on the prices of privately owned buildings and the replacement of real estate
The Ministry of Finance, in agreement with the participating central authorities and authorities, provides, pursuant to § 4 of the Government Decree No. 52 / 1960 Coll., on the abolition of the State Building Committee, and § 31 (2) (b) of Act No. 87 / 1958 Coll., on the Construction Regulations:
§ 1
Subject matter
(1) This decree provides:
(a) the prices of buildings acquired from citizens for any legal reason by socialist organisations or private legal persons and other citizens (Sections 2 to 10);
(b) prices of land use law (§ 11);
(c) the amount and method of compensation for personal and privately owned buildings (Sections 12 to 23).
(2) This decree also provides for the procedure for the granting of compensation for expropriation and for the contractual acquisition of those goods by socialist organisations in return for payment (§ 24).

PRICE PROVISIONS

Hlava první

Prices of personal property structures
§ 2
Family homes and residential areas of agricultural holdings
(1) The price of the family house and the residential part of the farm estate *) shall be determined as follows:

The principles for the classification of houses and dwellings of agricultural holdings in each class are set out in Annex 1.
(2) The residential area for the calculation of the price is the floor area of the residential rooms according to the housing regulations.
(3) The price of the family house will be reduced accordingly by wear; This reduction is generally 1% for each year of construction age in normal maintenance. In the case of a family house in which an upgrade or overhaul has been carried out, the reduction is reasonably lower and in the case of a family house where maintenance or repair has been neglected, or if the house is damaged, is reasonably higher.
(4) The date on which the building is put into use is in doubt for the assessment of the age of the family house.
§ 3
Vacation cabins
(1) The price of the holiday cottage is found as follows:

The principles for the inclusion of holiday huts in each class are set out in Annex 2.
(2) The price referred to in paragraph 1 shall be increased by 20% if the holiday cabin has an attic and by 60% if the holiday cabin has a continuous floor.
(3) The built-in area for calculating the price of the holiday cottage is the total built-in area of the building, including the porch, but without accessories, if outside the building, and without secondary constructions (wood, tools, etc.).
(4) Paragraph 2 (3) and (4) applies mutatis mutandis, with the reduction for each year of age of the holiday cottage generally being 1,25% for the construction quality of Class I, 1,75% for Class II and 3,3% for Class III.
§ 4
Garage
(1) The price of a separate garage is determined as follows:

The principles for the classification of garages in each class are set out in Annex 3.
(2) Paragraph 2 (3) and (4) applies mutatis mutandis, with the reduction for each year of garage age generally being 1,25% for the construction of Class I, 1,75% for Class II and 3,3% for Class III.
§ 5
Fences
(1) The price of the fence is determined as follows:

§ 6

(2) The price of the well in paragraph 1 includes the price of a simple (hand) pump.
(3) Paragraph 2 (3) and (4) applies mutatis mutandis, with a reduction of 1% for each year of well age.
§ 7
Small buildings
(1) The price of small buildings is determined as follows:

The principles for the classification of small buildings in each class are set out in Annex 5.
(2) Small buildings are structures which, by their nature, serve personal needs (e.g. fuel lumber, perpendicular, laundry, etc.); However, such character does not include barns, stables, granaries, establishments, etc.
(3) Paragraph 2 (3) and (4) applies mutatis mutandis to the fact that the reduction for each year of small buildings is generally 1,25% for construction of Class I, 1,75% for Class II and 3,3% for Class III.
§ 8
Outdoor treatment
(1) The price of outdoor treatment (paving, gazing, wall protection, etc.) on land intended for the construction of a family house, holiday cottages, garages or for the establishment of a garden is equal to the cost of purchasing reduced generally by 2% for each year of the age of outdoor treatment.
(2) Paragraph 2 (3) and (4) shall apply mutatis mutandis.
§ 9
Unfinished constructions
The price of the unfinished construction is that part of the price of the completed construction which corresponds to the ratio of the costs expected when the construction was completed to the costs already incurred. Unbuilt construction material shall not be included in the cost.
§ 10
Prices of buildings acquired among citizens
The prices of privately owned buildings, established in accordance with § 2 to § 9, are the highest prices, if they are to acquire such buildings among citizens.

