laying down more detailed provisions on the residence of foreigners in the territory of the Czechoslovak Socialist Republic
In agreement with the Ministry of Foreign Affairs, the Ministry of Interior provides, pursuant to § 6 of Act No. 68 / 1965 Coll., on the residence of foreigners in the territory of the Czechoslovak Socialist Republic:
Czechoslovak visas
(1) Czechoslovak visas
(a) Czechoslovak diplomatic missions and consular posts to foreigners abroad;
(b) the district department of the Ministry of Interior (in regional cities of the Regional Administration of the Ministry of Interior) to foreigners who are staying in the territory of the Czechoslovak Socialist Republic and intend to travel abroad,
(c) the border inspection department at border crossing points in cases specified by the Ministry of Interior.
(2) The district department of the Ministry of Interior (in regional cities of the Regional Administration of the Ministry of Interior) decides on the extension of the Czechoslovak visa.
(3) Foreigners enjoying diplomatic and consular privileges and immunities in the Czechoslovak Socialist Republic and foreigners are granted Czechoslovak visas and extended by the Ministry of Foreign Affairs.
(4) An application for or extension of a Czechoslovak visa shall be made on the prescribed form. An application for an extension of the Czechoslovak visa shall be lodged no later than 3 days before its expiry.
Residence permit
Granting of residence permits
(1) An application for a residence permit shall be lodged with the Czechoslovak diplomatic mission or consular post, in exceptional cases with the reporting authority. The application shall be decided by the Ministry of the Interior.
(2) The residence permit card is issued by the reporting authority to which the alien is required to present the travel document, the document issuing the Czechoslovak visa, three photographs of dimensions 5,5 cm x 6,5 cm, with a lower white border of 1,5 cm, or additional documents (translation thereof), which the reporting authority will require.
(3) A residence permit is not issued to foreigners under the age of 15 and to foreigners deprived of legal capacity.
(4) A residence permit is required for a stranger to carry and to prove himself at all times.
Extension of residence permit
(1) An application for renewal of the residence permit must be submitted no later than 14 days before the expiry of the period of validity of the residence permit to the reporting authority which decides on it.
(2) An alien is required to add a residence permit to the application for renewal.
Entries in the residence permit
Entries in the residence permit shall be carried out by the reporting authority. Employers are required to enter in the residence permit card the beginning and termination of the working (teaching) ratio of a stranger.
Change reporting
A stranger to whom a residence permit has been granted shall report to the competent reporting authority within 3 days on the prescribed form any changes which have occurred in his personal data or circumstances in which he has been granted a residence permit, in particular any change in his name, surname, nationality, status, birth and death of the child, employment, interruption or cessation of study or practice, the issue of a new travel document, and shall provide appropriate documents.
Reporting of residence
Persons reporting mandatory
(1) Any stranger over 15 years of age shall, unless otherwise specified, report his stay in person on the prescribed reporting form to the reporting authority.
(2) Foreigners under 15 years of age who are accommodated together with their parents must be entered in parents' reporting forms. If a stranger under 15 years of age is not staying with any parent, his stay must be reported separately on the reporting form.
(3) The obligation to report the residence of foreigners under the age of 15 who are not staying with any of the parents, and foreigners who are unable to fulfil this obligation because of their mental or physical condition, shall be the one who is obliged to keep an eye on them or whose supervision has been entrusted to them under the relevant regulations.
Reporting authorities
The authorities are the Regional Department of the Ministry of the Interior (in the regional cities of the Regional Administration of the Ministry of Interior), responsible for the residence of a stranger in the territory of the Czechoslovak Socialist Republic.
Accommodation
The accommodation is
(a) the owner (user) of the building or property which he has accommodated in his building or on his property;
b) the user of the apartment or other room that the stranger has accommodated in his apartment or room,
(c) the operator of the accommodation, tourist, self-camping, recreational, medical, social or similar facility (hereinafter referred to as the "accommodation facility") which has accommodated the stranger;
(d) any other person who has provided any accommodation to a stranger.
