GOVERNMENT REGULATION
of 8 December 2004
defining the Beskyda Bird Region
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
§ 1
Subject matter
(1) The Beskyda bird region (hereinafter referred to as the "bird area") is defined.
(2) The protection of the birds' areas are the populations of the stork (Ciconia nigra), the cranes of the forest (Bonasa bonasia), the hake (Tetrao urogallus), the pups of the smallest (Glaucidium passerinum), the turnip (Strix uralensis), the yellowtail (Picus canus), the black date (Dryocopus martius), the strikapoude (Dendrocopos leucotos), the tripees (Picoides tridactylus) and the lees (Figula parva) and their biotopes.
(3) The purpose of the protection of the birds' area is to preserve and restore ecosystems relevant to birds' species as referred to in paragraph 2 on their natural grounds of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
§ 2
Definition of bird area
(1) The bird region is situated in the territory of the Moravian-Silesian Region and the Zlín Region, in the cadastral territories of Bordovice, Čeladná, Dolní Bečva, Lower Lomná, Frenštát pod Radhosti, Guta, Hodslavice, Horní Bečva, Horní Lomná, Carpennná, Chamber Lhotka, Košariska, Beautiful under Lysa Hora, Malenovice, Milíkov u Jablunkov, Morávka, Morávka, Navsi, Oldřichovice at Třenka, Ostravice 1, Ostravice 2, Prostřemní Bečva, Rožnov pod Radhostí, Řekka, Smilice u u v Třince, Stará Hamry 1, Stará Hamry 2, Trojanovice, Tyra, Vendřice, Vedřice, Věřice, Vyřice, Vyří Lhoty Lhoty Lhoty Hora a a a.
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The map material of the 1: 50 000 scale, in which the territory of the bird region is drawn, is stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Beskyda Landscape Administration, the Moravian-Silesian Region Regional Office and the Zlín Region Regional Office and the municipal authorities of the enlarged municipalities whose administrative area is located.
§ 3
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2) may the territory of municipalities be located in the birds' area outside the concurrently built and stoppable (3)
(a) carry out all toll and pre-toll mining and mechanized work in the forestry activity between 15 March and 15 July at a distance of less than 200 m from known occupied black stork nests;
(b) carry out all toll and pre-toll mining and mechanized work in the forestry activity between 1 February and 15 June, at a distance of less than 100 m from the known riverbed nest;
(c) in the period from 15 March to 31 July, carry out tolls and pre-tolls in forest areas over 80 years of age with a spruce representation of less than 50% and in all forest areas over 130 years of age;
(d) define new tourist, cycling and ski tracks4),
(e) to change the type of land and the means of usingit (5);
(f) to reposition hunting equipment at a distance of less than 200 m from known nests of black stork or less than 200 m from known nests of white rifle.
(2) In the territories of the first and second zones of the Protected Landscape Area of Beskyda, located in the birds' area, only with the consent of the competent nature conservation authority may
(a) to carry out tolls and pre-tolls which have not been located in an approved forest economic plan or in the adopted forest economic curriculum;
(b) to carry out random extractions of leafy trees and fir trees, with the exception of rivets and lying parts of broken trees.
(3) Prior consent of the competent nature conservation authority is not required
(a) the activities referred to in paragraph 1 and paragraph 2 (a) in the case of measures preventing or hindering the effects of harmful factors on the forest, and in the case of measures in the event of exceptional circumstances and unforeseen damage in the forest under special legislation (6);
(b) the activities referred to in paragraph 1 (c), where such mining has been notified at least 20 working days in advance to the competent nature conservation authority;
(c) for the activities referred to in paragraph 2 (a), where such extractions have been notified at least 15 days in advance to the competent authority of nature conservation and for extractions which are not subject to notification obligations within the meaning of the provisions of the specific legislation7),
(d) in the implementation of road operations8);
(e) the activities referred to in paragraph 1 in the case of activities carried out under special legislation9) in the territory of the specified conquest area and exclusive bearings;
(f) the activities referred to in paragraph 1 (e), where such activities are subject to a decision pursuant to a special legislation (10) and have been given an opinion by the competent nature conservation authority.
