GOVERNMENT REGULATION
of 8 December 2004
delimiting the Bird Region of Labské sandstone
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
Subject matter
(1) The birds' area of the Elbe sandstone (hereinafter referred to as the "bird area") is defined.
(2) The object of the protection of the bird region are the populations of the falco peregrinus, the field crasher (Crex crex), the large broth (Bubo bubo), the black date (Dryocopus martius) and their biotopes.
(3) The purpose of the protection of the birds' area is to preserve and restore ecosystems relevant to birds' species as referred to in paragraph 2 on their natural grounds of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
Definition of bird area
(1) Králová region is situated in the territory of the Ústí Region, in the cadastral territories of Arnoltice, Belá u Děčín, Brtních, Bynov, Bynovec, Czech Kamenice, Decin, Lower Chříbská, Lower Kamenice, Lower Podluží, Lower Žleb, Doubí, Upper Oldřichov, Upper Podluží, Horní Podlučící, Loučina, Markřov u Děčín, Kopka, Šřenice, Janská, Jetřichovice v Děčín, Kamenice, Kamenice, Kamenice, Šenice, Šenice, Šenice, Kunratice, Kyjov u Kríčina, Labí, Labí, Ženice
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The map materials of the scale 1: 50 000, in which the territory of the bird region is drawn, are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the National Park Office of the Czech Switzerland, the Commission of the Protected Landscape Areas of the Labská Sand, the Landscape Areas of the Lusatian Mountains, the Regional Office of the Ústí Region and the municipal authorities of the municipalities with extended scope, in whose administrative district the birds are located.
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2) may the territory of the municipalities be located outside the bird area at the same time as the municipality (3)
(a) carry out all toll and pre-toll deliberate mining and mechanized work in the forestry activity at a distance of less than 200 m from the well-known migratory falcon nest in the period from 1 March to 30 June;
(b) carry out all toll and pre-toll deliberate mining and mechanized work in the forestry activity at a distance of less than 200 m from the known nesting point of a large field between 15 February and 30 May;
(c) to reposition hunting equipment at a distance of less than 200 m from known nesting sites of the migratory falcon and a large owl.
(2) Only with the prior consent of the competent authority of nature protection (2) can part of the territory of the municipalities and outside the territory of the Czech Switzerland be located in the birds' area outside the concurrently built and stoppable (3)
(a) change the type of land and the means of usingit (4);
(b) carry out activities on land not intended for the performance of forest functions, including the maintenance of drainage systems causing a change in the level of the established surface and groundwater level which could cause a change in the biotope of the species for which the bird area is established;
(c) organise sports competitions and other events with public participation, carried out outside permanent sports areas and marked tourist routes;
(d) define new tourist, cycling, riding and ski tracks5).
(3) The consent of the competent authority of nature protection is not required
(a) the activities referred to in paragraph 2 (b), if they are carried out in accordance with the waterworks control rules (6);
(b) the activities referred to in paragraphs 1 and 2 in the case of activities carried out under specific legislation7) in the territory of the designated conquest area and exclusive bearings;
(c) the activities referred to in paragraph 2 (a), where such activities are subject to a decision pursuant to a specific legislation (8) and have been given an opinion by the competent nature conservation authority.
(4) The location of known occupied nests referred to in paragraph 1 (a) and (b) shall be communicated in writing to the owners of the forest land concerned by the competent nature conservation authority before the beginning of the limitation period for mining activities.
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border of the birds' area of the Elbe sandstone
The northwest border of the bird region is the same as the national border between the Czech Republic and the Federal Republic of Germany (Free State of Saxony). In the west turns from the state border along the road *) Petrovice - Tisá - Libouchec. In Liboužoum it turns towards the exit and leads along road I / 13 towards Blue, Jílové and further to Decin. The same road passes through the local parts of Bynov, Lower Oldřichov and Podmokly. Here he turns left by the class of Czech Youth and under the underpass under the ČD line, he heads down the Elbe waterfront to the railway bridge and then he crosses over to Loubí. It also leads the border along the railway line to Wolker Street (off-level crossing) and to the railway overpass on Rieger Street. This street continues up the Kamenická road and further along the road No I / 13 via Ludvíkovice, Huntířov and Markvartice to Česká Kamenice. Here he leads Smetana Street, the street on May 5th, around the hospital, then comes out of the city and continues along the road through Kunratika, Lipnice, Cold to Lower Chřibska. It continues on the road to the square in Chřibská, where it connects to road No II / 263, which leads the border to the Rybniště. Before the village of Rybiště, at the crossing point of road No II / 263, the railway line crosses the border of the bird area to the railway line, following which it continues through the Upper Podluží to the railway crossing with road No I / 9 and further along the road No I / 9 towards the Studánek. In the village of Studánka, the border of the bird area is turned on road No II / 265 to Králové Lípa. From the square in Králová Lípa passes the border along the main road through the local parts of the Beautiful Buk and Gardens where it connects to the railway track. Following this track continues through Brtníky and Mikulášovice. About 800 m behind the station Mikulášovice lower railway station, where the line approaches the state border, crossing the border of the bird area to that border.
Explanatory notes:
*) If the text of the Annex indicates that the border leads on the road, it is indicated that it leads on the edge of the road auxiliary parcel, namely the edge facing into the bird's area.
