on the spa fee
The Ministry of Finance provides pursuant to § 2 paragraphs 1 and 3 of Act No. 82 / 1952 Coll., on Local Charges.
§ 1
(1) A spa fee is levied at the spa sites listed in the Annex (hereinafter referred to as "the fee") for the use of facilities and services intended primarily for spa visitors.
(2) The local (urban) national committee (hereinafter referred to as the "national committee") may use the levy only to maintain and promote the spa site (parks, trips, spa music, etc.) and the services intended for visitors to the spa as well as to promote the spa.
§ 2
(1) The fee is levied on persons temporarily staying at a spa place between 1 May and 30 September.
(2) If all spa facilities are in operation and services are carried out primarily for spa visitors during the period from 1 October to 30 April, the National Committee may provide that a fee is also levied at this time - but not more than half the rates.
§ 3
(1) The fee for each day of stay in spa places is included:
do skupiny I 4,- Kčs
do skupiny II 2,- Kčs
do skupiny III 1,- Kčs.
The day of arrival and the day of departure do not count to the time of stay.
(2) Visitors to the spa to whom spa care or recreation is provided on a selective basis shall pay a fee equal to half the rates referred to in paragraph 1.
(3) The National Committee may reduce the fee rates for certain parts of the spa site or, where appropriate, waive the fee; it may also, on a case-by-case basis (e.g. for social reasons), reduce or, where appropriate, forgive the fee.
§ 4
The fee shall be exempt:
(a) patients staying in bed facilities as well as patients receiving spa care for selected diseases *)
b) Permanent guides to blind and ill, unable to walk without help
(c) persons temporarily resident in a spa in the exercise of their profession (function) or for the purpose of studying at local schools
(d) relatives in the direct generation and siblings of the accommodation provider or his spouse and spouses of such persons, if they are not in the place to be treated; the relative ratio is equal to the learning ratio
(e) children under 15 years of age and participants in children's recreation
(f) participants in school trips and in the off-season also participants in training or instruction
(g) participants in foreign exchange recreation between trade unions.
§ 5
(1) The fee is paid in advance for the expected period of stay; if the stay exceeds four weeks, the fee shall be paid in advance for no more than four weeks.
(2) A fee which has not been paid on time or at the correct amount shall be determined by the national committee by a payment scale; it may charge a fee up to 50% of the outstanding amount.
§ 6
(1) The fee is charged to the National Committee by the accommodation provider (spa, recovery, hotel, pension, etc.); In particular, it is his duty to collect a fee set in time from the visitor (§ 5 (1)).
(2) Further obligations of the accommodation provider, in particular on the reporting of visitors and the collection of the amounts collected, are laid down by the national committees taking into account local circumstances.
(3) The accommodation provider is liable for a fee if he does not fulfil the obligations imposed on him in the previous provisions.
§ 7
Article 13 of Decree No 161 / 1960 Coll. The proceedings are governed by Decree No. 16 / 1962 Coll., on the proceedings concerning taxes and charges.
§ 8
This decree shall take effect on the day of its publication.