(4) The location of known occupied nests referred to in paragraph 1 (a) and (b) shall be communicated in writing to the owners of the forest land concerned by the competent nature conservation authority before or during the period of limitation of mining activities.
§ 4
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the Beskyda border
The west point of the bird area is where the cadastral border between K. Ú. Hostašovice and K. Hodslavice crosses the railway line Valašské Meziříčí - Ostrava. After the track body, which is also the border of CHKO Beskyda in this section (hereinafter "CHKOB"), it continues towards the exit to Veřovice to the overpass over the local asphalt road *). Following local communication, along the river Jichinka to the valley of the Pavel, it continues to the foot of the verovic hills, where it turns sharply to the left and passes to the forest ferry road * *) running along the northern slopes of the Great Javorník. After this it continues to the location of Forečka to the place where the cadastral border between K. Ú. Frenštát pod Radhoště and K. Ú. Trojanovice intersects it. It continues along this line of the cadastral border to the football field. Here it leaves and continues after local communication on the western edge of the Frenštát mine (so it remains outside) to the state road * * *) Frenštát pod Radhodšt - Rožnov pod Radhošt no. I / 58. It crosses the main road and continues towards the east along the district road to the centre of Trojanovice until the intersection with the local road to Kopana (this section is at the same time the border of CHKOB). It moves towards this communication and heads south towards the foot of the mountains to the forest outbound road Shašina, following the northern foot of the Massif Miashi. It follows it further to the east, around the old area and above the cottage in Raztoka it connects to the so-called Prince's way from the valley of Raztoka to Pustevny.
After the Prince, he collects briefly to the corner at the quarry, where he moves again to the forest ferry. It crosses the River Raztok, which is briefly followed downstream on the right bank to the crossroads of forest roads. Here he turns right against the stream of the Mala Raztoka. After a few hundred metres, it crosses it and after another forest outbound road around the Optimit Recreation Centre first around the north, then in the eastern direction it turns the statue of the main ridge - it nests up to the bridge through the Brief stream and the crossroads just behind it. From this intersection it returns back to the north on a forest outbound route drawn already at the northwest foot of the Great Table.
It continues along the north foot of the massif to the valley of the river Čeladenko. Short copy of the communication to the valley Podolánek and cross at the north foot of Smrk to other local communication, the so-called Osmecká route, which is again the border of CHKOB in this section. The border of CHKOB leaves the place where the border of CHKOB comes from the forest and the JV continues along the edge of the forest along the Osmet Road. The Osmec road leaves in the valley of the Bukáčí creek, which crosses and continues along the northeastern corner of Smrku by cottage construction along a reinforced road to the state road Frýdlant nad Ostravicí - Bumbláka č. I / 56. After that, it returns to the north and continues along the road to the Mazák Valley to move on to the outbound road on the west side of the hill of Butoranka until the valley of the Sepetal creek.
After the valley of Sepetná, he continues again along the border of CHKOB through the forest road around the Sharp Mountain and Staskov to the valley of Satina and through the village of Malenovice. At the crossing point the border between K. Ú. Lubno and K. Malenovice leaves the border of CHKOB and crosses the cadastral border between Malenovice and Lubne further to the cadastral border between K.Ú. Lubno and K. Beautiful under Lysa Hora to its crossing with the road Pržno - Pražmo, which is again simultaneously the border of CHKOB. It continues in the eastern direction until further crossing with the cadastral boundary. Beautiful under Lysa Hora to which she passes and runs on it by placing the cadastral territory of Raškovice and Prague from the bird area. After the border k. Ú. Prague continues in the north direction until the crossing of the river Morávka, on which it continues to cross the road Dobrá - Morávka. From this point towards the village of Milíkov, the boundaries of the bird area and the CHKOB Beskyda are identical. Exceptions are the tiny area k. Ú. Dobratice in CHKOB and a short section from the center of Komorná Lhotka to the result of the valley of the River. This is where the border takes place after the forest outbound communication running at the north foot of the Goddula.
