DECLARATION
of 21 February 2008
amending Decree No. 266 / 1999 of the Ministry of Defence Coll., on the method of providing free meals, equipment and transport equipment and on the accommodation of professional soldiers, as amended by Decree No. 456 / 2002 Coll.
According to § 93 of Act No. 221 / 1999 Coll., the Ministry of Defence provides:
Decree No. 266 / 1999 Coll., on the method of providing free meals, equipment and transport equipment and on the accommodation of professional soldiers, as amended by Decree No. 456 / 2002 Coll., is amended as follows:
1. in § 1 (e), the words "in a military school, flight activity carried out at an air service unit or at an air school base for the purpose of preparing soldiers who are preparing in the field of study a pilot of a military aircraft for the performance of their duties by studying" shall be replaced by the words "flight activity carried out at an air service unit for the purpose of preparing soldiers for the performance of their duties as an executive pilot."
2. In Article 1, at the end of point (e), the dot is replaced by a comma and the following points (f) to (h) are added:
"(f) foreign operation of an operation outside the territory of the Czech Republic in which a soldier performs tasks within a multinational force unit, including operations of international governmental organisations;
(g) the area of deployment of a geographical area of foreign operation;
(h) by sending the service of a soldier in a foreign operation, starting on the day of leaving the territory of the Czech Republic or at the place where the foreign office or place from which the soldier is removed is dislocated and ending on the day of his return from the foreign operation in the Czech Republic or at the place where his foreign office or place of establishment is dislocated. "
3. In Article 2, the following paragraph 3 is added after paragraph 2:
"(3) If it is not possible to provide for free meals in a foreign operation as referred to in paragraph 1 or if the service body so decides, it shall be paid in the same way as during a foreign business trip, except where the soldier receives food from an international government organisation to secure his activity. '
4. in Paragraph 4 (1) (e), the words "studying in a military school in the field of study of a military pilot" shall be replaced by the words "preparing to perform the duties of an executive flyer."
5. In Paragraph 4 (1), the dot at the end of point (f) is replaced by a comma and the following point (g) is added:
"(g) a soldier transferred to a foreign operation, unless he receives food from an international government organisation for the duration of his secondment. It shall also be provided in the case referred to in Section 5 (1) (b) if the soldier is in the deployment area. '
6. in Article 5 (1) (a), the words "leave granted for continuous military training" shall be inserted after the words "leave."
7. in Article 5 (1) (e), the words "and parental" shall be inserted after the words "maternity."
8. In Article 7 (b), the words "studying in a military school 'are replaced by the words" preparing to perform the duties of an executive flyer'.
9. In Article 7 (c), the words "tasks in the units of the multinational armed forces' are replaced by the words" duties in a foreign operation or in a foreign operation '.
10. In Article 11, the following paragraph 4 is added:
"(4) The financial value of the food levy for a soldier in a foreign operation shall be determined according to the evolution of the commercial prices of food in the deployment area. '.
11. in Paragraph 14 (8):
"(8) A soldier who prepares for the performance of his duties by studying in schools and courses abroad, or is transferred abroad, and a soldier who is seconded to perform his duties in a foreign operation, shall be provided with military equipment for operating abroad. Upon completion of the secondment, the military equipment referred to in paragraph 1 shall be provided to the soldier, provided that the essential or reduced basic equipment has not been issued to him during his occupation. ';
12.Paragraph 15 (1), including footnotes 3a and 3b, reads as follows:
"(1) Military equipment to be owned shall be secured for each full calendar month for which the soldier was entitled to a salary or compensation of plate3a) or sick be3b), retrospectively. A soldier's entitlement to provide military equipment arises even if the temporary incapacity to serve for sickness or accident falls within that period when a soldier is not legally compensated for his salary. Military equipment may be provided on a one-off basis for calendar year 3a).

3b) Act No. 32 / 1957 Coll., on sickness care in the armed forces, as amended. Act No. 187 / 2006 Coll., on sickness insurance, as amended. '
13. in Paragraph 16 (3):
"(3) A one-off refund in cash shall be paid to the soldier in the month following the month in which the soldier was entitled to a refund in cash."
14. In Article 16, paragraphs 4 and 5 are added:
"(4) Members of Military Intelligence shall be paid compensation in cash for the use of civil clothing in connection with the performance of specific military intelligence tasks. The Director of Military Intelligence shall each year issue a list of systemised places for which compensation is paid in cash for the use of civil clothing for service purposes. This compensation shall be paid back to the soldier each calendar year. If a member of the Military Intelligence has not been classified in that systemically located place throughout the calendar year or if he has changed his classification during the calendar year, a proportion of the refund shall be paid for the calendar months concerned.
(5) Members of the Military Police shall be paid compensation in cash for the use of civil clothing to perform specific tasks of the Military Police. The Chief of Military Police shall each year issue a list of systemised places where compensation is paid in cash for the use of civil clothing for service purposes. This compensation shall be paid back to the soldier each calendar year. Where a member of the Military Police has not been classified in that systemised place for the entire calendar year or if a proportion of the refund has been paid for the calendar year in question for the change in classification. ';
15. in Paragraph 18, the words "in units of the multinational armed forces" shall be replaced by the words "to carry out official duties in a foreign operation."
This Decree takes effect on 1 March 2008.
