DECLARATION
of 15 March 2010
on the determination of reserved electrical equipment, their classification in classes and groups and on closer conditions for their safety (Decree on reserved electrical equipment)
The Ministry of Labour and Social Affairs provides, pursuant to § 7b (1) (a) and (b) of Act No. 174 / 1968 Coll., on State Professional Safety Supervision, as amended by Act No. 124 / 2000 Coll. and Act No. 253 / 2005 Coll.:
This Order
(a) provide for dedicated electrical equipment (1) (hereinafter referred to as "equipment"), their inclusion in classes and groups, and further conditions of their safety;
(b) does not apply to medical devices under the Law on medical devices and amending certain related laws (2);
(c) have been notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations, as amended by Directive 98 / 48 / EC.
(1) Equipment
(a) for the production, conversion, transmission, distribution and collection of electricity and electrical installations;
(b) intended to protect against the effects of atmospheric or static electricity.
(2) The inclusion of establishments in classes and groups is set out in Annex 1 to this Decree.
Further safety conditions are set out in Annex 2 to this Decree.
The following shall be deleted:
a) Decree of the Czech Office of Labour Safety and the Czech Mining Office No. 151 / 1969 Coll., which defines reserved technical equipment.
b) Decree of the Czech Office of Labour Safety and the Czech Mining Office No. 20 / 1979 Coll., which determines reserved electrical equipment and lays down certain conditions for their safety.
c) Decree of the Czech Labour Safety Authority and the Czech Mining Authority No. 553 / 1990 Coll., amending and supplementing the Order of the Czech Labour Safety Authority and the Czech Mining Authority No. 20 / 1979 Coll., which determines reserved electrical equipment and lays down certain conditions to ensure their safety.
d) Decree of the Ministry of Labour and Social Affairs No. 159 / 2002 Coll., amending Decree of the Czech Labour Safety and the Czech Mining Office No. 20 / 1979 Coll., determining reserved electrical equipment and laying down certain conditions to ensure their safety, as amended by Decree No. 553 / 1990 Coll. and Decree No. 352 / 2000 Coll.
This Decree shall take effect on 1 June 2010.

Closer safety conditions
1. Legal persons and business natural persons may carry out the assembly, repair, revision and testing of equipment on the basis of an authorisation (3) issued by a state professional surveillance organisation.
2. The application for authorisation referred to in point 1, other than those referred to in paragraph 37 (2) of the Administrative Regulation, shall contain:
(a) the type and scope of the authorisation requested according to the following breakdown:

(b) the conditions of the necessary technical equipment for the activity for which authorisation is sought, the necessary information on the technical assumptions of natural persons.
3. In the case of an installation, its safety shall be certified to the extent and under the conditions laid down by the legislation and other provisions to ensure safety and health at work4) and in accordance with the technical documentation; the certificate is carried out by a review technician with a valid certificate of the type and scope in accordance with another legislation5).
4. The installation of Class I equipment shall be notified without undue delay to the organisation of the state professional supervision.
5. Class I equipment may be put into service only on the basis of a professional and binding opinion (6) of the state professional surveillance organisation.
6.
(a) identification of the type of revision, identification and scope of the installation;
(b) the dates of commencement, termination, preparation and transmission of the review report;
(c) name and surname, signature and registration number of the inspection technician, where applicable;
(d) an inventory of the operations carried out, the instruments used and the defects or non-conformities detected;
(e) other data with regard to the safety status of the installation;
(f) a final assessment of the safety of the installation.
7. Compliance with safety requirements shall be deemed to be satisfied for products which are products designated for conformity assessment under another legislation7).