Obligations of the accommodation provider
(1) The accommodation provider shall:
(a) examine the identity of the alien according to his travel document or residence permit;
(b) ensure that the alien he has accommodated complies with the obligation to report his residence within the prescribed period,
(c) immediately notify the reporting authority of a stranger who requests accommodation and cannot or refuses to prove his identity or has no valid document authorising his residence in the territory of the Czechoslovak Socialist Republic.
(2) In addition to the obligations referred to in paragraph 1, the accommodation operator shall have the following obligations:
(a) make entries on the beginning and termination of the stay of a stranger in the accommodation facility to the home book, according to the foreign travel document or residence permit;
b) Foreigners who reside in the territory of the Czechoslovak Socialist Republic on the basis of a travel document bearing a Czechoslovak visa confirm the time of accommodation on the form of the application for a Czechoslovak visa;
(c) in the case of foreigners residing in the territory of the Czechoslovak Socialist Republic on the basis of a residence permit, submit this card to the reporting authority for registration of a temporary stay;
(d) submit the home book to the competent reporting authority.
Reporting the residence of foreigners who are permanently present in the territory of the Czechoslovak Socialist Republic
(1) An alien to whom a residence permit has been granted is required to report permanent residence to the reporting authority.
(2) The stranger is obliged to report the beginning of the permanent residence within 48 hours of accommodation.
(3) The stranger is obliged to report the termination of the permanent residence no later than 48 hours before leaving the territory of the Czechoslovak Socialist Republic.
(4) The reporting authority shall enter the beginning and termination of the residence permit in the residence permit.
(5) The change of permanent residence is required by the alien to report 48 hours in advance to the reporting authority for which he is registered for permanent residence.
(6) A temporary stay outside the place of permanent residence shall be declared to the reporting authority within 48 hours of accommodation, indicating the duration of the temporary stay. The period of temporary residence shall be entered by the reporting authority in the residence permit card.
Reporting of residence of foreigners temporarily present in the territory of the Czechoslovak Socialist Republic
(1) An alien who is temporarily present in the territory of the Czechoslovak Socialist Republic on the basis of a travel document is obliged to report a temporary stay within 48 hours of entry into the territory of the Czechoslovak Socialist Republic only to the reporting authority responsible for the place of first accommodation.
(2) For foreigners staying in the accommodation facility, the accommodation operator shall be obliged to report the accommodation.
Relief from the notification of a transitional stay
(1) A transitional stay (Sections 10 (6) and 11) of less than 48 hours and the termination of the transitional stay shall not be reported to the reporting authority.
(2) Nationals of socialist states are required to declare temporary residence under Paragraph 11 (1) of this Order only if this stay lasts more than 30 days.
Reporting forms
Reporting forms are issued to foreigners by reporting authorities. The alien must complete the full and true reporting forms and submit them to the reporting authority at the same time as the travel document or proof of residence.
Final provisions
Aliens enjoying diplomatic and consular privileges and immunities in the Czechoslovak Socialist Republic
The provisions of this Order on the notification and authorisation of residence shall not apply to the following foreigners:
(a) members of diplomatic missions and consular offices of foreign states and members of their families living with them in the common household, unless they are citizens of the Czechoslovak Socialist Republic;
(b) representatives of the Member States of the international organisations of which the Czechoslovak Socialist Republic is a member and of the workers of those organisations enjoying privileges and immunities in the Czechoslovak Socialist Republic;
c) representatives of foreign states sent to the Czechoslovak Socialist Republic for international negotiations.
Authorisation of concessions
The Ministry of the Interior, in agreement with the Ministry of Foreign Affairs or by the authorities empowered by them, may, where justified, authorise relief from the provisions of this Order.
Repeal
Decree No 135 / 1953 of the Ú. l., on reporting foreigners and allowing foreigners to stay is hereby repealed.
Efficacy
This decree shall take effect on 1 August 1965.
