Ministry of Construction
of 8 September 1963
amending and supplementing the Decree laying down the basic conditions for the supply of works
The Ministry of Construction, in agreement with other supply and customer ministries (central offices and authorities) and after approval by the main arbiter of the Czechoslovak Socialist Republic, provides pursuant to Section 192 of Act No. 69 / 1958 Coll., on Economic Relations between Socialist Organisations:
Čl. I
The Decree of the Ministry of Construction No 231 / 1959 Ú. l, which issues the basic conditions for the supply of construction works, is amended and supplemented by the following:
"(5) Following the prior approval of the District National Committee, unfinished residential and civil construction buildings included in the timetable for complex residential and civil construction may exceptionally be surrendered and taken over if the complete completion of such buildings is lacking:
(a) ventilation equipment;
(b) CO equipment;
(c) from 1 December to 30 April, external plaster with wet production process,
(d) gardening work (planting of trees and shrubs, planting of lawns, etc.), which may only be carried out during the corresponding seasons.
The same applies mutatis mutandis to housing and civil construction, not included in the timetable for complex housing and civil construction, with the derogation that, in such cases, the approval of a central investor is needed instead of the approval of the District National Committee.
(6) In cases other than those referred to in paragraph 5, unfinished buildings of residential and civil construction may be surrendered and taken over only on the basis of an exception which the Ministry of Construction will allow in an individual case in an agreement with the State Planning Commission and the State Investment Construction Commission. A central investor may request an exemption from the Regional National Committee, or (for construction not included in the plans for complex housing and civil construction) if material or financial losses would be incurred by non-occupying (non-use) buildings and if the unfinished business does not mind the proper use of the buildings.
(7) The record of surrender and take-over shall specify the period within which the missing work will be prepared for surrender and take-over; for the plaster referred to in paragraph 5 (c), this period shall not be longer than the next 31 July. Upon completion of each of the missing works referred to in points (a) to (c) of paragraph 5, the supplier shall surrender the work and the customer shall take over the work in addition to the original registration. If the supplier fails to comply with that deadline, he shall pay the customer a penalty of 500 CZK for each day of delay, but not more than 2% of the price of all the works agreed in the contract. '
Čl. II
Decree No. 111 / 1962 Coll., amending and supplementing the Order issuing the basic terms of supply of construction works, is hereby repealed.
Čl. III
This decree shall take effect on 20 September 1963.
