GOVERNMENT REGULATION
of 25 March 2015
amending Government Regulation No 363 / 2009 Coll., on determining the retirement age and the conversion of the old-age pensions of certain miners who started their employment before 1993
The Government orders pursuant to § 107 (2) of Act No. 155 / 1995 Coll., on Pension Insurance, as amended by Act No. 198 / 2002 Coll., Act No. 108 / 2009 Coll. and Act No. 220 / 2011 Coll.:
Government Decree No 363 / 2009 Coll., on determining the retirement age and the conversion of the old-age pensions of certain miners who began to work before 1993 is amended as follows:
1. The opening sentence of the Decree of the Government reads: "The Government orders pursuant to § 107 (2) of Act No. 155 / 1995 Coll., on Pension Insurance, as amended by Act No. 108 / 2009 Coll. and Act No. 220 / 2011 Coll.: '.
2. In Article 1 (b), in the sentence, the first words "before 1 January 2009 'are deleted and in the part of the sentence, second after the semicolon, the words" underground' are inserted after the words "under Article 4 '.
3. In Article 4, the words "between 1 January 1993 and 31 December 2008 'are replaced by the words" after 31 December 1992' and the words "under the ground 'are inserted after the words" worked'.
Transitional provision
If the conditions for determining the retirement age laid down in Sections 1 and 2 of Government Regulation No 363 / 2009 Coll., as effective from the date of entry into force of this Regulation, were fulfilled before the date of entry into force of this Regulation and the old-age pension
(a) has not been granted before that date, the retirement age is determined in accordance with Government Decree No 363 / 2009 Coll., as effective from the date of entry into force of this Regulation, and for determining the percentage rate of the old-age pension, Section 76a of the Pension Insurance Act shall apply mutatis mutandis; an old-age pension may be granted at the earliest from the date of entry into force of this Regulation,
(b) has been granted before that date, it shall be treated mutatis mutandis in accordance with Article 3 (1) (b) of Decree-Law No 363 / 2009 Coll. with the fact that the old-age pension will increase at the earliest from the first instalment of the pension due after the date of entry into force of this Regulation.
Efficacy
This Regulation shall enter into force on the first day of the second calendar month following its publication.
