DECLARATION
Central management of the purchase of agricultural products
of 18 July 1962
on domestic slaughter of pigs, compulsory sale of lard and purchase of hides from such slaughter
The central management of the purchase of agricultural products shall, in agreement with the participating central authorities, provide for the establishment of the Central Administration of the Purchase of Agricultural Products pursuant to Article 15 of Act No. 51 / 1959 Coll., and Section 6 of the Legal Measures of the Bureau of the National Assembly No 40 / 1962 Coll., on the establishment of the Central Administration of the Purchase of Agricultural Products:
I. Domestic slaughter of pigs
(1) Pigs' breeders may carry out domestic slaughter of a pig (hereinafter referred to as "slaughter") only on the basis of an authorisation granted to them by the competent national committee, provided that they fulfil the conditions laid down in the other provisions of this decree.
(2) The slaughter is only allowed for the purposes of supplying the applicant's own household and the single agricultural cooperatives and other socialist organisations for joint catering only. The authorisation of slaughter for the purpose of the sale of meat shall be prohibited.
(3) The applicant shall only be allowed one slaughter per household in a calendar year, unless otherwise provided for in this Order.
Conditions of slaughter authorisation
(1) The single agricultural cooperatives shall be allowed to be slaughtered if the supplies of pigs for slaughter have been delivered for the preceding quarter from the beginning of the year to which they have been committed by contract or have been made available to them. In the first quarter, the slaughter shall be allowed if the single agricultural cooperative has completed these deliveries of pigs for the previous year.
(2) The members of the single agricultural cooperatives shall be permitted to be slaughtered if the cooperative has complied with the planned supply of pigs for slaughter referred to in paragraph 1.
(3) Individual farmers with an area of agricultural land above 0,50 ha shall be allowed to be slaughtered if the annual total meat supply task is fulfilled; in January and February, the slaughter shall be allowed if they have completed the meat delivery task in the previous year and have secured the arrest of pigs for the current year's tasks.
(4) Other agricultural land users with an area of up to and including 0,50 ha and non-agricultural land users (hereinafter referred to as "non-farmers') shall be permitted to be slaughtered only if they have been given prior approval by the local national committee to feed pigs for slaughter and that they have fulfilled the annual delivery tasks of the current year as regards slaughter in the IVth quarter and those of the previous year as regards slaughter in the other quarters of the year.
(5) In cases of non-compliance with the conditions referred to in paragraphs 2 to 4, the county national committee shall decide on the authorisation of slaughter to those applicants in exceptional cases (non-compliance with supplies, health and social reasons).
(6) If the local national committee has not given its consent in accordance with paragraph 4, the breeder shall be obliged to sell the pig to the authorised purchasing organisation for public supply.
(7) Other applicants (hospitals, mass caterers, etc.) are permitted to be slaughtered if the applicant provides confirmation that the supply plan for the undertaking (unit) provides for slaughter. This confirmation is not necessary in those departments where the central supply plan includes the supply of meat and lard from the slaughter of pig farming (ancillary agricultural holdings of departments).
(1) The slaughter of members of single agricultural cooperatives, individual farmers and non-farmers is permitted by the local national committee, subject to the conditions laid down in paragraphs 2 to 4 of Article 2.
(2) The county national committee shall decide on the authorisation of the slaughter of single agricultural cooperatives and other socialist organisations authorised to feed pigs for fattening from feed waste, from the leftovers of factory canteens and such.
(1) Only those applicants who have fed themselves from piglets or pigs who have gained a live weight of up to and including 50 kg will be allowed to be slaughtered by the local national committee.
(2) Where the conditions referred to in paragraph 1 are not met, the Regional National Committee may exceptionally decide to authorise the slaughter of the national district committee,
(a) interchangers who have received a pig of more than 50 kg as a natural exchange from a farmer who himself fulfils the conditions for authorisation of slaughter;
(b) joint catering establishments and establishments of socialist organisations or bed facilities of preventive and therapeutic care, where such establishments (establishments) have contractually entrusted pigs for fattening to gatherers of kitchen waste in places where pig holdings are prohibited in the inner district of the municipality.
Only the district national committee may decide to authorise the second slaughter of members of single agricultural cooperatives and individual farmers with an area of agricultural land above 0,50 ha, only in exceptional cases, taking into account the social and health conditions of the applicant; In addition, for members of single agricultural cooperatives, the cooperative shall be required to fulfil the delivery tasks referred to in Section 2 (1) and for individual farm farmers with an area of agricultural land of more than 0,50 ha, so that the farmer shall fulfil the delivery tasks referred to in Section 2 (3).
