on the protection of national borders.
The National Assembly of the Czechoslovak Republic decided on the following Act:
In order to ensure the peaceful construction of socialism in our homeland, state borders must be effectively protected against the penetration of all enemies of the camp of progress and peace. Protection of national borders is therefore the responsibility of every citizen.
The implementation of national border control falls within the competence of the Ministry of National Security, which carries out this task by its institutions, in particular the Border Guard.
(1) The service at the Border Guard is carried out by selected members of the working people for its importance, responsibility and exertion.
(2) Border guards shall have the same rights and obligations as members of the military; in the exercise of their powers, they shall also have the legal status of members of the National Security Corps.
Organisation The border guards shall be designated and the provisions on its addition, the release of border guards and the rules of service shall be issued by the Minister for National Security.
The Ministry of National Security shall decide on the cooperation between the Border Guard and the Defence Minister in agreement with the Minister of National Defence.
Service at the Border Guard counts as service in the army. The performance of the Border Guard shall be military. The rules on the pay ratios of members of the armed corps shall apply to border guards.
Members of the Border Guard shall be subject to military jurisdiction and provisions on military offences.
The Minister of National Security shall lay down a regulation whereby a border guard shall use arms in the exercise of his authority.
The Minister for National Security shall, in agreement with the Minister for Finance, provide for the cooperation of border guards with financial authorities in the detection of criminal offences and offences of a financial nature.
(1) In order to fulfil the tasks set out in this Act, the Minister for National Security may take the necessary measures and issue generally binding provisions; may, in particular, lay down:
(a) that entry and residence into a certain part of the territory of a State is prohibited or allowed only for a special authorisation;
(b) that there is also a need for prior approval by the Ministry of National Security to carry out work that changes the shape of the terrain or to establish telecommunications or energy lines of national or international territory.
(2) In individual cases, the Minister for National Security may delegate the powers referred to in paragraph 1 to his subordinate authorities.
This Act shall take effect on the day of its publication; It shall be implemented by the Minister for National Security in agreement with the participating members of the Government.
