Regulation of the Minister for National Security
of 14 July 1951
on the right of a border guard to use weapons.
The Minister of National Security hereby orders pursuant to Section 8 of the Law of 11 July 1951, No 69 of the Coll. on the Protection of State Borders:
§ 1.
A border guard shall use weapons in the exercise of his or her jurisdiction, maintaining the necessary caution:
(a) against persons who have unlawfully crossed the territory of the Republic or who are trying to cross the national borders and who will not stop at warning;
(b) without warning, where an attack is clearly being taken against a border guard officer, against another person, against a guard post or against a neighbouring post;
(c) without warning to prevent the escape of persons arrested, detained or dangerous offenders, unless they can otherwise prevent the escape;
(d) against persons who oppose the duties of a border guard, unless they can otherwise and in spite of a warning, overcome the resistance to thwart the operation.
§ 2.
This Regulation shall enter into force on the day of its publication.
