of 24 July 1974
to implement certain provisions of the Maternity Contributions Act
The Federal Ministry of Labour and Social Affairs, in agreement with the Central Council of Trade Unions, the Federal Ministry of Finance and the Ministry of Labour and Social Affairs, Education and Health of the Republic, provides, pursuant to Article 16 of Act No. 107 / 1971 Coll., on Maternity Contributions (hereinafter referred to as "the Act"):
§ 1
In order to qualify for a maternity allowance, a woman is required to undergo regular care of pregnant women in health care institutions during pregnancy. The first examination shall be carried out by the woman at the latest by the end of the 16 week of pregnancy, unless there are serious health reasons preventing compliance with this period, and further undergoing a specialist examination as instructed by the doctor. The competence of the medical establishment shall be governed by a separate Regulation (1).
§ 1a
The period of school holidays following the end of the school teaching period of the school year in which the child completes the last year of compulsory schooling, unless the child has entered permanent employment at that time or has started other permanent work.
§ 2
(1) A woman who, at the time of receiving the maternity allowance granted by the competent authority pursuant to Article 11 (1) of the Act, gives birth to another child or takes over the child into permanent care replacing maternity care, and is no longer a party to sickness insurance (sickness insurance, armed labour care) at the date of delivery of the child, shall claim a new maternity allowance from the district national committee responsible under § 10 (1) (e) and § 11 (2) of the Act.
(2) In the application for a maternity allowance, the woman must indicate the authority which decided on the current maternity allowance. The District National Committee shall inform that authority of its decision on the maternity allowance. If, after the date on which the new maternity allowance was granted, the national district committee has cleared the amounts paid in respect of the new maternity allowance.
(3) Among the authorities responsible for the maternity allowance provided for in Article 11 (1) and (2) of the Act, the amounts paid in the maternity allowance are not paid to each other, even if the maternity allowance has been paid by the competent authority.
§ 3
(1) The maternity allowance is not included in the income applicable to the provision
(a) social security services, with the exception of the contributions referred to in Article 4 (1) and (2) of the Act;
(b) nutritional allowance, 2)
(c) social scholarships for students at secondary and higher education institutions;
(d) a supplement to a company scholarship for a wife who cannot be employed;
(e) a contribution to the soldier for the use of the flat and the services related thereto,
(f) free catering and accommodation for apprentices and young workers;
(g) child allowance, education and orphan's pension.
(2) Maternity allowance shall not be taken into account in determining the amount of the cost of care provided in certain youth establishments (3) and the amount of the allowance for care provided in nurseries, nor in determining the amount of the catering fees provided in primary schools and school canteens for basic nine-year-olds.
§ 4
This decree shall take effect on the day of its publication.