Price of the right of personal use of land
§ 11
(1) The price of the right of personal use of the land *) for the construction of a family house, holiday homes, garages or the establishment of a garden or already used for that purpose is equal to the amount of compensation granted for such land when expropriated (§ 15).
(2) The Regional National Committees may, taking into account local conditions and after consulting the Ministry of Finance, increase the price of the right of personal use of land intended or used for the construction of a holiday cabin or the establishment of a garden.

REFUNDS ON THE IMPLEMENTATION OF THE PROCEEDS AND IMMOVITY

Hlava první

Compensation for personal property construction
§ 12
(1) In the case of expropriation, a cash refund equal to the price of the construction is payable for the personal property construction (Sections 2 to 9) unless otherwise provided for in paragraphs 2 to 4 or in Section 13.
(2) The reduction due to the age of the building is 70% or more for the family house and the residential part of the farm estate (§ 2) and 80% for the buildings referred to in § 3 to 8.
(3) If a citizen has acquired the expropriated building from the State, the compensation may not exceed the price at which it was obtained, plus the price of the investments that have consistently assessed the construction. This assessment shall be calculated on the basis of the prices applicable at the time of expropriation.
(4) If, at the time of the expropriation procedure, a refund of more than 150 000, - Kčs, is to be granted for personal construction works, the authority responsible for expropriation before granting the refund shall seek the approval of the Ministry of Finance of the amount of the refund.
§ 13
(1) At the request of the owner or the expropriator, the expropriation authority may decide that the expropriator may, in agreement with him, provide compensation in place of cash in another similar construction which may be in the personal ownership (but not in its construction) or in the means of construction.
(2) The replacement construction shall be valued in accordance with § 12 (1) and (2) and any differences shall be offset in cash. The difference between the compensation and the price of the means of construction shall also be offset in money.
(3) If the acquiring organisation does not have a replacement structure, it may obtain it from another socialist organisation.

Compensation for privately owned buildings and immovable property
§ 14
Construction
(1) A refund calculated in accordance with the following table shall be granted for the construction:

