GOVERNMENT REGULATION
of 8 December 2004
defining the Bird Region of Třeboňsko
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
§ 1
Subject matter
(1) The birds' zone of Třeboňsko ("the bird region") is defined.
(2) The object of the protection of the bird's region are the white herrings (Egretta alba), the nocturnal yeast (Nyticorax nycticorax), the black stork (Ciconia nigra), the eagle (Halieetus albicilla), the apicorus bee (Pernis apivorus), the muskrat (Circus aeruginosus), the redfish (Sterna hirundo), the redfish (Alceda arborea), the yellowtail (Picus canus), the black dahl (Dryocopus martius), the trakapod (Dendrocopos medius), the redfish (Alcedo atto arborea), the larynx (Picus canus canus), the larynx.
(3) The purpose of the protection of the birds' area is to preserve and restore ecosystems relevant to birds' species as referred to in paragraph 2 on their natural grounds of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
§ 2
Definition of bird area
(1) The birds' area is located in the territory of the South Bohemia Region, in the cadastral territories of Bošilec, Branná, Slílice, Cep, Lower Lhota near the Guard of Nehřeka, Domanín near Trebon, Děhřín, Frahelz, Hamr, Hamr nad Neženka, Hatín, Barbers near Old Chána, Horusice, Hrachoviška near Třeboň, Chlum near Třebona, Kardášova, Klekov, Kojakovice, Kolenka, Lhota u Dynísek, New Ves, Lomnice nad Lužnice, Luznice, Luzněžněžice, Lutovka, Majdalena, Mazelov, Mirochov, Mlka, Mnika, Mnika u u u u u Kardášovice, Níčíčíšovice, Níšovice, Krážovice, Žážovice, Zážení nad nad, Šážek, Šáž@@
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The 1: 50 000 map documents, in which the territory of the bird region is drawn, are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Třeboňsko Landscape Administration, the Regional Office of the South Bohemia Region and the municipal authorities of the municipalities with extended scope in whose administrative district the bird area is located.
§ 3
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2) may the territory of the municipalities be located outside the bird area at the same time as the municipality (3)
(a) to carry out tolls and pre-tolls and mechanised work in the forestry activity in the vicinity of known occupied forest nests at a distance of less than 200 m from 1 May to 15 August, a black stork at a distance of less than 200 m from 15 March to 15 July and an eagle at a distance of less than 300 m from 1 January to 15 July;
(b) to change the water level between 1 April and 31 July by more than 20 cm in the period of time of less than 14 days on the Černický, Little Dubovec, Small Tisky, Dushakovský, Lake under the Tisch, New Widow, New Burned, Rod, Subseat, Ruda u Kojákovice, Old Lake, Satlavy, Big Dubovec, Great Virgin, Big Tisé and Ženich,
(c) use fertilisers and biocides when managing ponds;
(d) remove lithoral crops;
(e) interfere with the crops of trees on islands with nesting colonies of the night-cap;
(f) enter the lithoral fields of ponds between 1 March and 31 July, except for owners and tenants of land and hunting for the purpose of care of ducks released,
(g) to enter the night-time yeast colonies between 1 April and 31 August and the fish colonies between 15 April and 31 July;
(h) setting new tourist and cycling tracks4),
(i) to introduce farmed poultry farming;
(j) to carry out tolls and pre-tolls which have not been located in an approved forest economic plan or in a taken-over forest economic curriculum.
(2) Prior consent of the competent nature conservation authority is not required
(a) the measures referred to in paragraph 1 which prevent or impede the effect of harmful factors on the forest and the measures taken in the event of exceptional circumstances and unforeseen damage in the forest under special legislature5);
(b) the activities referred to in paragraph 1 (b) in the event of a flood, emergency or exceptional climate situation;
(c) for the activities referred to in paragraph 1 (j), where such extractions have been notified at least 15 days in advance to the competent authority of nature conservation and for non-notifiable extractions, under a special legal provision (6);
(d) the activities referred to in paragraph 1 (d) and (f) in the railway protection zone under special legislation (7);
(e) the activities referred to in paragraph 1 in the case of activities carried out under specific legislation8) in the territory of the designated conquest area and exclusive bearings.
(3) The location of known occupied nests referred to in paragraph 1 (a) shall be communicated in writing to the owners of the forest land concerned by the competent nature conservation authority before or during the period of limitation of mining activities.
§ 4
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border of the region of Trebon
In the southern part of the territory, the border of the bird region of Třeboňsko at the national border with Austria at border line No V / 69 begins. From there he goes west on the forest road *) to the Burning Landing settlement, where he follows local communication * *) northwest on Rapschach and after about 200 metres he turns north on the forest road to the Bosnia settlement. From this settlement the border follows approximately 1 km east and north of the local road to Great London, then before the Wild Pond it ducts from this road in the north direction to the field road, which results in the intersection of the road * * *) No III / 15015 Rapschach - Františkov with local road to the Paris settlement (cubit 465 m above sea level). From this crossroads the border continues after the local communication via the settlement of Paris to the crossroads with the road (8) No III / 1502 Klikov - Suchdol nad Lužnicí, on which he swerves west towards the bridge over the river Lužnice to the village Suchdol nad Lužnicí, where he crosses the railway line Veselí nad Lužnice - České Velenice and the road No I / 24.
