Regulations on the organisation and competence of selection boards

Government Regulation
of 13 February 1951
on the organisation and competence of selection committees.
The Government of the Czechoslovak Republic hereby orders pursuant to § 5 (2) of Act No. 187 / 1950 Coll., on the Improvement of Animal Production ("the Act '):

Oddíl I.

Basic provisions.
§ 1.
(1) Selections of stallions, bulls, boars, rams and goats (hereinafter referred to as "breeders") shall be carried out and authorised for admission or insemination shall be granted, amended and repealed by:
(a) the Central Selection Board set up by the Ministry of Agriculture;
(b) a regional selection panel set up in the context of the agricultural delegation; and
(c) the Regional National Committees (hereinafter referred to as the Regional Selection Committees).
(2) The selection boards referred to in paragraph 1 (hereinafter referred to as the selection committees) are subject to the needs of the livestock business plan and the guidelines of the Ministry of Agriculture.
§ 2.
The breed selection shall be:
(a) the basic ones on which the breeding animals to be used for breeding are first selected;
(b) general, for which breeding animals are already in use each year and on which their breeding value is re-assessed. With the agreement of the Regional National Committee, additional general withdrawals may be made if the breeding animals could not be presented for general selection for serious reasons.

The selection committee.
§ 3.
(1) Central (Regional) Selection Board
(a) carry out a specific classification of breeders and breeders before entering them in national breeding books (Section 3 (1) of the Act);
(b) carry out basic selection of breeders;
(c) approve breeding plans drawn up by regional national committees;
(d) carry out general selection of stallions and breeders intended for semen collection centres, issue authorisation for them (insemination permit) and amend or revoke the authorisation issued; and
(e) decide to amend the authorisation for admission in the case referred to in Paragraph 13 (1).
(2) Regional Selection Board
(a) grant authorisation for the admission of breeding animals - except for stallions - selected on the basis of a basic selection;
(b) carry out general selection of breeding animals - with the exception of stallions and breeding animals for insemination - and issue admission permits for them;
(c) authorisations for admission, issued in accordance with points (a) and (b), shall be amended or revoked.
§ 4.
(1) The President of the Central (Regional) Selection Board, its representatives and other members of the Commission and their alternates shall be appointed and dismissed by the Ministry of Agriculture, which shall request in advance the proposal of the Regional National Committees and the competent Union of Farmers and ensure that all Regional National Committees are adequately represented. The term of office of members of the commission shall be three years.
(2) The central (regional) selection panel shall establish a special five-member subcommittee from among its members for each species of livestock (horses, cattle, sheep, pigs, goats). The chairman of the subcommittee and four other members, one of whom must be a veterinarian, and their alternates shall be designated by the chairman of the central (regional) selection committee.
§ 5.
(1) The Regional Selection Board shall be set up by the Regional National Committee. The Regional Selection Board shall be composed of the Chairperson, his representative and other members and their alternates. The term of office of members of the commission shall be three years.
(2) The Regional Selection Board shall establish a special five-member subcommittee from among its members for bovine, ovine, porcine and caprine animals. The chairman of the subcommittee and four other members, one of whom must be a veterinarian, and their alternates shall be designated by the chairman of the district selection committee.
§ 6.
(1) The members (alternates) of the selection committees may be members (alternates) of several selection committees and of several subcommittees. Their function is honorable.
(2) Reimbursement of the actual expenditure of the members of the selection committees shall be paid in accordance with the rules applicable to travel, removal and other expenses for civil servants.
§ 7.
(1) At least three members of the selection committee should be present in order to hold a resolution. For additional general selection, the presence of the chairman and veterinarian of the relevant district selection subcommittee shall be sufficient.
(2) The selection subcommittees shall be delivered by a majority vote. The chairman shall vote for the last time; in the event of a tie, the opinion to which the President opted. Their decisions are final.

Oddíl III.

Breeding samples.
§ 8.
(1) The basic selection shall normally take place on the shopping markets (auctions) for breeding animals organised under the market (auction) order issued by the Ministry of Agriculture.
(2) General selection shall take place once a year on grounds which must be organised in such a way that as many breeders as possible can be shown and kept under the minimum burden. The distance from the seedling point, except in the case of stallions, shall not exceed 7 km from the breeding post.
(3) The basic and general selection of breeders shall be held as a competition to achieve the best breeding results.
(4) General withdrawals in stables are prohibited.
§ 9.
For general selection, the local national committee shall register the breed already selected, except those selected for basic selection in the current calendar year. The transport of breeders for selection and return shall be provided by their breeders at their own expense and risk.
§ 10.
The selection boards shall keep lists of breeding animals which they have selected, by municipality, in stallions by stallion.
§ 11.
The results of the breed selection procedure shall be notified:
(a) in the case of basic selection at the place of selection, both by oral declaration and by written declaration on the spot accessible to breeders;
(b) in the case of general choices and additional general choices, by oral announcement at the place of selection, and in the municipality of the breeder in the usual manner.
§ 12.
(1) A selection book shall be issued by the central selection committee to the breeder selected on the basis of the basic selection.
(2) The selection book is a public instrument in which it is entered in particular:
(a) that the breed has been selected,
(b) that an authorisation has been granted (insemination);
(c) an amendment to the entries referred to in (a) and (b).
(3) Only the selection boards and veterinary services may make entries in the selection book.
(4) The model of the selection book is determined by the Ministry of Agriculture.

Oddíl IV.

Permission to admit.
§ 13.
(1) The authorisation to admit applies to a specific circuit. If the breeding conditions in the neighbouring district so require, the permit may also be extended to that district selection committee; If two or more district national committees are concerned and there is no agreement between the participating regional selection committees, the central selection committee may do so.
(2) Where a breeder is moved in the district of the district national committee to another place for which no authorisation for admission is granted, the district selection committee shall decide to retain, amend or revoke the authorisation for admission. If a breeder moves to the perimeter of another district national committee, the district selection committee shall decide on a new post.
(3) The authorisation for admission is valid until the next general selection unless otherwise provided for in this Regulation.
§ 14.
(1) The county selection committee shall issue to the breeder a breeding register in which the breeder records all the data relating to the admission of the breeder.
(2) The admission register shall be a public instrument; its model shall be determined by the Ministry of Agriculture.
§ 15.
The breeding book and the breeding register shall be submitted by the breeder to the supervisory and safety authorities upon request, as well as when presenting the breeder for the new selection.
§ 16.
(1) The authorisation for admission shall be renewed, amended or revoked in the case of general selection or additional general selection.
(2) Where authorisation for admission has been revoked or the period of validity has expired, the selection panel which has made the general selection, the selection book and the admission register shall withdraw.
§ 17.
The provisions on authorisation for admission shall apply mutatis mutandis to authorisation for insemination.

Oddíl V.

Transitional and final provisions.
§ 18.
Breeders for which a permit for admission (for insemination) has been issued before the application of this Regulation in accordance with the existing rules may be used until the next general selection.
§ 19.
The Ministry of Agriculture may, on a case-by-case basis, authorise exemptions from the provisions of this Regulation.
§ 20.
This Regulation shall enter into force on 15 February 1951. they shall be carried out by the Minister for Agriculture in agreement with the participating members of the Government.