(1) If the applicant has not delivered the quantity which is a condition for authorisation of slaughter and if only a smaller quantity which can be offset by delivery of the half-carcase is missing, the authorisation of slaughter shall be decided by the district national committee, subject to the applicant supplying half of the pig for delivery of the supply.
(2) Halves of pigs from slaughter are delivered with or without head, without offal, but with fat dorsal, feline and whole skin.
Procedure for authorising slaughter
(1) The applicant shall submit an application for slaughter to the local national committee in whose district the pig has been fattened. The application shall be accompanied by a certificate from the agricultural purchasing and supply plant to carry out its supply tasks pursuant to Article 2 (1) to (3). Applicants referred to in Article 2 (4) shall provide proof of the performance of their supply tasks by the relevant purchasing organisation.
(2) The slaughter permit is always issued by the local national committee, even if the county national committee has decided on the authorisation.
(3) Applications for slaughter shall be decided by the local national committee within 7 days and by the district national committee within 14 days of receipt of the application.
(4) At the same time as the authorisation to carry out the slaughter, the national committee shall inform the relevant veterinary establishments and, where appropriate, the surveyors of the meat of domestic slaughter in order to carry out the veterinary inspection.
(5) The applicant who has been authorised to be slaughtered will pay an administrative fee in accordance with the special rules on the receipt of the slaughter authorisation document. *)
(6) If the pig has necessarily been slaughtered and the breeder who fulfils the conditions for authorisation of slaughter wishes to keep it for his household, he must submit a request to the local national committee for approval to keep the pig no later than the following day after the necessary defeat. The application must be accompanied by a certificate from the veterinarian on the cause for which the pig must have been slaughtered and on the fact that from the point of view of the veterinary health, it is not against leaving the pig. The request for the retaining of the necessarily slaughtered pig shall be decided within 24 hours of its submission. * *)
II. Mandatory sale of lard
(1) When authorising slaughter, the local national committee shall at the same time prescribe the quantity of greased lard (hereinafter referred to as "lard ') which the applicant is obliged to sell from the slaughter to the lard collection.
(2) The quantity of fat for compulsory disposal shall be as follows:
(a) members of uniform agricultural cooperatives and of staff of State Socialist organisations 5 kg of lard for each slaughter;
(b) land users up to 0,50 hectares and shallots, provided that they have been authorised to feed the pig for slaughter, and other individual farmers, 7 kg of fat for each slaughter.
(3) Slaughter of pigs authorised for joint catering of single agricultural cooperatives and other socialist organisations which fatten pigs from feed waste and residues from factory canteens is not subject to compulsory sale of lard.
(4) Of the necessarily slaughtered pig left to the holder to supply his household, the quantity of lard for compulsory disposal shall not be fixed if the meat has been recognised by the veterinarian as conditionally edible. If the meat has been recognised as fit for consumption without restriction, the compulsory sale of the fat shall not be prescribed only if the dead weight of the pig does not exceed 50 kg; if the dead weight exceeds 50 kg, the amount of fat referred to in paragraph 2 shall be prescribed.
(5) The amount of fat for compulsory disposal shall be prescribed only half the amount if the slaughter is permitted, subject to half of the pig being sold to the relevant purchasing organisation.
(1) Applicants whose households live in at least 3 persons under 15 years of age or are permanently unfit for work or one person with tuberculosis will be exempt from compulsory sale of lard, or one person with tuberculosis will prove the disease by confirming the hospital's tuberculosis department with a clinic (clinics).
(2) For the second slaughter, the exemption provided for in paragraph 1 shall not apply in the same calendar year.
(1) The forces of the armed forces are exempted from the compulsory sale of lard from slaughter.
(2) The compulsory disposal of fat from slaughter is not provided for in the rendering techniques (convenient).
(1) Lard collection plants are purchased from slaughter. The seal must be submitted to the collection centre within 7 days after slaughter. The lard collector shall issue a purchase note at the time of taking over the lard stating: the name and address of the pig farmer, the date of taking over, the weight of the lard, the price per 1 kg and the total amount to be paid. The ticket will be signed by the supplier and the representative of the collection centre.
(2) The seed must be of back fat or of feline fat, fresh, impeccable quality, white colour, not exceeding a slight grey-yellow shade, consistence at 15 ° C of grease, smooth to fine-grained structure, full aroma and taste, pleasant, delicate and typical for freshly rendered lard, clean, free of deposits, greaves and other impurities.
