Slovak National Council
of 10 June 1969
on the Supreme Audit Office of the Slovak Socialist Republic
The Slovak National Council decided on this law:
The Supreme Audit Office of the Slovak Socialist Republic (hereinafter the Supreme Audit Office) is hereby established as the Audit Authority of the Slovak National Council.
Status and responsibilities of the Supreme Audit Office
(1) The Supreme Audit Office operates within the framework of the control of the Slovak National Council.
(2) The Slovak National Council is responsible for its activities.
(3) It is independent of the executive bodies of the Slovak Socialist Republic.
(1) The powers of the Supreme Audit Office include:
(a) examine the creation and use of the State budget of the Republic;
(b) to examine the State Final Account of the Republic and submit an opinion to the Slovak National Council on the State Final Account of the Republic;
(c) to control the management of the Republic's tangible and other funds, including financial and material reserves, loans and government debt of the Republic;
(d) to check the state and level of handling of complaints, notifications and initiatives of citizens and to examine more seriously.
(2) The Supreme Audit Office as required by the Slovak National Council
(a) determine how its laws and resolutions are implemented; Observes how the laws of the Federal Assembly and of the International Treaty are implemented when implemented by the authorities of the Slovak Socialist Republic,
(b) examine the performance of the selected tasks of the medium-term national economic plan;
(c) carry out other tasks entrusted to it by the Slovak National Council or its Bureau.
The Supreme Audit Office shall also ensure:
(a) publication of an opinion on the Republic's State Final Account;
(b) generalisation and use of knowledge of forms and methods of control;
(c) research in the field of control;
(d) developing international contacts in the field of control, in cooperation with the control body of the Federal Assembly.
(1) The Supreme Audit Office shall be authorised to carry out control in the Central Authorities of the Republic and, where necessary, in their subordinate bodies and organisations and in national committees; in cooperative and social organisations within the scope of their relations with the state budget of the Republic.
(2) The jurisdiction of the Supreme Audit Office does not apply to the activities of courts, authorities of state arbitration, prosecutors and state notaries with the exception of their management.
Organisation of the Supreme Audit Office
(1) The Supreme Audit Office is composed of the President, Vice-Presidents, Audit Board and staff.
(2) The number of Vice-Presidents and members of the Audit Board shall be determined by the Bureau of the Slovak National Council.
(1) Chairman of the Supreme Audit Office:
(a) manages the Supreme Audit Office, represents it externally and is responsible for its activities to the Slovak National Council;
(b) submit to the Bureau of the Slovak National Council proposals for the activities of the Supreme Audit Office and reports on the outcome of its audit activities;
(c) has the right to attend meetings of the Slovak National Council, its institutions, the Government of the Republic and national committees. If he asks for the floor, he will be granted.
(2) The Vice-Presidents of the Supreme Audit Office shall represent the President.
(1) The President shall be elected by the Slovak National Council by secret ballot on a proposal from its Bureau for a period which coincides with its term of office.
(2) The President holds the following promise in the hands of the President of the Slovak National Council: "I promise on my honour that I will perform the duties entrusted to me conscientiously, to abide by the Constitution and other laws of the Czechoslovak Socialist Republic and the Slovak Socialist Republic and to consistently protect the interests of the people."
(3) The President shall remain in office until the new election is completed; The Slovak National Council may withdraw him from office.
(1) The Vice-Presidents are appointed and dismissed by the Bureau of the Slovak National Council on a proposal from the President of the Supreme Audit Office.
(2) The Vice-Presidents shall remain in office until a new appointment.
The salary of the President and Vice-Presidents shall be determined by the Bureau of the Slovak National Council.
(1) The Audit Board (hereinafter referred to as the Board) is the advisory body of the President.
(2) The Council shall in particular discuss:
(a) draft plans for the activities of the Supreme Audit Office;
(b) an opinion on the State Final Account of the Republic;
(c) reports on the activities of the Supreme Audit Office;
(d) the results of more serious control actions.
(3) Meetings of the Council shall be convened and chaired by the President.
(4) The arrangements for the deliberations of the Board shall be laid down by the Rules of Procedure, to be adopted by the President.
(1) The members of the Board are appointed and recalled by the President of the Supreme Audit Office from the leading experts in the theory and practice of the Bureau of the Slovak National Council.
(2) A member of the Board may not be shortened in the rights and entitlements arising from an employment or similar relationship for the performance of his duties.