The principles for the classification of residential buildings in each class are set out in Annex 1, for the classification of garages in Annex 3 and for the classification of economic buildings in Annex 5.
(2) Obstructed space means the basic enclosed space bounded by:
(a) the lower level of the base circumferential masonry,
(b) above the outer surfaces of roofs;
(c) on the sides of the outer surfaces of the walls of the building.
(3) In the case of privately-owned family houses, buildings which may serve the purpose of family houses and buildings with an apartment and an establishment, the district national committee may, in particular, authorise the granting of compensation to the owner to the extent of compensation for the personal-owned family house. However, when calculating the refund, account shall be taken only of the living space and only up to an area of 120 m2.
(4) In the case of agricultural buildings used for agricultural activities, the compensation for only 20 m2 of area built up shall be at the price calculated in accordance with Section 7. The amount of compensation referred to in paragraph 1 shall be granted for a part exceeding 20 m2.
(5) The compensation for the fence is equal to 0,1% of the price calculated in accordance with Section 5.
(6) The refund per well is equal to 0,25% of the price calculated in accordance with Section 6.
§ 15
Land intended for the construction of family houses, holiday homes, garages and garden for the owner of the land
(1) The property shown for the construction of a family house (including a yard and garden) is eligible for a refund of 1 m2
(a) up to 800 m2
2.- In cities over 60,000 inhabitants,
1.60 CZK in cities from 20,000 to 60,000 inhabitants,
1,20 CZK in municipalities from 2,000 to 20,000 inhabitants,
0,80 CZK in municipalities with less than 2,000 inhabitants,
(b) for a part of a parcel exceeding 800 m2 up to an area of 3000 m2 Kčs 0,40.
(2) A refund per 1 m2 shall be granted for the land shown for the construction of a holiday cottage or for the establishment of a separate garden.
(a) up to 400 m2, at the rates referred to in paragraph 1 (a);
(b) for a part of a parcel exceeding 400 m2 up to 1500 m2 at the rate referred to in paragraph 1 (b).
(3) Reimbursement shall be granted for the land shown for the construction of the garage at the rates referred to in paragraph 1 (a) but not more than the area strictly needed for that purpose.
(4) The expropriation authority may, at the request of the owner, decide that the right of personal use for another parcel may be established instead of the cash compensation granted; any differences between the price of that right and the amount of the cash compensation awarded shall be settled in cash.
(5) According to the preceding paragraphs, compensation shall also be granted for the parcels already used for those purposes.
(6) Where, under the preceding provisions, no cash compensation is granted for the land, the refund on the land intended for a purpose other than the construction of a family house, holiday homes, garages or the establishment of a garden shall be payable; Paragraph 16 (3) also applies here.
§ 16
Other land
(1) For land other than those referred to in § 15, compensation shall be granted only in the replacement plot of national property in the same or in some other municipality, intended for a purpose other than the construction of a family house, holiday homes, garage or garden.
(2) If the area of such expropriated land (expropriated parts of land) does not exceed 500 m2, a cash refund of Kčs 0,40 per 1 m2 is granted.
(3) The expropriation authority in its decision to grant the replacement parcel will merely state that the expropriated person is entitled to compensation on the land. The replacement parcel shall be provided by the district national committee in whose district the expropriated parcel is located and shall transfer the request of the expropriated parcel to its ownership.
§ 17
Outdoor treatment
Outdoor treatment (paving, etc.) shall be compensated at the price of the material obtained by demolition after deduction of demolition costs.

§ 18

The compensation shall be reduced by up to half for trees and shrubs of non-bone varieties, untreated, disproportionately weak in size or partially damaged.
(2) Compensation for ornamental trees is granted at the price of harvested wood.
(3) The total compensation for fruit and ornamental trees may amount to a maximum of 10 000 CZK.
(4) The compensation for vineyard crops, including vineyards, is determined according to the following table:

The refund shall be reduced proportionally at a shrub buckle of more than 1x1 m, or reduced to 50% of the above rates, if less than the district average has been achieved in the last 5 years. The total compensation for vineyards and vineyards may amount to a maximum of 10 000 CZK.
(5) The compensation for hop crops and hop plant is granted at the level calculated in accordance with the following table:

The total compensation for hop crops and hop plant may amount to a maximum of 2000 CZK.
(6) Compensation for forest crops is granted at the level calculated in accordance with the following table:

