Government Regulation
of 7 September 1951
setting up the Ministry of State Control.
The Government of the Czechoslovak Republic orders, with the agreement of the President of the Republic, pursuant to § 1 of the Constitutional Act No. 47 / 1950 Coll., on adaptations to the organisation of public administration, and under § 42 (1) of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
(1) The Ministry of State Control is hereby established to carry out the strictest control of the management of State, cooperative and other funds.
(2) In carrying out its tasks, the Ministry of State Control relies on the widest initiative of the workers.
(1) Ministry of State Control:
(a) carry out a check on registration, storage, acceptance and issuance of State, cooperative and other funds and material values;
(b) carry out checks on compliance with the laws, regulations and decisions of the Government.
(2) In order to carry out these tasks, the Ministry of State Control is responsible for:
(a) issue guidelines binding on all ministries and other central authorities and their subordinate bodies, on State, cooperative and other organisations to submit plans, documents, statements and other documents, as well as reports, communications and explanations on matters falling within the competence of the Ministry of State Control;
(b) have access without barriers to operating, storage and service rooms as well as to all other premises and facilities;
(c) any failure to comply with the laws, regulations and decisions of the Government to inform the relevant managers and to give them binding instructions to remedy the deficiencies identified,
(d) to impose on those who have not complied with the laws, regulations and decisions of the Government, or that there have been irregularities in the register and in the management by means of money and material values, or that communication to the authorities of state control is incorrect, disciplinary penalties in accordance with the rules issued by the Government;
(e) in the detection of a gross breach of official authority or of duties imposed, or in the detection of other offences, to force the persons responsible through the prosecution to prosecute,
(f) if it is found, in the course of the inspection, that the error in the performance of the service has been caused by the damage to the State, to impose on the winegrowers cash compensation under the rules issued by the Government; a decision imposing a cash refund shall also be enforceable by judicial execution.
(3) Persons invited by the authorities of the Ministry of State Control in carrying out the inspection to submit plans, documents, statements and other documents, as well as reports, communications and explanations on matters falling within the competence of the Ministry of State Control may not rely on confidentiality obligations imposed on them in order to preserve national, economic and professional secrecy.
The government shall further adapt the tasks and activities of the Ministry of State Control.
(1) All provisions contrary to this Regulation shall be repealed.
(2) The Supreme Audit Office and the Supreme Audit Court are hereby repealed.
(3) The Minister of State Control shall be responsible for organising the arrangements related to the abolition of the Supreme Accounting Audit Office and the Supreme Audit Court in agreement with the Prime Minister.
This Regulation shall enter into force on the day of its publication; All members of the government will do it.
