about the State Health Institute.
The National Assembly of the Czechoslovak Republic decided on the following Act:
The State Health Institute of the Czechoslovak Republic, established by the Law of 12 October 1925, No. 218 Coll., on the establishment, competence and organisation of the State Health Institute of the Czechoslovak Republic, and the State Health-Social Institute, established by the Law of 11 May 1939, No. 101 Coll. of the State Health-Social Institute, is hereby established the State Health Institute (hereinafter referred to as the Institute).
(1) The Institute acts as an integral part of the State Health Administration in the field of scientific, research, investigation, control and other professional work in the field of health, necessary for the management, implementation and control of a single health policy. His task is in particular:
a) implement for state health administration with medical aspects
1. research, surveys and investigations necessary to ensure the health of humans, animals and plants in the context of life;
2. research and environmental control with particular regard to the basic natural conditions and their impact on life;
3. biological research on nutrition and control of food and articles of need,
4. research and control of medicines;
(b) educate and train health professionals for public health services;
(c) participate in the health education of the people, in particular in the field of health protection.
(2) The Government may, as necessary, establish, and adjust its tasks by means of a regulation for the performance of some of the tasks referred to in paragraph 1, specific state institutions in the field of health, or existing public institutions in the field of health.
(1) The State Health Institute has a main Institute in Prague, a Regional Institute for Slovakia in Bratislava and a branch.
(2) Branches are established in particular at the premises of the medical faculties and their branches and at the premises of the regional national committees, and only for one of the branches of the Institute. The Ministry of Health establishes and abolishes branches in agreement with the Minister of Finance.
(1) The main institute, regional institute and branch are divided into trade unions according to the main branches of their activity. Each department has the necessary number of departments. The individual trade unions are managed separately on a professional basis. The head of each department is a presenter appointed by the Minister for Health.
(2) The Ministry of Health will ensure that the various departments of the Central Institute, the Regional Institute and the branches proceed uniformly in matters where this is necessary. Privileges of trade unions of the main institute shall be convened as necessary by the Heads of Trade and Division of the Institute concerned and may, on the basis of the outcome of such consultations, propose to the Ministry of Health measures as referred to in the first sentence. The details will be adapted by the organisation rules (Section 6).
(3) The main institute and the regional institute are independent in administrative and economic terms and are managed by the directors appointed by the Minister for Health. The Organisational Regulations (Section 6) shall adjust their relationship, in particular in matters requiring a uniform procedure.
(4) In the case of branches, the Minister for Health shall give priority to one of their trade unions to manage them by administrative and economic means.
In addition to the heads of trade unions and departments and directors (Section 4), the necessary number of other professional and other staff are employed by the Institute. The staff of the Institute shall be in a personal capacity and shall be subject to the rules on the relevant category of civil servants. The Institute's assistants are equal to university assistants.
The Minister for Health will issue detailed regulations on the organisation and administration of the Institute (the Organisational Regulations) by regulation with a view to ensuring the professional cooperation of the Institute with universities.
(1) The Institute shall perform, at the request of the public authorities, the Central National Insurance Corporation and its organisational units and other legal and physical persons, within the limits of its activities (§ 2 (1)), unless this is detrimental to the performance of its tasks towards the State Health Administration. The Ministry of Health will adjust the details of the guidelines.
(2) The Ministry of Health shall, in agreement with the Ministry of Finance, provide for a decree in the Official Journal in which cases, under which conditions and to what extent the Institute shall charge the parties (paragraph 1) for its performance.
The Institute is subordinate to the Ministry of Health.
Unless otherwise provided for in this Act, the Institute shall continue the activities of the State Health Institute of the Czechoslovak Republic; The State Health-Social Institute becomes its regional constitution. The branches of both existing institutions become branches of the Institute.
(1) Any provisions which contravene this Act, in particular Act 218 / 1925 Coll. and Act 101 / 1939 Coll. as amended by the Regulations amending it and supplementing it, are hereby repealed.
(2) If the provisions adopted for the implementation of this Law do not apply, they shall be applied mutatis mutandis in accordance with the provisions laid down for the implementation of the laws referred to in paragraph 1.
This Act shall take effect on 1 April 1949; It shall be implemented by the Minister for Health in agreement with the participating members of the Government.
