of 25 January 1949
on the purchase and delivery of agricultural products under the contract.
The Government of the Czechoslovak Republic orders pursuant to § 41, paragraph 2 of the Act of 27 October 1948, No. 241 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the first five-year Plan):
(1) Farmers shall enter into a contract with the Centre for the Management of Agricultural Products (hereinafter referred to as the "Headquarters") or a legal person authorised by it to supply the quantities of agricultural products determined in accordance with Article 2. This contract obliges the Institute or the legal person authorised by it to redeem this quantity of agricultural products, thereby fulfilling the obligation under Article 2 of the Act of 2 December 1948, No 278 Coll., on the Office for the Management of Agricultural Products as regards the type of agricultural products covered by the contract.
(2) The contract referred to in paragraph 1 shall be concluded in the presence of a representative of the local national committee, who shall co-sign it.
(3) The commitments entered into by farmers under the contract referred to in paragraph 1 shall replace their delivery obligation under the relevant measures in the management of the maintenance holding.
The quantities of agricultural products covered by the contract referred to in Article 1 shall be determined by the local national committee, with the participation of a representative of the district national committee, in accordance with the guidelines of the Ministry of Food issued in agreement with the Ministry of Agriculture within the time limits laid down in these Directives.
If the contract is not concluded, the district national committee shall, in conjunction with the local national committee, determine the delivery obligation for the farmer under the relevant rules.
(1) If the farmer cannot fulfil the delivery obligation under the contract for reasons of force majeure, the district national committee may, in cooperation with the local national committee, reduce that obligation accordingly. The District National Committee shall follow the guidelines issued by the Ministry of Food in agreement with the Ministry of Agriculture.
(2) On the basis of the measures referred to in paragraph 1, the Centre shall indicate the relevant amendment to the contract.
(1) The contract is concluded in writing, preferably on all agricultural products to be delivered by the farmer.
(2) The model of the contract shall be published by the Ministry of Nutrition in the Official Journal.
The above provisions do not apply to the purchase and delivery of agricultural products from Czechoslovak state goods, a national enterprise, a military administration and a large-scale livestock feed designated by the Ministry of Agriculture in agreement with the Ministry of Food; the method of redemption and the supply thereof shall be determined directly by the Ministry of Food in agreement with the Ministry of Agriculture and, as regards the assets of the military administration, in agreement with the Ministry of National Defence.
The measures provided for in Articles 2 to 4 are carried out in conjunction with the relevant agricultural organisation component.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Minister of Nutrition in agreement with the Minister for Agriculture and the members of the Government involved.
