 6 and 22 hours,
- on the day of work between 6 and 22 hours,
pay a fine of 500 CZK to the carrier; This shall be without prejudice to the carrier's right to compensation for the performance provided for in the tariff referred to in paragraph 1.
5. the following paragraph 8 shall be added to Article 59:
"(8) An organisation involved in a shipment as a carrier which does not take over or issue the consignment within three hours after the expiry of the period notified to the carrier pursuant to Paragraph 50 (2), but at the latest, if not for the delivery and collection of the consignment in the overnight time referred to in the second sentence of Paragraph 50 (2), within 22 hours, the transporter shall pay a fine of 300 Kčs; This shall be without prejudice to the right of the consignor to withdraw from the transport contract referred to in paragraph 2. ';
This Decree shall take effect on 1 September 1981.
