GOVERNMENT REGULATION
of 8 December 2004
defining the Bird Region of Šumava
-The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
Subject matter
(1) The bird region of Šumava ("the bird region") is defined.
(2) The protection of the birds' areas are the populations of the tetras (Tetrao tetrix), the hake (Tetrao urogallus), the stork (Ciconia nigra), the horseradish (Crex crex), the tegument (Glaucidium passerinum), the rhombus (Aegolius funereus), the black date (Dryocopus martius), the forest crane (Bonasa bonasia) and the trifinger (Picoides tridactylus) and their biotopes.
(3) The purpose of the protection of the birds' area is to preserve and restore ecosystems relevant to birds' species as referred to in paragraph 2 on their natural grounds of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
Definition of bird area

(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The map material of the scale 1: 50 000, in which the territory of the bird region is drawn, is stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Office of the National Park of Šumava, the Regional Office of the South Bohemia Region and the Regional Office of the Pilsen Region, the Military Forest Office and the municipal authorities of the municipalities with extended scope in whose administrative district the bird area is located.
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2) outside the concurrently built and stoppable (3) the territory of the municipalities may be in the birds' area
(a) carry out all toll and pre-toll mining and mechanized work in the forestry activity between 15 March and 15 July at a distance of less than 200 m from known occupied black stork nests;
(b) in the period from 1 March to 31 July, carry out tolls and pre-tolls in forest areas over 80 years of age with a beech presence of 50% or more, in forest areas over 80 years of age with a spruce presence of less than 50%, in forest areas over 80 years of age with a pine area of less than 50% and in all forest areas over 130 years of age;
(c) to carry out tolls and pre-tolls which have not been located in an approved forest economic plan or in a taken-over forest economic curriculum;
d) replace hunting facilities at a distance of less than 200 m from known nests of black stork.
(2) Prior consent of the competent nature conservation authority is not required
(a) the measures referred to in paragraph 1 which prevent or impede the operation of harmful factors on the forest and the measures in the event of exceptional circumstances and unforeseen damage in the forest under special legislation (4);
(b) for the activities referred to in paragraph 1 (c), where such extractions have been notified at least 15 days in advance to the competent authority of nature conservation and for extractions which are not subject to notification obligations under special legislature5),
(c) for the activities referred to in paragraph 1 (b), where such mining has been notified at least 20 working days in advance to the competent nature conservation authority.
(3) The location of known occupied nests, as referred to in paragraph 1 (a), shall be communicated in writing to the owners of the forest land concerned by the competent nature conservation authority before or during the period of limitation of mining activity.
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border of the Shumava Bird Region
Borders The birds of the Šumava region are coming from the state border - milestone No 17 / 2 (the border crossing of the Back Chalupa), turning along the forest path *) to the east and crossing the forest path leading from the Statěček, along which it continues to the intersection of the Back Chalupa. At this crossroads it turns along the forest road to the southeast and follows it to the forest road from Hromada Square to Hamry. Following this road leads to Hamry, crosses the Svinnen stream and continues southeast of the site of the Watchpost on the forest border east of the road. From there it moves further along the edge of the forest to the east to the old deep forest road, which descends south towards the valley of the Svinnen creek north of the VN 22kV route. From there it leads along the road on the right bank of the creek to the road north of Rodrovsky Dvor, where it follows the local communication leading to the village of Hamer Court. It continues along the road * *) to cross with the state road leading from Green Lhota to Hamry, continues along this road via Hamry to Back Hamry, crosses the Head and continues along the road to the point of crossing it with the Red Brook - left-hand presence of the Head (cubicle about 740 m n.). It descends after this tributary to the Head, crosses it and rises after the nameless right-hand tributary towards the location of Tomáš's Court, where it passes from the watercourse to the local road in Tomáš Dvořa, and from it to the state road leading from Želená Ruda to Nýrsko. After it continues to the village of Hojssov Guard, where under the church it crosses to the local and later forest road on the South Side and continues after it until close to Green Lhota. In the place of the guard house near the railway station south of the station Green Lhota crosses the forest road rising to the west slope of the Little Prenet and continues along this road along the west, north and northeast slope of the Little Prenet to the road Green Lhota - Prenet. On this road it moves towards the exit to the turn of the forest road to Datelov, following it continues towards Datelov to the point of crossing with the Desenik stream. Here it descends to the stream and leads downstream to the crossing point of the Desenice creek with the path of Matìjovice - Děpoltice. It continues on this journey to Děpoltic and Oldřichovice and from there after local communication * * *) via Datelov to the City. From the town, it rises through the forest path to the saddle between Plášina and Dry Studios (Kohlerwastl locality) and from there further to Ono World. East of Ono World passes on road No I / 27 and continues along it to Javorná, where it continues after local communication to Gerlov. From Gerlov then on the forest road to the Keply location, and further along the state road Keply - Pražil to the Old Hust (crossroads above Kepli), where he comes to the border of the national park. It follows the paved road to Poustek, Busil and Schöpfro's court. Here he turns on the forest road to Karlov and to Good Water. From Good Water continues on the forest road to the Great Babylon and from there on the forest road through the Monasterské Mlýn to Rejštejn. The border of the bird region from the border of the national park is receding in the Rejštejn mansion and continues along the field road over the church around the church to the village where it crosses the state road of Rejštejn - Susice. Following it, it runs towards Susici to the intersection of Radesov. From this intersection then rises