of 12 June 1974
on joint distribution of radio and television signals by cable
The Federal Ministry of Communications pursuant to Section 22 of Act No. 110 / 1964 Coll., on Telecommunications, in agreement with the participating central authorities, for the approval of basic technical parameters of developed and imported equipment, for the examination of technical standards, technical conditions and mandatory regulations, and for the purpose of ensuring the performance of the state inspection of telecommunications on compliance with technical standards and technical conditions for the construction and operation of common distribution of radio and television signals by cable, provides:
Scope
(1) The Federal Ministry of Communications sets out basic technical parameters in the Czech and Slovak Federal Republic of manufactured and imported systems for the joint reception and distribution of television and radio signals and reception equipment for the group reception of signals from satellites (hereinafter referred to as "joint distribution").
(2) Under the authority of the Federal Ministry of Communications
a) Research Institute of Communications checks basic technical parameters in the Czech and Slovak Federal Republic of manufactured and imported joint distribution facilities,
b) The Prague - Inspectorate of Radiocommunications in the Czech Republic and the Bratislava - Inspectorate of Radiocommunications in the Slovak Republic are entitled to check compliance with technical standards, technical conditions and mandatory regulations in the design, construction and operation of joint distribution and local studies for the creation of own programmes connected to joint distribution, issue permits for the establishment of television cable distribution and permit the operation of television cable distribution and investigate complaints from listeners and television viewers about the poor functioning of joint distribution after prior inspection of the equipment by a professional undertaking.
State inspection of telecommunications in production and import of equipment
(1) The basic technical parameters of new joint distribution facilities, unless these parameters are regulated by Czechoslovak state standards and related to the parameters of a single telecommunications network, must be submitted for approval to the Federal Ministry of Communications before the start of development, before the conclusion of a licence contract for the use of a foreign patent or production documentation or before the application of the import requirement.
(2) Only types of equipment (including antennas, cables and possibly wireless signal distribution systems) whose technical parameters have been checked by the Research Institute of Communications pursuant to § 19 (2) of Act No. 110 / 1964 Coll., on Telecommunications (hereinafter referred to as "the Act") may be used for the construction, extension and reconstruction of joint distribution. The manufacturer or importer of joint distribution facilities shall request the control of the technical parameters. The application shall be accompanied by a set of technical parameters in accordance with Czechoslovak state standards and on request by samples of equipment and protocols of measurement of parameters. The results of the inspection shall be communicated by the Research Institute of Communications to the applicant and, if satisfactory, shall be notified of the type of equipment tested in the Communication Bulletin; the check is carried out for payment. The check shall be completed within 60 days of the submission of the application and of the necessary samples. The examination of technical parameters of a joint distribution facility may be waived in part or in whole by the Research Institute of Communications if the installation has already been controlled by another management of the links or by another competent authority.
Authorisation to establish and permit the operation of television cable distribution
(1) The establishment and operation of television cable distribution is only possible on the basis of an authorisation granted under § 4 (1) of the Act.
(2) The investor shall request the action by the Prague Inspectorate of Radiocommunications or the Bratislava Inspectorate of Radiocommunications to issue a permit for the establishment of a television cable distribution. The application shall contain the following basic information:
(a) the name and address of the future owner of the cable distribution,
(b) a scheme for the planned divorce;
(c) the type of equipment proposed (including cables),
(d) the location of the main station and the number of participants;
(e) a list of distribution programmes indicating signals received from satellites, transfers and planned use of channels;
(f) the name and address of the supply (assembly) undertaking for the construction of the television cable distribution,
(g) the planned date for the putting into service of the television cable distribution.
This provision is without prejudice to the obligations of the investor under the building legislation.2)
(3) The connection of several common television antennas to one television cable system is subject to an authorisation under this Decree.
(4) The cable cable cables that will be operated in the connection cable can only be designed after a prior written agreement between the investor and the connection cable manager. In cases where television cable cables are crossed or collided with underground communication cables of a single telecommunications network, an investor of the television cable distribution is obliged to discuss cable laying with the local relevant communication organisation, which will carry out a state telecommunications inspection over the cable cable cables.
(5) An inspection of radio communications may, when the authorisation referred to in paragraph 1 is granted, lay down the conditions for the establishment of a television cable distribution.
(6) At least 15 days before the date of the approval procedure, the investor of the construction shall request the Inspectorate of Radiocommunications to issue a permit to operate the television cable distribution. The request shall be supported by protocols on the measurement of system parameters and documentation of the actual execution of the television cable distribution. If the television cable distribution complies with the Czechoslovak state standards, 2a) issues a permit to operate it for a specified remuneration. The permit shall be valid for 10 years. Before the expiry of the authorisation, the owner of the television cable distribution may request an extension of its validity.
(7) Changes in the central station and in the primary and secondary network of television cable distribution are subject to authorisation.
