of 23 March 1994
on the sale and export of objects of cultural value
Parliament has decided on this law of the Czech Republic:
Sale and export of objects of cultural value
(1) Articles of cultural value under this Act are natural or human creation or sets thereof which are relevant to the history, literature, art, science or technology and fulfil the criteria set out in Annex 1 to this Act.
(2) This Act does not apply to the sale and export of cultural monuments and national cultural monuments, (1) registered collections of museum character and collection items which are their components, (2) archives, (3) originals of works of art living authors, and to objects imported into the Czech Republic which have been placed under the temporary importation procedure.
(1) Articles of cultural value may be exported to a third country or transferred from the territory of the Czech Republic only if they are accompanied by a certificate for temporary export or temporary transfer of an object of cultural value from the territory of the Czech Republic, an export certificate or a permanent transfer of an object of cultural value from the territory of the Czech Republic or a certificate for an object of cultural value transferred to the territory of the Czech Republic (hereinafter referred to as the certificate). The certificate may not be replaced by an expert opinion.
(2) Certificates are issued on request by a natural or legal person who owns an object of cultural value (hereinafter referred to as "owner"), museums, galleries, libraries and workplaces of the National Heritage Institute (hereinafter referred to as "professional organisation") or the Ministry of Culture (hereinafter referred to as "Ministry"). The list of professional organisations, specifying the fields in which they operate and defining their territorial scope, is set out in Annex 2 to this Act.
(3) The owner may, on the basis of full power (3a), entrust the third party with the execution of all operations relating to the export or transfer of an object of cultural value.
(4) A temporary export certificate or temporary transfer of an object of cultural value from the territory of the Czech Republic shall be issued if the object of cultural value is not subject to special legislation. (3b)
(5) A certificate of export or permanent transfer of an object of cultural value from the territory of the Czech Republic shall be issued if the object of cultural value is not subject to protection under special legislation, 3b) does not show the characteristics of an object protected under a special legislation, 1) nor is it referred to in point XIX of Annex 1 to that law.
(1) The objects of cultural value in the field of archaeology and objects of cultural value of sacral and cult character offered for sale must be accompanied by a certificate of export or permanent transfer of the subject of cultural value from the territory of the Czech Republic; the certificate must be transmitted to the purchaser together with the subject of cultural value, the part of the certificate marked B.
(2) The offer for sale referred to in paragraph 1 shall also mean the issue of articles in public sales premises, auctions and collectors' markets.
(1) The application for a temporary export certificate or temporary transfer of an object of cultural value from the territory of the Czech Republic, the model of which is set out in Annex 3 to this Act, shall be submitted by the owner in paper or electronic form to the professional organisation in the parts marked A, B and C. The application for the issue of an export certificate or the permanent transfer of an object of cultural value from the territory of the Czech Republic, the model of which is set out in Annex 4 to this Act, shall be submitted by the owner in paper or electronic form to the professional organisation in the parts marked A and B.
(2) The application referred to in paragraph 1 shall be submitted to the professional organisation in the field and to the competent local authority according to the place of permanent residence or registered office of the owner. If the owner is a natural or legal person who has no permanent residence or registered office in the Czech Republic, the application shall be submitted to the locally competent professional organisation according to the place where the subject of cultural value was located at the time of acquisition. If the local competence of the professional organisation cannot be determined in accordance with the second sentence, the application shall be submitted to any branch-related professional organisation.
(3) The owner is obliged to allow the subject of cultural value to be examined and to provide the professional organisation and, where appropriate, the Ministry with the necessary synergies.
(1) The application for certification of an object of cultural value transferred to the territory of the Czech Republic, the model of which is set out in Annex 5 to this Act, shall be submitted by the owner in paper or electronic form to the Ministry in the parts marked A and B.
(2) The time limit for the application for the issue of a certificate of an object of cultural value transferred to the Czech Republic is 60 calendar days from the transfer of an object of cultural value to the Czech Republic.
