Government Regulation
of 21 July 1953
on the insurance of members of military units working in companies in the socialist sector.
The Government of the Czechoslovak Republic orders, with the agreement of the President of the Republic, pursuant to § 42 (1) of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan), and pursuant to § 4 (2) and § 6 (3) of Act No. 102 / 1951 Coll., on the Rebuilding of National Insurance:
The provisions of Act No. 99 / 1948 Coll., on National Insurance, as amended by the Act amending it, shall apply to men and non-officers (except for petty officers from the profession) who are members of the military working units assigned to the companies of the socialist sector ("military units'). The legal relationship between members of the military divisions and undertakings of the socialist sector in which work is carried out (hereinafter referred to as" undertakings') shall be considered, for the purposes of that Act, as an employment relationship with the derogations set out in Section 2.
(1) The members of the military sections are participants in military sickness care under Act No. 236 / 1948 Coll., on military sickness care, and are not granted sickness insurance benefits under the National Insurance Act.
(2) National insurance premiums shall be determined by a percentage of the total of the assessment bases of all members of the military units with the same employer and shall be 15%. From this premium companies pay 5% to the military administration and the Revolutionary Trade Union Movement (sickness insurance authorities) 10%. The basis of assessment for insurance premiums is the wage for work under Section 3 of Act No. 76 / 1952 Coll., on the payroll tax, unless it is exempt under Section 4 of the same Act.
(3) The insurance shall be incurred on the day on which the soldier, as a member of the military division, takes up work in the undertaking and shall cease on the day on which his secondment to work in the undertaking ends.
(1) Where an occupational soldier, as a member of a military division, suffers from an accident at work in an undertaking resulting in his incapacity for military service or death, that accident shall be considered as a work accident under the National Insurance Act; pensions belonging to him pursuant to the Act No. 89 / 1952 Coll., on pension arrangements of members of the armed forces, are treated as pensions under the National Insurance Act and the National Insurance Office provides him with an increase pursuant to § 86 or § 87 (3) of the National Insurance Act.
(2) Undertakings shall pay an accident allowance equal to one per cent of the service allowance for the soldiers referred to in paragraph 1 of the Revolutionary Trade Union Movement (sickness insurance authorities).
Measures taken in accordance with this Regulation before it is effective shall be considered as measures under this Regulation.
Government Regulation No. 73 / 1949 Coll., on social insurance of members of military units assigned to mining or other works, is hereby repealed.
This Regulation shall enter into force on the day of its publication; All members of the government will do it.