In the case of forest areas with predominantly leafy trees, the refund shall be reduced by 25%. The refund shown in the table is valid at full census (1,0); for lower census, the refund shall be reduced in proportion to the actual census.
The total compensation for forest crops may amount to a maximum of 3 000 CZK. Wood in expropriated forest areas belongs to expropriators. The expropriator shall arrange for its extraction in accordance with the instructions and in cooperation, where appropriate through organisations which have expropriated forests in the professional administration and are also responsible for the purchase of raw wood from those forests.
§ 19
Other crops
For crop crops on the expropriated parcel, compensation shall be granted for the costs of sowing or planting, cultivation and fertilisation.
§ 20
Reimbursement of certain costs
(1) The removal or, where appropriate, the transfer of non-expropriated portable structures and other objects from the expropriated land is subject to compensation of reasonable and demonstrably incurred costs; such refund shall not be granted where the owner has been obliged, by contract or by official decision, to remove it for his cargo.
(2) The transfer of uppers and other movable property of the user of the expropriated building to a new place of destination shall be subject to compensation of reasonable and demonstrably incurred costs.
§ 21
Pre-use of real estate
(1) For the provisional use of *) the buildings and the land for which the right of use was established shall be compensated at 2,5% per year from the amount which would have been due for the expropriated construction or, where appropriate, from the price of that right. The refund is not applicable if the buildings are used under Decree-Law No 50 / 1955 Coll. or for land for which the right of personal use has not been established.
(2) The total refund on immovable property is not reduced by the refund for the provisional use of the property.
§ 22
Replacement housing measures
Investors and national committees help citizens to use the funds for the expropriated property to provide for replacement housing, in particular in building housing cooperatives and in view of the need for the deployment of labour.
§ 23
Exemptions for higher compensation (purchase prices)
(1) In exceptional cases, the district national committee may authorise the granting of higher compensation up to the amount of a member's share in the building housing cooperative if the compensation for the personal property is not sufficient to obtain an adequate replacement apartment in cooperative housing.
(2) If the building is co-owned, only the co-owner who needs to buy a replacement apartment can be exempted. The exemption may be granted only up to an amount corresponding to the share of the co-owner.
(3) Higher compensation authorised under paragraph 1 may only be used to repay a member's interest in a building housing cooperative. The expropriation authority shall quantify in the decision the difference by which the refund is higher and shall determine the condition that the difference must be recovered if the refund is not used for that purpose within 5 years of the date of payment.
(4) A higher replacement will be referred to by the organisation to the deposit book of the former owner of the construction at the state savings bank in the district of his residence, on condition that the payment of the deposit from the deposit book will be charged by the former owner to the agreement of the organisation. The organisation shall consent to the payment of this contribution only to the payment of a member's share in the building housing cooperative.

PROCEDURE OF SOCIALISTIC ORGANISATIONS IN THE CONTRACTING TREATMENT OF CONTRACTS IN PERSONAL PROPERTY AND CONSTRUCTION AND IMMOVITY IN PRIVATE PROPERTY
§ 24
(1) In the contractual acquisition of privately owned buildings and buildings and privately owned properties covered by this decree, socialist organisations may not commit to any higher remuneration or compensation than that provided for in the expropriation.
(2) If a socialist organisation needs to provide a replacement land for the land purchased, it can obtain a replacement land from national assets in the same or some other municipality. The Socialist Organisation shall request a replacement plot from the District National Committee. The District National Committee shall transfer the replacement parcel free of charge to the management (ownership) of the Socialist organisation.
(3) A socialist organisation may agree to provide another similar construction (but not its construction) or means of construction for the personal property purchased; Paragraph 13 (2) and (3) shall apply mutatis mutandis.
(4) The Socialist organisation may, instead of paying in cash for land, grant the right of personal use to another land under the conditions laid down in the Civil Code.
(5) Paragraphs 20 to 23 apply mutatis mutandis. The difference (Paragraph 23 (3)) must be calculated and the obligation to repay it laid down in the contract.
(6) If a higher remuneration of more than 150,000 CZK is to be agreed from the building in private ownership, the socialist organisation will require the approval of the Ministry of Finance before negotiating the amount of the remuneration.
(7) The regulation on the management of national assets and the regulation on the acquisition of property by socialist organisations by citizens and private legal persons is not affected by this.

FINAL PROVISIONS
§ 25
Organisations which obtained the expropriation of the case for compensation or contractually at the price under Decree No. 18 / 1963 Coll. shall pay the amount of the difference between the refund (purchase price) and the refund (purchase price) which may be granted under that decree.
§ 26
For exceptional and reasonable reasons, the Ministry of Finance may allow exemptions from this decree.
§ 27
Decree No. 18 / 1963 Coll., on determining compensation for the expropriation of real estate to citizens and private legal persons, is hereby repealed.
§ 28
This Decree shall take effect on 1 May 1964.