(3) An organisation with which a member of the Board is in a working or similar relationship shall be obliged to allow him to perform his duties and to provide him with the necessary leave of absence. Compensation for lost earnings, travel and other expenses shall be provided to members of the Board by the Supreme Audit Office in accordance with the general rules.
The salary and other requirements of the staff of the Supreme Audit Office shall be governed by the general rules applicable to staff of central government bodies. The salary system shall be determined by the President of the Supreme Audit Office.
Obligations and authorisations of the Supreme Audit Office, synergy of the bodies and organisations checked
The Supreme Audit Office shall:
(a) to focus control activities in such a way that their results help the Slovak National Council to fulfil constitutional functions;
(b) proceed with the inspection in such a way as to ensure that the control results are true, complete and verifiable, to identify the causes of the defects and to establish personal responsibility;
(c) discuss the results of the inspection with the staff responsible for the occurrence and duration of the defects detected, request their explanation and examine any objections to the veracity, completeness and evidence of the results of the check;
(d) discuss the results of the inspection with the heads of the bodies and organisations checked, and, where appropriate, with the heads of their superior bodies.
(1) The Supreme Audit Office shall be entitled to require, in particular, the authorities and organisations checked to carry out the inspection:
(a) to allow him to enter all objects and equipment;
(b) to provide within the time limits the necessary supporting documents, materials, accounting documents and other documents, whatever the level of secrecy, and to provide true and complete written and oral information on the facts as well as an explanation of the causes of the defects found.
(2) In order to carry out its tasks, the Supreme Audit Office may request from the central government bodies and national committees the results of their examinations, reviews and analyses, recruit experts or other experts, require expert opinions and cooperate with scientific institutes, universities and other institutions. Experts and other experts shall have, within the scope of the mandate, the rights and obligations within the meaning of paragraph 1 (a), (b) and (14).
(1) The audited and requested authorities and organisations, their officials and staff, are required to create the conditions for the performance of the inspection activities and to provide the requested assistance to the Supreme Audit Office.
(2) The officials and managers of the bodies and organisations checked are required, at the request of the Supreme Audit Office, to attend to discuss the results of the inspection.
(3) Controlled authorities and organisations are required to remove the identified defects and their causes without delay and to report to the Supreme Audit Office in writing within a specified time limit.
(4) If the controlled authorities and organisations do not remove the detected defects without delay or report in writing to the Supreme Audit Office within the prescribed time limit (paragraph 3), the Supreme Audit Office shall inform the relevant competent authority or the Slovak National Council accordingly.
(1) Persons who, within the time limit laid down, do not create the conditions for the exercise of the control or do not cooperate on request [Paragraph 15 (1) (a), (b)] may impose an order-by-order fine of up to 1000 Ccs. The order fine may be imposed again if the obligation has not been fulfilled even within the new deadline.
(2) The provisions of the Administrative Procedure Act shall apply to proceedings and ordered fines.
(3) Order fines are the income of the state budget of the Republic.
Common, transitional and final provisions
The President, Vice-Presidents, members of the Board and the staff shall be required to keep the national, economic and professional secrets which they shall learn in their activities. The obligation to remain silent shall continue after the end of the term of office. The President shall decide on the waiver; if the President is to be discharged, the Bureau of the Slovak National Council shall decide so.
(1) The Commission of People's Control of the Slovak National Council is hereby repealed.
(2) The resources provided for by the plan and budget for the Commission for the People's Control of the Slovak National Council belong to the Supreme Audit Office, which also assumes its property rights and obligations.
The Government of the Slovak Socialist Republic sets out which authority of state administration will review the Commission's decision of the People's Control Commission of the Slovak Socialist Republic of Bratislava, the People's Control Commission of the Municipal National Committee in Košice and the People's Audit Committees of the District National Committees on the imposition of order fines and reprimand with a fine, issued pursuant to Sections 22 and 24 of Act No. 70 / 1967 Coll., on People's Control Committees.
The Act of the Slovak National Council No. 78 / 1967 Coll., on the Commission of People's Control of the Slovak National Council, and the provisions of Act No. 70 / 1967 Coll., on People's Control Committees, as amended by Act No. 85 / 1968 Coll.
(a) the provisions of Part Three of the Act;
(b) the provisions of Part One and Part Six and the provisions of Section 32 of the Act applicable to the Commission of People's Control of the Slovak National Council.
Paragraph 12 of the Act SNR No. 207 / 1968 Coll., on the establishment of ministries and other central bodies of the Slovak Socialist Republic is hereby repealed.
The law shall take effect on the day of its publication.
