DECLARATION
State Arbitration of the Czechoslovak Socialist Republic
of 9 July 1981
on the transitional arrangements for certain economic obligations for the supply and collection of electricity
According to Article 395 (b) of the Economic Code No. 109 / 1964 Coll., as published in No. 37 / 1971 Coll., and on the basis of the Resolution of the Government of the Czechoslovak Socialist Republic of 3 June 1981 No 146 on the evaluation of the supply of the national economy and the population of fuel and energy in the winter period 1980 / 1981 and on winter security 1981 / 1982:
(1) If the retail customers exceed 1) the specified limit on electricity consumption for the deduction period, 2) they are obliged to calculate and pay a penalty of 4 CZK for each kWh exceeded, within 30 days of delivery of the electricity supply invoice. The limit on electricity consumption for the deduction period 2) is obtained from the consumption reported in the next comparable deduction period before 15 June 1981.
(2) If the retail customers do not pay 1) the penalty payment referred to in paragraph 1 shall be increased by 0,1% for each day of delay in payment.
(3) The period for exercising the right to payment of periodic penalty payments referred to in paragraphs 1 and 2 shall be two years.
Paragraph 2 (2) of Decree No 175 / 1973 Coll., which issues the basic conditions for the supply of electricity and heat, as amended by Decree No 107 / 1977 Coll., does not apply to the limit on the consumption of electricity, 2) as regards the admissibility of a tolerance of + 1%.
(1) The provisions of this Decree do not apply to cases where electricity is collected in those premises and residential housing facilities which serve the common use of their inhabitants and in other buildings and facilities, where the cost of electricity is subsequently allocated to the population.
(2) Detailed guidelines for the regulation of electricity consumption by retail consumers - socialist organisations and other individual cases not covered by the provisions of this Decree are laid down by the Federal Ministry of Fuel and Energy Directives (3).
Decree No. 40 / 1980 Coll., on the transitional arrangements for certain economic obligations for the supply and collection of electricity, is not affected by this regulation.
The decree shall take effect on the date of its publication and shall expire on 31 December 1983.

1) Paragraph 3 (4) of Decree No. 175 / 1973 Coll., on the basic conditions for the supply of electricity and heat, as amended by point 5 of Decree No. 107 / 1977 Coll.
2) According to the Government Resolution of 3 June 1981 No 146 on electricity consumption for retail customers, the limit of 94% for two consecutive periods of deduction and 100% for the third period of deduction of consumption of the previous comparable period is fixed at 15 June 1981 and does not include an excess of the limit of electricity consumption for the previous comparable period.