along the road towards Kašerské Hora, which passes along this road, and continues further after the same communication on Řetenice and Nicov. At Nicov Mansion he turns southwest on his way to Cinderella. In the house of Cinderella, the crossing with the Losenice flow continues further after the Losenice flow and follows it up to the Golden well. From there along the forest road to the cubicle 1141 m n. and further to the road Kvilda - Vimperk, along this road it continues several hundred meters towards Vimperk until the intersection with the road Nová Huta - Churáňov. At this intersection he turns right into the village of Nová Huta where he turns left on the road towards Vimperk. On this road passes through the intersection of U Baborka. After about 600 m behind the junction at booth 1008 it turns sharply back to the right and along the road leading in the southern direction it comes to the intersection of Shindlov, where it connects to the road Nová Huta - Borová Lada. On the Borův Lady turns on the road to Upper Vltavice and runs along it to the bridge over the Vltava in Polka. From Polka leads the border of the bird area through the ford and the cubits of 933 and 842 m n., on a reinforced road to Strážný, from there along the road to the Aluminium, where it crosses the river of the Asparagus and follows it towards the confluence with the Vltava. It also takes place along the Vltava to the railway crossing near the Great Niva, here it crosses the field road near the northwest border of NPR Great Niva towards the northeast. On the border of the forest tree, it turns on the forest road to the north into the saddle between Birdhouse and Zatonská Hora, where it passes on the forest road Longback, but leaves it at the junction at booth 809 m n. and continues along the forest road northwest towards its crossing with the railway line. It then continues along the railway towards the stop of the Bay of Kaplice towards Kubov's Huti. In the location Nad stops (on southern Basum) leaving the railway and crossing perpendicular to the forest road towards the northeast and climbing on the back of the Arch. After that it leads (identical to the NPR Boubino Forest border) to the booth 1183 m n. Cross-section descending from the saddle between the top of Boubin and John's stone. From there it continues along the northern slope of Boubín on the crossing with the forest road Kubov's Hut - Monument, and along that road it continues to the northeast to the intersection of the forest roads near Monument. It continues through the branch towards the southeast along the forest road to the valley of the Boubín creek, which crosses on a cubicle of 1012 m n., and along this road leads to the water catchment area of the Cold Creek, which crosses on a cubicle of 1027 m n., and further along this forest road through the northeast slope of Solovka through the locality of Na Kubrny by the northeast slope of Bobík. In the crossing of the forest path and the eastern intersection leading from the top of Bolik the border bends towards the forest path towards the south, following this path continues at the height of 1025-1045 m n., up to the point of 1000 m n. (intersection of forest roads). From there it leads the forest road west and southwest to the point of contact of the forest road with the long-back road. Following it continues along the western slope Jedlová to the road I / 39 between Volary and Stöger Hutí. Following this road leads to Stögrův Huti, but here it turns on the field road towards the south towards the eastern slope of Lisková, which passes to the intersection of the forest roads. From there, it continues south on the border of the forest line to the railway line and along the railway line to Volary, where it crosses the Luční potok, passes around the Volary and on the crossing point of the Volarský creek with the road connects to road No I / 39 Volary - Turnava, which runs all the way to Želnava and continues on the road to Belá and Nová Pice. Behind Nová Pěce is connected to the path following the Schwarzenberg Navigational Channel and continues along it towards the Hutsky Court. In the Hutsky Court location, the border leaves the road along the Schwarzenberg Canal and continues on a reinforced dirt road to the Lhota and here along the road to the ferry. From there it descends to the Lipna shoreline (cubicle 725 m n.), on which it continues towards the exit to the Frýdava mansion. Here on the communication of the ferry steps onto the road and continues from Frýdava to Frýdava. From the Front Výtona then along the state road to the border crossing of the Burning Point - Gugelwald. From here along the state border with Austria and Germany to the border line 4 / 11 and here it turns on the road in Ferdinand Valley and in Debrník it turns towards the fork at the cubicle 804 m n m.. It continues in the northeast direction along the border of the national park along the edge of the forest and forest roads through the cubits of 933 and 923 m n m to the bridge over the stream, returning to the cubicle of 882 m n., and on the cubicle of 828 m n., it results on the road Železná Ruda - Klatova, which is followed to the crossroads of Gerlova Huti - cubit 952 m n m. In this place it crosses the state road No I / 27 and moves along the forest road to the west (Snake Path) on the northeastern side of the Mlyn Hill on the forest road Nový Brunst - Back Pančíř. Following this path, it continues towards the west, leading along it north of the Hotel Horizont and descending on the Pièácké saddle. From there, it continues along the forest road towards Divorce. From this, the path is rotated towards the southwest through the forest line to the top of Pípičák (at the point 1185 m n.). From this cubicle, along the dorsal path of Špičák continues towards the south to the very top of Špičák, and from there on the west side of the most westward-located slopes to the forest intersection, which descends in a direct direction towards the Iron (Lake) stream, which crosses on the booth 945 m n. The border descends further along the river to the crossing with the railway line, and continues along this line towards the Iron Ruda. From the track, the border is diverted to the west at the border of the forest area at booth 805. It continues along the border of forest land and meadows west and southwest, from there on the forest road to the monument of A. Kaspar and further to the crossroads of forest roads Elizabeth - Devil's Lake - Welsh. From the crossroads it descends along the forest road towards Elizabeth to cross with Elizabeth - Welded. Following this path, it continues in the direction of Svarožnou until the point where the river crosses Svarožné. From there it descends downstream to its confluence with the Cut and further after the Cut River until it crosses with the state border with Germany. From there it continues along the state border to the border line 17 / 2.
