DECLARATION
of 21 March 2024
to implement the Vehicle Liability Insurance Act
The Ministry of Finance provides, pursuant to § 31 (3), § 38 (6), § 45 (4) and § 81 (4) of Act No. 30 / 2024 Coll., on the insurance of vehicle liability:
Range of traffic accident and vehicle data in the search
(1) The traffic accident reports necessary to investigate the harmful event provided by the Police of the Czech Republic to the Office are:
(a) details of the participants in the accident and their identification and contact details, where available;
(b) data on vehicles participating in the accident, including their identification and technical data;
(c) information on the insurance of vehicles participating in the accident;
(d) the day and time of the accident;
(e) an indication of the location of the accident containing the coordinates of the global navigation system;
(f) data on the nature and causes of the accident, data on the fault of the accident and data on the detected infringements of the law where the conduct has been dealt with as an offence by an on-the-spot order, in other cases information on suspected infringements;
(g) a description of the injury suffered and, where appropriate, its expected amount;
(h) photo documentation of an accident;
(i) the number of the document of the service concerned.
(2) The data on vehicles in the search necessary for the investigation of a harmful event provided by the Police of the Czech Republic to the Office are:
(a) the registration number, if issued and stolen, otherwise the last 6 characters of the vehicle identification number of the stolen vehicle, the vehicle identification number and, if available, the engine number;
(b) the year of manufacture of the vehicle;
(c) the type of vehicle, its factory mark and its type;
(d) the colour of the vehicle,
(e) the date of publication of the vehicle in the search;
(f) indication of the place of theft of the vehicle;
(g) the date of withdrawal of the vehicle from the search;
(h) the date on which the vehicle was returned to its owner or other authorised person;
(i) the reference document number of the unit conducting the search.
Scope of liability insurance data
Indication of the formation, time of interruption, change and termination of liability insurance provided by the insurer to the Office
(a) the number of the green card, if issued, the date of issue and its duration;
(b) the name, date of birth, birth number or identification number and address of the owner of the vehicle, the vehicle operator and the policy holder;
(c) the telephone number and e-mail address of the policy holder and the vehicle operator, if available,
(d) the name and address of the insurer's registered office;
(e) the date on which the liability insurance was incurred and the termination of liability insurance and, if agreed, the period of interruption;
(f) the type of vehicle, its factory mark and its type,
(g) vehicle identification number; If the vehicle identification number has not been assigned, the body or chassis number of the vehicle,
(h) vehicle registration number or military registration number;
(i) the registration number of the vehicle and, if available, the vehicle technical licence number;
(j) the number of the insurance contract which has been agreed with liability insurance.
Vehicle data range
(1) Data on vehicles provided by the Ministry of Transport to the Office are
(a) the registration number of the vehicle, the date of its assignment and the date of expiry;
(b) the registration number of the vehicle and, where available, the date of its issue and the date of expiry;
(c) the date of the first registration of the vehicle and the date of the first registration of the vehicle in the Czech Republic,
(d) the purpose for which the vehicle is intended;
(e) the type and category of vehicle;
(f) the factory mark of the vehicle, its trade mark and the marking of the vehicle type,
(g) vehicle identification number; If not, then the chassis serial number of the vehicle,
(h) information on the vehicle manufacturer, chassis, engine and bodywork;
(i) type, engine power and engine displacement and fuel;
(j) the type, serial number and colour of the bodywork, the number of seating and standing positions, where applicable, the number of beds, the dimensions of the loading area, the volume of the cabinet or tank,
(k) an indication of the overall dimensions of the vehicle;
(l) the maximum technically permissible mass, the maximum authorised mass and the operating mass of the vehicle and the maximum technically permissible axle mass and the maximum authorised axle mass;
(m) the vehicle's design speed;
(n) number of axles and driven axles, type of coupling device, maximum technically permissible mass of the trailer, maximum authorised mass of the trailer, maximum technically permissible mass of the combination and maximum authorised mass of the combination,
(o) the degree of compliance with the emission level, CO2 emissions and fuel consumption data;
(p) the date of completion and the expiry date of the vehicle technical inspection;
(q) the date and reason for the decommissioning of the vehicle under the law governing the conditions of use of vehicles on the road;
(r) the date and reason for the disappearance of the vehicle under the law governing the conditions of use of vehicles on the road;
(s) the date of submission of the registration marks under the law governing the conditions of use of vehicles on the road;
(t) the state of the distance travelled counter and the date of its detection;
(u) the number of persons registered in the register of road vehicles as owner of the vehicle since the first registration of the vehicle in the Czech Republic.
(2) The data relating to the owner and operator of the vehicle provided by the Ministry of Transport to the Office are data relating to the person registered as the owner of the vehicle in the register of road vehicles and data relating to the person registered as the vehicle operator in the register of road vehicles, to the extent provided for by the law governing the conditions of use of vehicles on the road.
Scope of data on claims and claims
(1) The claims and claims of the insurer, if available, provided by the Office are:
(a) the number of the claims and claims;
(b) the date, time and location of the injury involving the coordinates of the global navigation system;
(c) the date and time of notification of the harmful event;
(d) the name and address of the insurer's registered office;
(e) the number of the insurance contract which has been agreed with the insurance of liability;
(f) the name, date of birth, birth number or identification number and address of the owner of the vehicle, the vehicle operator and the policy holder,
(g) the type of vehicle the operation of which has caused injury, its factory brand and its type;
(h) the identification number of the vehicle in whose operation the damage occurred; If the identification number has not been assigned, the body or chassis number of the vehicle,
(i) the registration number of the vehicle in operation of which the damage occurred and, if available, its technical licence number;
(j) the registration number or the military registration number of the vehicle the operation of which has caused damage;
(k) the name, date of birth, birth number or identification number and address of the home or registered office of the injured party;
(l) the type of vehicle damaged, its factory brand and its type;
(m) the identification number of the damaged vehicle; If the identification number has not been assigned, the body or chassis number of the vehicle,
(n) the registration number of the damaged vehicle and its technical licence,
(o) the registration number or military registration number of the damaged vehicle;
(p) an indication of the amount and nature of the right to supply and the extent of the damage to the vehicle applied,
(q) an indication of the amount and nature of the premium provision;
(r) an indication of the amount and nature of the payment;
(s) an indication of the amount of penalties applied;
(t) the state of the investigation of the event and the event;
(u) the date on which the investigation ended and the reason for its closure.