(3) The owner of the application for a certificate of an object of cultural value transferred to the territory of the Czech Republic shall submit to the Ministry a permit to transfer an object of cultural value issued by an authority of the country of origin or confirmation by the authority of the country of origin of the fact that no obligation on such an object of cultural value is laid down for that object and documents demonstrating when the object was transferred to the territory of the Czech Republic.
(1) The period for issuing the certificate of professional organisation shall be 30 calendar days from receipt of the application to the professional organisation. The deadline for issuing the certificate of cultural value object transferred to the Czech Republic by the Ministry shall be 60 calendar days from the date of receipt of the request by the Ministry.
(2) If, following an assessment of the subject to which an application for a certificate is made, the expert organisation does not issue a certificate on the grounds that the article is not of cultural value, it shall indicate that fact on the application and return the copies of the certificate in the parts marked B or B and C to the owner.
(3) If, after assessing the subject matter of the cultural value of the certificate, the expert organisation does not issue a certificate on the grounds referred to in paragraph 4 or 5, it shall forward the application to the Ministry within the time limit laid down in paragraph 1. It shall simultaneously inform the owner in writing of its action.
(4) The Ministry shall issue a certificate to the owner of the professional organisation within 3 months of the receipt of the application, or, if the subject of cultural value shows the characteristics of an article protected under a special legislation (1), and if an application for the issue of an export certificate or the permanent transfer of an object of cultural value from the territory of the Czech Republic has been made, it shall not issue the certificate and initiate the procedure under a special legislation. 1) It shall also not issue a certificate where the object of cultural value is subject to protection under specific legislation. (3b)
(5) If an application has been made for the issue of an export certificate or permanent transfer of an object of cultural value from the territory of the Czech Republic and the certificate has not been issued on the grounds that it is an object of cultural value referred to in point XIX of Annex No 1 to this Act, the Ministry shall, within the time limit laid down in paragraph 4, give the decision.
(1) The certificate shall be issued to the owner in copies in the parts marked B or B and C. The professional organisation or ministry shall keep records of the part of the certificate marked A for a period of 20 years.6)
(2) The certificate is issued to the applicant for a fee of CZK 500. This provision shall not apply to the issue of certificates pursuant to Articles 2 (4), 3 (1) and 5 (4). The recipient of the fee shall be an expert organisation.
(3) A temporary export certificate or temporary transfer of an object of cultural value from the Czech Republic may be issued for a maximum period of 5 years.
(4) The certificate for export or the permanent transfer of an object of cultural value from the Czech Republic shall be valid for a period of 3 years from the date of issue.
(5) The certificate of cultural value transferred to the Czech Republic shall be valid for 10 years from the date of its issue.
(6) Upon a reasoned request from the owner, the Ministry may extend the duration of the certificate for temporary export or temporary transfer of the cultural object from the territory of the Czech Republic to a maximum of 10 years. The period of the temporary export certificate or temporary transfer of an object of cultural value from the territory of the Czech Republic may be extended only during the period of validity of the certificate. The model of the application is set out in Annex 6 to this Act.
(1) After re-import or re-transfer of an object of cultural value temporarily exported or temporarily transferred, the owner shall, within 15 days of the expiry of the period laid down in the certificate, surrender the part of the certificate marked B to the professional organisation which issued the certificate or, if the certificate has been issued, to the Ministry. The part of the certificate marked C shall be retained by the owner. The owner shall, upon request, present the subject of cultural value after re-import or re-transfer for inspection and identification to the professional organisation which issued the certificate or to the Ministry, if the certificate has been issued, or allow such inspection and identification to be carried out at the place of deposit of the article.
(2) In the event that the export or transfer has not taken place, the owner shall return parts of the certificate marked B and C to the professional organisation which issued the certificate or to the Ministry, if it has issued the certificate, no later than 15 days after the date of expiry of the certificate.
(3) Professional organisations shall monitor compliance with the deadlines for temporary export or transfer and notify the Ministry in writing not later than 30 days after the deadline.
(1) Where the exporter submits a customs declaration to the customs office proposing to release the article under the customs export or outward processing procedure and the customs office suspects that the exported article is the subject of a cultural value exported without certification and the exporter does not demonstrate that the article is not the subject of a cultural value, it shall retain the article in accordance with the procedure laid down in the law governing the customs administration of the Czech Republic, shall immediately inform the competent professional organisation of the customs office and allow it to examine the article. At the same time, it shall indicate the data needed to assess whether the exported article is of cultural value.
