THE LAW
of 8 March 2007
amending Act No. 143 / 2001 Coll., on the Protection of Competition and on the Amendment of Certain Acts (Law on the Protection of Competition), as amended
Parliament has decided on this law of the Czech Republic:
Act No. 143 / 2001 Coll., on the Protection of Competition and on the amendment of certain laws (Act on the Protection of Competition), as amended by Act No. 340 / 2004 Coll., Act No. 484 / 2004 Coll., Act No. 127 / 2005 Coll. and Act No. 361 / 2005 Coll., is amended as follows:
1. Paragraph 1 (9), including footnote 4a, is deleted.
2. In Paragraph 11, the first of the paragraphs marked as paragraph 2 shall be deleted.
3. In Article 15 (3) (b), "§ 26 (3) 'is replaced by" § 26 (1)';
4. In Article 21, paragraphs 10 and 11 are added:
"(10) Parts thereof which contain commercial, banking or similar legally protected secrets shall be excluded from the inspection of the file and may be consulted on such parts of the file under the conditions laid down in Paragraph 38 (6) of the Administrative Regulation.
(11) At the request of the Office, the person who testifies to the protection of commercial, banking or other similar legally protected secrets shall submit, in addition to documents containing such secrets, the documents from which such secrets have been removed or, where appropriate, obtain from such documents a sufficiently detailed lift which does not contain secrets. '
5. In Paragraph 21a (2), "Article 20 (5)" is replaced by "Article 20 (6)" and "or Article 12 (1) of the Merger Regulation" is replaced by "Article 12 (1) or Article 13 (6) of the Merger Regulation."
6. In Paragraph 26, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The Office may, by order pursuant to Article 4 (2), grant a block exemption from the prohibition of agreements pursuant to Article 3 (1)."
That law shall take effect on the first day of the calendar month following its publication.
