DECLARATION
Ministry of Energy and Water Management
of 30 May 1960
on surfactants
According to Section 38 (2) of Act No. 11 / 1955 Coll., on Water Management, as amended by Act No. 12 / 1959 Coll. and on the basis of a resolution made by the Government pursuant to § 27 (1) of this Act:
For the collection of surface water which is allowed or improved by water-based components or equipment, customers whose annual take-up exceeds 15 000 m3 or whose monthly take-up exceeds 1250 m3 shall be obliged to pay compensation under this decree to water-based organisations having such water-based works or equipment in their administration.
Water authorities and organisations shall be entitled at any time to check whether the actual water consumption corresponds to the standard consumption and the agreed conditions. In particular, they may consult the reports on water collection, conducted under special regulations *) and determine the state of the measuring equipment. If the measuring devices are not installed at the customer, the water consumption derived from the energy consumption of the pump shall be determined. If the customer collects water from the water source by an open drive or underground open water channel, the quantity of water collected shall be determined according to the flow capacity of the facility and the water conditions recorded on the water.
(1) Compensation for water collection is invoiced monthly by water management organisations. The rules on invoicing and payment of refunds shall apply to invoicing and payment for goods and works and on payment and settlement transactions. *)
(2) The compensation paid under this Order forms part of the customer's own costs.
The obligation to pay compensation for the collection of surface water under this Decree shall not apply until 31 December 1965 to the collection of surface water for the irrigation of agricultural parcels.
This Decree shall take effect from 1 January 1962.