(2) The expert organisation shall, without delay, but not later than 15 working days after the date of submission of the information, provide the customs office with an assessment as to whether the exported article is of cultural value. One copy of the assessment shall also be received by the exporter.
(3) Where, according to the expert organisation's opinion, the object of cultural value is not presented and the certificate is not presented, the customs office shall not release the object of cultural value under the proposed customs export procedure and inform the Ministry.
(4) The exporter shall, at the time of lodging the declaration, submit the certificate and bear the necessary steps to identify and verify the subject.
(5) The costs of processing the report shall be borne by the exporter, provided that he has been found to have infringed this law.
Supervision of compliance with the obligations laid down by this Act is carried out by the Ministry and by the Customs Administration of the Czech Republic pursuant to § 7a and 7c.
(1) If the authority of the Customs Administration of the Czech Republic finds, in the exercise of its other competence, that the object of cultural value is the object of cultural value transferred from the territory of the Czech Republic and that it is not the subject of cultural value, the object of cultural value will be withheld by the law governing the Customs Administration of the Czech Republic.
(2) It shall inform the expert organisation of the detention without delay, indicating at the same time the information necessary to assess whether the object being transferred is of cultural value. Where, within 3 days, a professional organisation notifies that it is an object of cultural value, the subject of cultural value shall be forwarded by the customs office to the professional organisation for further action.
(3) The person transferring the subject of cultural value must submit a certificate to the customs office and must bear the necessary steps to identify and verify the subject.
(4) The costs relating to the storage of the cultural value of the professional organisation and the processing of the opinion shall be borne by the person who relocates the subject if it has been established that the law has been infringed.
Transfers
(1) A natural, legal or business natural person commits an offence by:
(a) export, export, transfer or transfer from the territory of the Czech Republic an object of cultural value without certification; or
b) on sale offers an object of cultural value in the field of archaeology or an object of cultural value of sacral and cult nature without certification for export or permanent transfer of an object of cultural value from the territory of the Czech Republic.
(2) The owner commits an offence by:
(a) make it impossible to examine the subject of cultural value or to provide the professional organisation or, where appropriate, the Ministry with the necessary synergies (Section 4 (3));
(b) return parts of certificates marked with B and C within the prescribed period to the professional organisation which issued the certificate or to the Ministry where the certificate was issued, in the event that the export or transfer from the Czech Republic had not taken place (Section 7 (2));
(c) does not re-import or transfer to the territory of the Czech Republic the object of the cultural value temporarily exported at the time specified; or
(d) within the statutory deadline, it shall not surrender a part of the certificate marked B to the professional organisation which issued the certificate or to the Ministry if it has issued the certificate or, on request, submit the subject of cultural value for inspection and identification, or allow such inspection to be carried out on the site of the deposit of the article (Section 7 (1)).
(3) The exporter commits an offence by failing to accept the necessary actions to identify and verify the subject matter (Sections 7a (1) and 7c (3)).
(4) The expert organisation shall commit an offence by not notifying the Ministry in writing of non-compliance with the temporary export period or temporary transfer period referred to in Article 7 (3).
(5) The offence referred to in paragraphs 1 and 2 (c) and (d) may be fined up to CZK 5 000 000 and the offence referred to in paragraph 2 (a) and (b) and paragraphs 3 and 4 may be fined up to CZK 20 000.
The transfers under this law are discussed by the Ministry.
(1) The certificate provided for in this Act does not replace the export authorisation under the special rules. 7)
(2) With the exception of § 5 (4), § 7a (1), § 8 and 8a, the general administrative rules do not apply to the procedure under this law. 8) An appeal against a decision under Paragraph 7a (1) shall not have suspensory effect.

Final provisions
Decree No. 239 / 1959 of the Ministry of Education and Culture of the Czech Republic on the export of cultural monuments and objects of museum value is hereby repealed.
This Act shall take effect on the day of its publication.