Behind the forest section Vrna in the village Košariska the border passes on the line between K. Ú. Košariska and Milíkov near Jablunkov to cross it with the road to the valley Košarisk. It crosses it and transforms to local communications in Milíkov and Navsi, taking place at the east foot of the Massif Kozub. At the point of crossing with the border of K. U. Bocanovice and K. Navsí, respectively K. Dolní Lomná passes to this line (Bocanovice stays outside) until the enclave of Novina. Here it leaves and follows local communications and forest roads on the north slope of the Lomá Valley. Cross the road and the river Lomé and switch to communication in the valley of Jestřábí. It then continues along the ridge of the forest road between the valleys of Jestřábí and Skřínov up to the main border ridge in the Skalka region.
From there, the border between K. Ú. Bridges near Jablunkov and K. Dolní Lomná follows the ridge around the cottage Sketřov towards the state border with the Slovak Republic, which is also the border of CHKOB. This line runs all the way to the Shrav Bay above the White Cross. From this point he returns inside the CHKOB and heads over the cadastral border between K. Ú. Morávka and K. Old Hamry 1 direction Visalaje towards the cadastral border K. Beautiful under Lysa mountain, after it and after the reinforced communication collects the valley of Greece and then from the confluence of the Greek and Greek just a reinforced communication to the dam of Šance. Through the body of the dam it reaches the state road Ostravice - Hlavatá no. I / 56 and runs along it in the southern direction until the village of Jankula.
Here it turns to the west and uses reinforced forest communication towards the valley of the Great Brook towards Podoláky, still following the communication round the nature reserve in Podoláky and in the location In the pit, he's moving on to another forest communiqué heading for the saddle. It continues along the forest outbound road by the southern side of the Priest to the state road Procentral Bečva - Pustevny. Following it towards Pustevny, where he leaves the road under the parking lot. In addition, it uses the forest outbound route, heading around Skalík meadow through the southern slopes of the ridge Radhošt-Pustevny to the west. At the crossing point of this road with a green tourist sign, it uses its route and after the unpaved path meets towards the Kamenné location. At the intersection of the forest roads before it, the right turns sharply and collects into the valley of the valley of the Důdné rozpiý. Behind the bridge he passes to the foot of the massif Radhošt and the Black Mountain and runs through the forest trees on the bottom of two ties on this slope above the non-forest enclaves in the Lower Spiny, which thus remain outside the bird area.
The border continues along the gangway and reaches the eastern slope of Montenegro. From its exit from the forest complex above the tourist cottage Peace follows the forest border to the location of Pavel's meadow. Here it crosses the border of the section falling down to the tiny watercourse up to the heel of the slope in the valley of Dolní Rozpité. From there, it follows the forest border virtually to the recreation area of Bučina, which remains outside the bird's territory. From there it follows the border of the forest departments 402A and 402G, then the border of the I. zone to the location U Pila. Here it turns to the right, and after the forest communication, it follows the western border of the I.Z. zone. It then rises on the road on the western slope of Montenegro to the highest laid large non-forest enclave. Here it meets on the local communication leading to the Sladský porok valley and further to the restaurant U Janoštík on the state road Rožnov pod Radhostí - Frenštát pod Radhošt. Here it crosses and continues again after local communication to the west of the Valley of Lower Paseka.
It continues about 300m up the valley along the road and passes on the forest ferry route which reaches the west side of Kamenářka into the saddle between Kamenářka and Longou on the ridge of Verovic hills, which is simultaneously a cadastral and district border. He continues after him through the cubits Short, Hushtín to the starting point of the border description.
Explanatory notes:
