on popular control committees
The National Assembly of the Czechoslovak Socialist Republic decided on this law:

THE CENTRAL COMMISSION OF PEOPLE'S CHECKS
§ 7
(1) The Central Commission for People's Control carries out the tasks assigned to it by the National Assembly; it shall be responsible for its activities to the National Assembly.
(2) The Bureau of the National Assembly shall approve the work plan of the Central Commission for People's Control.
(3) The Central Commission of People's Control reports on its activities to the National Assembly.
§ 8
The Central Commission of People's Control shall be entitled to require the cooperation and guidance of the other Commission of Human Control to carry out the tasks imposed by the National Assembly.
§ 9
(1) The Central Commission of People's Control in the performance of the tasks imposed by the National Assembly controls in particular:
(a) compliance with laws and other laws, the resolutions of the National Assembly and its Bureau and the resolutions of the Government;
(b) the effectiveness of the management work of state bodies and socialist organisations in addressing the problems of the development of the national economy and culture;
(c) the state and level of handling of complaints, notifications and initiatives working in state bodies and socialist organisations;
(d) the effectiveness of the work of the other control bodies.
(2) In monitoring the implementation of the laws and other legislation, the resolution of the National Assembly and its Bureau and the resolution of the Government of the Central Commission of People's Control, it examines the timeliness and completeness of the tasks and gives incentives to amend those laws and resolutions which no longer meet the needs of the further development of socialist society.
(3) In particular, in checking the effectiveness of the work of the control bodies of the Central Commission for Human Control, it shall carry out analyses of the activities and organisation of the various articles of the control system in the administration and the economy, generalise and assist in the progressive methods and forms of their activities and their dissemination.
§ 10
Central Commission for People's Control
(a) submit an opinion to the National Assembly on the State Final Account;
(b) proposes, on the basis of the experience gained in the control activity, the National Assembly to carry out checks in each sector, sector or section of the national economy, culture or government;
(c) methodically manage the control activities of other commissions of popular control and to this end may also issue binding directives;
(d) organise and ensure research in the field of control and education of officials and staff of the popular control committees and in agreement with the competent central authorities as well as in the education of officials and other bodies and organisations carrying out checks.
§ 11
(1) The Head of the Central Commission for People's Control is the President who is appointed from among the elected members and is removed from office by the President of the Republic. The President of the Central Commission for People's Control shall be the Head of the Central Authority; participate in meetings of the Government and have the right to attend meetings of all representative bodies and their bodies.
(2) The President of the Central Commission of People's Control is represented by two Vice-Presidents who elect from among their members and who remove from office the Central Commission of People's Control.
§ 12
(1) The Central Commission for People's Control has a specialised apparatus.
(2) The Central Commission for People's Control shall establish the organisation of its apparatus, appoint and dismiss its managers and lay down guidelines for its work; The President of the Central Commission for People's Control shall direct the work of the apparatus.

§ 16
The establishment and election of the national committees' popular control committees and their responsibilities are governed by the National Committees Act.

Order fines
§ 22
(1) A member or a member of the Commission of People's Control elected by the representative body appointed by that commission may impose an order fine up to 500, - Kčs. The order fee may also be imposed again if such an obligation has not been fulfilled even within the new deadline.
(2) He who has imposed a fine may also forgive it.
(3) However, if the obligation referred to in paragraph 1 is not fulfilled by the official of the controlled national committee, the member or the staff of the HR commission elected by the representative board may only propose to that national committee or national higher-level committee to ensure that the obligation imposed is fulfilled.

Measures to ensure control results
§ 23
The Central Commission of People's Control, the Commission of People's Control of the Slovak National Council and the Commission of People's Control of Regional and District National Committees shall be entitled to impose without delay the measures required by the outcome of the inspection,
(a) to remove immediately and at their discretion by checking the defects found;
(b) until the decision of the competent authorities has been taken, the implementation of an unlawful decision or action shall be suspended if there is a risk of damage to the national economy.
§ 24
(1) The Commission of People's Inspections referred to in Article 23 may, in the performance of its duties, impose a fine on senior officials of controlled bodies and organisations who have committed a breach of their obligations under the laws and other generally binding laws, resolutions of the National Assembly and its Bureau, resolutions of the Slovak National Council and its Bureau, generally binding regulations of the National Committees and resolutions of their Plenary Sessions and Councils, or, in spite of the warnings, have not taken the necessary measures as a result of the inspection or have made measures insufficient. A fine may also be imposed on elected officials of economic organisations. The fine falls to the state.
(2) When imposing a reprimand with a fine, account shall be taken, in particular, of the ratio of the manager (the official) to the work and to the socialist ownership, the extent of the fault and of its personal and economic circumstances.
(3) A penalty may be imposed only within one year of the date on which the Commission of People's Control found an infringement, but no later than three years after the date on which the infringement occurred.
(4) A decision to impose a reprimand with a fine may be published by the press or by other appropriate means in order to increase the educational effect.
(5) The decision to impose a reprimand with a fine shall be based on the personal file of the manager (official). If, within one year of notification of this Decision, a reprimand with a fine or a punitive measure has not been imposed on the manager (s), the decision shall be removed from the personal file and the manager (s) shall be considered not to have been reprimanded with the fine; otherwise it may decide to exclude a decision from the personal file in justified cases only the commission of the people's control which imposed the reprimand with a fine.
§ 25
The Commission of People's Inspections elected by the Advisory Councils may, if, despite a warning, the competent authorities or organisations do not claim compensation without delay, submit to the competent court an application to initiate proceedings for damages against or directly related to the responsible official or chief officer of the controlled authority or organisation. Paragraph 32 et seq. of the Civil Code applies to the application for the initiation of proceedings and to the status of the People's Control Commission. The compensation granted by the court falls to the State.
§ 26
The Commission does not impose any reprimand on members of the armed forces in active employment or make a proposal against them to initiate proceedings for damages, but only to initiate disciplinary or replacement proceedings with the competent Chief.

Members and voluntary collaborators
§ 27
(1) A member of the Commission of People's Control may not be reduced to rights or to claims arising from an employment or similar relationship (a member of the cooperative) for the performance of his duties.
(2) An organisation whose member is a member of the Commission of People's Control is obliged to allow him to perform his duties and to provide him with the necessary leave of absence.
§ 28
(1) The reimbursement of lost earnings and travel and other expenses is provided by the Slovak National Council to its members by the Central Commission for Human Control and the Commission for Human Control; the amount of such refunds shall be governed by the provisions in force in general. *)
(2) The provision of compensation to members of the national committees' popular control committees shall be governed by the provisions applicable to national committees.
§ 29
Members of the popular control committees shall be obliged to maintain the national, economic and professional secrecy which they will learn from their activities. This obligation to remain silent shall continue after the termination of office. The discharge of this obligation shall be decided by the People's Control Commission.
§ 30
(1) Voluntary collaborators shall enjoy, in their rights and claims arising from an employment or similar relationship of protection as members of the Commission, and shall be authorised to exercise control within the scope of the mandate concerned; they shall be subject to obligations imposed on members of the commissions.
(2) If the volunteer collaborators are unable to carry out the tasks arising from this function outside their working hours and the organisations of which they are workers provide them with leave of absence, they shall be entitled to reimbursement of their average earnings for that period. The reimbursement shall be provided by the Central Commission of People's Inspections to its voluntary co-workers and, in other cases, by the body of which it is part. Reimbursement of travel and other expenses shall be granted to voluntary colleagues as well as to members of the commissions.

TRANSITIONAL AND FINAL PROVISIONS
§ 31
(1) The Commission of People's Control, which operates on the date of entry into force of this Act, is the Commission of People's Control under this Act.
(2) The staff of the apparatus of the Regional and District Commission of People's Control and the Commission of People's Control are equal to the staff of the apparatus of the respective commissions of the People's Control of National Committees.
§ 33
(1) The following shall be deleted:
1. for the field of control Act No. 23 / 1963 Coll., on People's Control and National Economic Records, as amended by § 3 of Act No. 93 / 1964 Coll.,
2. Article 16 of the Legal Measures of the Bureau of the National Assembly No. 1 / 1967 Coll., on Changes in the Organisation and Scope of Certain Central Authorities,
3. legal action by the Bureau of the National Assembly No 21 / 1967 Coll., on the elections of the People's Control Commissions.
(2) The following shall be deleted:
1. the Statute of the People's Control Authorities, published under No 2 / 1963 Bulletin of the Central Commission for Human Control and Statistics and registered under No 17 / 1963 Collection of Laws,
2. the decree of the Central Commission for Human Control and Statistics on the definition of the competence of the District Commission for Human Control and Statistics in the districts of the capital of Prague (Article 33822 / 1963 of 22.5.1963), registered in the amount of No. 29 / 1964 of the Collection of Laws.
§ 34
This Act shall take effect on the day of its publication.
