Government Regulation
of 8 March 1949
on social insurance for members of the military units assigned to mining or other works.
The Government of the Czechoslovak Republic, with the agreement of the President of the Republic pursuant to § 42, paragraph 1 of the Act of 27 October 1948, No 241 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
The provisions of the Act of 15 April 1948, No 99 Coll., on national insurance in respect of the legal relationship between them and the mining national undertaking in which work is carried out (hereinafter referred to as "the undertaking ') shall apply to military personnel and sub-officers who are members of military units assigned to mining work (hereinafter referred to as" members of military units'), with the following derogations:
1. The members of the military units are members of military sickness care under the Act of 7 October 1948, No. 236 Coll., on military sickness care, and are not subject to sickness insurance under the National Insurance Act.
2. The insurance shall be incurred on the date on which the military person, as a member of the military section, takes up business in the undertaking and ceases to be a member of that section.
3. The company pays the military administration for providing military sickness care from the assessment basis [§ 3 (a)] an amount equal to the insurance insurance insurance under the National Insurance Act (6.8%), which reduces the part of the insurance against employees.
4. The company pays the Central National Insurance Corporation (the relevant District National Insurance Corporation) from the assessment base [§ 3 (a)] of the pension insurance insurance, including the accident allowance, which reduces the part of the pension insurance attributable to employees.
(1) Where a professional military person, as a member of a military section, suffers from an accident which results in his incapacity for military service or his death and is treated as an accident at work under the National Insurance Act, he / she shall be entitled to rest benefits (provision) due to his / her public pension equivalent to an invalidity pension after retirement to an old-age pension (widow's, spouse's or orphan's pension under the National Insurance Act) and the Central National Insurance Agency shall provide them with an increase under Section 86 or Section 87 (3) of the National Insurance Act.
(2) The undertaking shall pay a single percentage of the accident allowance for the persons referred to in paragraph 1 to the Central National Insurance Corporation (the relevant Regional National Insurance Company).
The assessment basis for the assessment of benefits, insurance premiums and accident allowance under this Regulation shall be:
(a) in the case of members of military units who are military personnel or sub-officers, any benefits which they would enjoy under the relevant wage decree if they were carrying out mining work on the basis of an employment relationship;
(b) in the case of members of military units who are military professionals, their gross service salaries, after the requirement (§ 39 of Act No. 236 / 1948 Coll.).
Paragraph 1 to 3 shall apply mutatis mutandis to the military persons listed therein, who are members of the military units assigned for a period of one month other than mining work.
This Regulation shall enter into force on 1 March 1949; they shall be carried out by the Minister for Social Welfare in agreement with the Minister for National Defence.