(2) The insurer is not obliged to provide the Office with information that can be ascertained from the information provided to the Office under § 2 or 3.
Amount of the daily contribution rate
(1) The daily rate of the allowance for the period without liability insurance shall be:
(a) 6 CZK, if a motorcycle with an engine cylinder capacity not exceeding 50 cm3,
b) 13 CZK, if a motorcycle with an engine cylinder capacity exceeding 50 cm3 and not exceeding 350 cm3,
(c) 26 CZK, if a motorcycle with an engine cylinder capacity exceeding 350 cm3 and not exceeding 500 cm3,
d) 32 CZK, if it is a motorcycle with an engine cylinder capacity exceeding 500 cm3,
e) 81 CZK, if it is a passenger car with an engine cylinder capacity not exceeding 1000 cm3,
f) 51 CZK, if it is a passenger car with an engine cylinder capacity exceeding 1000 cm3 and not exceeding 1 350 cm3,
g) 61 CZK, if it is a passenger car with an engine cylinder capacity exceeding 1 350 cm3 and not exceeding 1 850 cm3,
h) 83 CZK, if it is a passenger car with an engine cylinder capacity exceeding 1,850 cm3 and not exceeding 2,500 cm3,
i) 109 CZK, if it is a passenger car with an engine cylinder capacity exceeding 2,500 cm3,
j) 74 CZK, if it is a residential car,
k) 180 CZK, if it is an ambulance,
(l) CZK 209, if the maximum authorised mass does not exceed 5 000 kg,
m) 399 CZK, if it is a bus with the maximum authorised weight exceeding 5000 kg,
n) 107 Kč, if by trolleybus,
o) 120 CZK, if a truck other than that referred to in (r) with a maximum authorised mass not exceeding 3,500 kg,
(p) CZK 189, if it is a truck other than that referred to in (r) with a maximum authorised mass exceeding 3,500 kg and not exceeding 12000 kg,
q) CZK 493, if it is a truck other than that referred to in (r) with a maximum authorised mass exceeding 12000 kg,
r) 582 CZK, if it is a truck that is or is to be registered in the register of road vehicles as a trailer tractor or trailer tractor,
s) 23 Kč, if it is a tractor,
(t) 5 CZK, if a trailer with a maximum authorised mass not exceeding 750 kg,
(u) 12 CZK, if a trailer with a maximum authorised mass exceeding 750 kg and not exceeding 10 000 kg,
v) 83 CZK, if a trailer with a maximum authorised mass exceeding 10 000 kg,
(w) 20 CZK if the vehicle is different from (a) to (v).
(2) If the vehicle has only electric power, the daily contribution rate for the period without liability insurance
(a) 13 CZK, if a vehicle with a power not exceeding 30 kW,
b) 81 CZK, if a vehicle with a power output exceeding 30 kW and not exceeding 40 kW,
(c) 51 CZK, if a vehicle with a power exceeding 40 kW and not exceeding 55 kW,
(d) 61 CZK, if a vehicle with an output exceeding 55 kW and not exceeding 80 kW,
e) 83 CZK, if a vehicle with an output exceeding 80 kW and not exceeding 135 kW,
f) 109 CZK, if it is a vehicle with a power exceeding 135 kW.
(3) If it is a registered vehicle, the Office shall proceed to determine the type of vehicle for the purposes of the daily contribution rate for the period without liability insurance according to the vehicle data provided by the Ministry of Transport.
Amount of flat-rate costs
The amount of the flat-rate costs of the Office associated with the out-of-court application of the right of contribution is CZK 300.
Scope of information published by the Office
(1) The information published by the Office on its website includes:
(a) the name, address and identification number of the Office;
(b) the names, addresses and identification numbers of the members of the Office;
(c) a description of the organisational structure of the Office;
(d) the names of the members of the Management Board and the Audit Committee of the Office, the date of the establishment of the office and the indication of the professional qualifications for the performance of the duties;
e) an overview of the activities of the Office under the Vehicle Liability Insurance Act,
(f) balance sheet of the Office,
(g) a statement of profit and loss of the Office.
(2) The Office shall publish the information referred to in paragraph 1 in accordance with the status at the date of:
(a) 31 March, 30 June and 30 September within 6 weeks of the end of the relevant calendar quarter;
(b) 31 December within 4 months of the end of the calendar year concerned.
(3) The Office shall publish the information referred to in paragraph 1 for the last and 3 preceding quarters.
(4) The disclosure requirements referred to in paragraph 1 shall be deemed to be met if the Office publishes this information in the annual report.
(5) The Office publishes the information referred to in paragraph 1 in the Czech language in the form of an unlocked data file suitable for download in a commonly used format.
Transitional provision
By 30 September 2024, the Ministry of Transport shall provide the Office with data on vehicles, their owners and operators and on registration changes pursuant to Article 15 (12) of Act No. 168 / 1999 Coll., as effective before the date of entry into force of Act No. 30 / 2024 Coll.
Efficacy
This Decree shall take effect on 1 April 2024, with the exception of the provisions of Sections 2 and 3, which shall take effect on 1 October 2024.