III. Withdrawal, disposal and removal of pig skins
(1) Pigs which have been slaughtered in accordance with the provisions of this Decree must have the pig withdrawn and the skin disposed of immediately after withdrawal. If the applicant has been allowed to retain only half of the pig from slaughter, he shall have the pig withdrawn and the skin disposed of in the same way as when the whole pig is kept.
(2) Withdrawals are carried out when pigs are slaughtered in slaughterhouses, workers of the meat industry, in other cases skinners, i.e. persons who have received authorisation from the county national committee to withdraw pigs from the slaughter.
(3) The skin must be removed immediately after withdrawal from all subcutaneous fat, stamped with a retractor using a colour that does not damage the skin; The fat from the skin is given to the pig farmer.
(4) If slaughter is carried out in slaughterhouses, the pig farmer shall hand over the skinned skin of the meat industry, in other cases the skinner. The skinner must treat the skinned skin properly and submit it either in a fresh state no later than the second day to the skin collection, or salt it and store it in a cool place. The salted skin shall be submitted within one week after the slaughter has been authorised to the skin collection centre.
(5) The skin shall be weighed immediately after withdrawal, assessed in good quality in terms of natural defects and its price calculated. No account shall be taken of damage to the skin caused by a staff member of the meat industry or by a skinner (rumps, cuts, etc.). The price of the skin shall be charged by deducting from the remuneration which the pig farmer is obliged to provide to the meat industry, or the skinner for the slaughter and withdrawal of the pig. The meat industry will check that the skinner has placed the skin in the correct grade. *) In the event that the skinner has placed the skin in the wrong grade, the meat industry will repair the shopping list (croponce) and draw attention to the irresponsible behaviour of the skinner by the district national committee. The meat industry company or the skinner will fill in the purchase note immediately upon withdrawal of the skin. * *)
(6) The purchase note shall state: the name and address of the pig breeder, the name and address of the skinner (at the slaughterhouse of the staff member who has withdrawn), the live weight of the pig (found or estimated), the weight, the quality and the price of the skin, the date of slaughter and the remuneration for the slaughter and withdrawal of the pig, the deduction from that remuneration of the skin price and the date of slaughter. The ticket will be signed by the pig breeder and the skinner (in the slaughterhouse by the employee who made the withdrawal).
(1) The County National Committee may, in rare cases, allow an exemption from the obligation to withdraw and dispose of the skin, in particular to farmers who live alone and carry out their own slaughter (remote groves, solitude in border and mountain areas, etc.).
(2) On the basis of the advice of the veterinarian that it is necessary to refrain from skin withdrawal in order to protect human or animal health, the district national committee will grant an additional exemption.
(3) The obligation to withdraw and dispose of the skin does not apply to the slaughtering of disinfected breeding boars and baguons (mangalic breed).
IV. Registration and control
(1) The local national committee shall keep a record of the authorisation of slaughterings, of the fulfilment of the compulsory sale of pig fat and pig skins, of the payment of the slaughter fees and of the inspections of meat in the event of such slaughter.
(2) The local national committee shall require from the applicant, when authorising slaughter, a certificate (document) of compliance with the delivery tasks referred to in Article 2 (1) to (4). After the slaughter carried out, it shall require proof of compliance with the compulsory sale of lard and slaughter leather and of the inspection carried out on the meat.
(3) The applicant is required to submit to the local national committee evidence of compliance with the compulsory sale of lard and leather and of the meat inspection carried out no later than 7 days after disposal.
(4) The forms of applications for slaughter and authorisations are strictly negotiable. *)
V. Final provisions
The rules on the inspection of meat during slaughter of pigs shall remain unaffected.
(1) In order to authorise the slaughter of sows excluded from breeding, in addition to the generally applicable conditions, the applicant is required to submit a certificate from the zootechnical service or veterinary care authorities that there is no objection from the point of view of agricultural production or from the point of view of veterinary production.
(2) Domestic slaughter of bovine animals, calves, piglets, horses and foals is not allowed. The slaughter of sheep's beard is regulated by a special regulation.
In exceptional cases, the central management of the purchase of agricultural products may allow derogations from the provisions of this decree in agreement with the participating central authorities.
Decree No 170 / 1959 of the Ministry of Agriculture of the Czech Republic on domestic slaughter of pigs and the purchase of hides and skins from such slaughter shall be repealed.
This Decree shall enter into force on 1 August 1962, with the exception of Article 2 (6), which shall take effect on 1 January 1963.
