DECLARATION
Minister of National Defence of the Czechoslovak Socialist Republic
of 26 July 1971
fixing the lump sum of criminal proceedings in the field of military justice
The Minister of National Defence of the Czechoslovak Socialist Republic provides, pursuant to § 152 (3) and § 153 (1), with reference to § 12 (14) of Act No. 141 / 1961 Coll., on Criminal Procedure (Criminal Code), as amended by Act No. 149 / 1969 Coll.:
The flat-rate amount of the costs of criminal proceedings borne by the State referred to in Articles 152 (1) (c) and 153 (1) of the Criminal Code shall be:
1. in proceedings against soldiers in the primary (replacement) service and against soldiers in the next service, provided that they are not entitled to a service income as professional soldiers and that they have not been subjected to an unconditional custodial sentence, the execution of which has been ordered to a correctional institution;
(a) in proceedings before a single judge, 200 Cds, and if an expert has been recruited, 300 Cds,
(b) in proceedings before a Chamber of 400 Ccsi, and if an expert has been recruited, 600 Ccsi,
2. in proceedings against soldiers in the primary (replacement) service and against soldiers in the next service, where they have been sentenced to an unconditional prison sentence, the execution of which has been ordered to a penal institution, as well as proceedings against other soldiers in active service, members of the National Security Corps and the Correctional Education Corps and against other persons sentenced by military courts,
(a) in the proceedings before a single judge, 300 Ccs, and if an expert has been brought, 500 Ccs,
(b) in proceedings before a Chamber of 600 Cds, and if an expert has been recruited, 1000 Ccs.
(1) For the field of military justice, the validity of Decree of the Minister of Justice No 51 / 1965 Coll., determining the flat-rate amount of the costs of criminal proceedings, is hereby revoked.
(2) Paragraph 1 does not apply to the costs of proceedings in cases brought before 30 September 1971.
This Decree shall take effect on 1 October 1971.