(8) The owners of the television cable distribution system which had been put into service before the entry into force of this Decree will ask the Inspectorate of Radio Communications to issue a permit to operate the television cable distribution before 30 June 1992.
Connection of reception equipment for reception of signals from satellites to shared distribution
Only reception equipment for group reception of signals from satellites, the control of which was carried out by the Research Institute of Communications pursuant to § 2, may be connected to the joint distribution and the operator (owner) agrees to the connection of the installation. The connected reception device is part of a joint divorce.
State inspection of telecommunications in construction
(1) State control of telecommunications (hereinafter referred to as "inspections") in the construction of joint distribution is carried out in the territory of the Czech Socialist Republic by the regional offices of the Inspectorate of Radiocommunications Prague and in the territory of the Slovak Socialist Republic by the regional offices of the Inspectorate of Radiocommunications Bratislava (hereinafter referred to as "branch of the Inspectorate"), which are part of the said Administration of Radiocommunications Prague and Bratislava.
(2) In the course of the inspection, the branches of the Inspectors shall participate at random in the acceptance of joint distribution facilities installed, in particular in residential buildings, and in the presence of an authorised official of the exit inspection body, the relevant suppliers shall check that these facilities comply with the technical standards, technical conditions and technical regulations for installation.
(3) In order to establish the actual situation objectively, the branches of the Inspectors are entitled to require the necessary documentation from suppliers or joint distribution operators, such as project documentation, pre-entry inspection documents (measurement reports), initial revision reports, take-over notes, etc. Checks on the quality of construction of joint distribution facilities carried out in the framework of an inspection under this Decree do not replace the activities of the supervisory bodies of suppliers or the recipient authorities of customers.
(4) The branches of the Inspectors are entitled to check the quality of the assembly works (including during assembly) and may also ascertain whether and how the specified parameters (functions) of the joint distribution facilities are controlled by future operators before they are taken over and put into permanent operation.
(5) Suppliers are required to inform the relevant branches of the Inspectors of the deadlines for receiving the installed joint distribution facilities at least 10 days prior to their operation, and at the same time to provide proof of checking such facilities before putting into service. Where the staff of the branch of the Inspectorate of Receipts participate, suppliers shall be obliged to allow them access to all parts of the installed equipment at the agreed time and to ensure the participation of their representative and, where appropriate, of the customer in the check referred to in paragraph 2, usually carried out before the deadline for the receipt.
(6) The actual status of the installation (results of measurements, functional defects, etc.) is recorded by the staff of the Inspection Branch in the "Protocol on the control of joint distribution facilities" (hereinafter referred to as the "Protocol"). Copies of the protocols shall be received by future operators and suppliers. During the check, no more interference shall be made to the joint distribution facility (setting of output levels of amplifiers, etc.). The identified deficiencies may be removed immediately on the spot by the supplier's representative, but the actions carried out must be recorded in the report.
(7) The branches of the Inspectors are entitled to issue orders to supplier organisations to eliminate detected functional defects in installed equipment. Defects must be removed within the specified time limit. If they find that joint distribution facilities are taken over in an inappropriate way, they shall recommend to the customers measures to be taken more appropriately. The branch of the Inspectors shall also be entitled to check that the personnel of such assembly organisations use recommended measuring instruments and have the prescribed qualifications according to the relevant regulations.
State control of telecommunications operations
(1) Inspection of the operation of joint distribution facilities is carried out by branches of Inspectors with the scope referred to in Section 4 (1).
(2) When carrying out the inspection, the branch of the Inspectorate checks at random the operation and conduct of regular revisions (3) and the maintenance of joint distribution facilities. The state (results of measurements, defects, etc.) shall be recorded in the protocols the copies of which shall be transmitted to the operators of the installation.
(3) Operators (owners or administrators) of joint distribution facilities are required to allow inspectors' branches to have access to all parts of the controlled facility and to ensure the participation of their representatives in the inspection, provided that they are notified of the date and place (s) of the inspection no later than 10 days in advance. Inspectors' branches are entitled to require project documentation from operators, review reports, measurement reports, take-over records and other evidence of equipment operation and maintenance.
(4) The branches of the Inspectors are entitled to issue orders to operators of joint distribution facilities to remedy the deficiencies identified. Operators shall ensure that they are removed within a specified time limit.
Final provisions
(1) Save as otherwise provided in this Decree, the general provisions implementing the Telecommunications Act apply to the approval of basic technical parameters developed and imported by the equipment and the inspection of common distribution of radio and television signals by cable. 4)
(2) The Directive of the Central Management of Communications on the exercise of State oversight over compliance with the technical standards and conditions for the construction and operation of common television and radio antennas of 17 June 1965, published in the Official Journal of the Central Management of Communications, published at 28 / 1965, is hereby repealed.
(3) This Decree shall take effect on 1 October 1974.