From the intersection with road No I / 24, the border of the bird area continues in the western direction along the field road leading on the southern edge of the small pond system to the local part of Venice and from there to the communication leading on the dam of the Old Pond at Cep until the intersection with road No III / 1501 Cep - Majdalena. It follows in the north direction about 500 m, it passes from it to the left of the Cep, and continues along the watercourse following the edge of the forest complex to the bridge, where the water tower crosses with the forest path (yellow tourist mark) about 600 m southeast of Chinatel grove. Following this route, the border leads west to road No II / 154, which is followed further south towards the edge of Hrachoviště. The village of Hrachoviště is circling the border on the northern edge of the border and is connected to the road III. The road continues in the western direction to Kojákovice and further north to Domanín, where it is connected to road II / 155. Following this road the border leads 1.5 km towards Třeboň and then turns along the drains to the west bank of the Opatovice pond. This pond passes west on the border of its parcel (p.p.no. 503 / 1 k.o. Domanín) to the northernmost point, where it crosses the connecting dam and to the sewer leading from the safety overflow of the pond World leads to the Golden sewer.
The border of the birds' area passes in the northern direction of the town of Třeboň and along the western edge of the Wet meadows up to the railway bridge through the Golden sewer at the level of the southern edge of the pond Káňov. Behind this bridge, where the Golden Seat turns sharply to the north, crossing the border on the dam of the Káňov pond and circling it along the border of the parcel (p.no. 723 / 1 k.ú. Stranka) from the east, south, west and north to the place where the Golden Seat is again locked to it by the bridge on the road No III / 15511 Luzka - Stranka. From this road bridge, the border of the birds' area continues in the western and northern direction along the Golden sewer along the villages of Přešeka and Smržov until the crossing point of the Golden sewer with the road No III / 1482 Lomnice nad Lužnice - Smržov at the northeast edge of the Koclířov pond. From there, the border is heading south on the road to the nearby intersection with road No II / 148 and passes east on this road to Lomnice nad Lužnice, where it turns along the local road in the south direction to the Měženná pond dam and further from its southern end along the field road along the west edge of the Shaloun estate to the west end of the Great Tisý pond dam. It follows in an eastern direction of approximately 800 m in length, and in front of the Big Dubovec pond passes under the dam on the Títý stream, which follows up to the confluence with the Miletín stream, which leads further to the river Lužka.
Following the river Lužnica, the border of the bird region continues to the mouth of its left-hand tributary of the Potedraksky stream, which it crosses and is heading west towards the Pinedrautsky pond dam. This pond passes from the south on the border of the parcel (p.p.no. 1029 / 1 k.k.ponedraj) and after the flow of the Poneatarite stream, which is situated in the discharge of the pond leads to the dam of the Záblatský pond. Following communication on the Záblátský Pond dam, the border is south at the intersection of roads No III / 1555 and III / 1556, from which it follows the west direction of road No III / 1556 Záblátský Pond - Mazelov to the edge of the forest near the Mazelov farm. Here it turns on the field road first east and after about 150 m north. At the crossroads near the forest, the border turns to the right and, after 250 m, it continues in the northern direction along the watercourse, except for its confluence with the PoteDrac creek. It continues along the river east and after about 100 m at the bridge it turns north on the forest and then along the field road to the village of Lhota near Dynín, where it connects to road No III / 1555 Zábátí - Bošilec and follows it in the north direction to the village of Bošilec and to the barrier of Bošilecký pond. Under the discharge of the pond crosses the border to Bošilecký brook, which follows to the border of the cadastral territory Bošilec. Following this cadastral border, the border of the bird area goes to the southern edge of the natural reserve Horusická blata. This reservation goes around its western and northern border and further along the northern edge of the Horusice pond parcel (pp. 2254 / 1 k.ú. Horusice) in an eastern direction to the main dam of this pond, where it is connected to road I / 24.
Road No I / 24 monitors the border of the bird area in approximately 3 km south to the intersection with road No III / 1551 leading to Vlkovo. On this road passes the border to the southern edge of the village of Vlkov, where it turns right along the field road to the Landscape pond. The border also follows the northern edge of the pond (border nr. 213 / 1 k.ú. Vlkov) and after the following discharge drain goes to the dam of the Vlkovský pond. From there the border continues in the northeastern direction and goes around the Vlkovský and Vlček ponds (after the borders p.p.. 552 / 1, 558 / 19, 557 and 555 K. Vlkov ponds) and in the southeast corner of the Vlkovský pond is connected to the local communication Vlkov - Val. Following this, he continues to the village of Val and further north after communication No III / 00353 to the village of Hamr, where he crosses the bridge via Nežárek and after local communication leading up the Hluboký u Hamr ponds and Front Sax heading to the village of Drahov. Here he crosses the road No. II / 147 Kardashov Greece - Veselí nad Lužnicí, passes through the village of Drahov and after local communication leads to the village of Zlukov. In the village of Zlukov, the border of the bird region turns northeast after local communication towards the village of Újejdec and follows it to the point where the railway line Veselí nad Lužnice - Jindřich Hradec crosses. Just before the railway line, the border of the birds' area is turned in an eastern direction along a local road that follows the body of the railway line to the point of exit of the road I / 23.
Road No I / 23 tracks the border of the birds' area 400 metres east and then ducts south along the discharge point from the Silk Pond towards Záhorsky Pond. This pond and adjacent pond Rohlik circling the gutter from the east and south and connects to the edge of the forest areas, which follows the southern direction to the Chlumský pond. It passes from the east on the draining drain and follows the eastern edges of the forest areas and smaller ponds to the eastern edge of the Pond of the Middle Otrazenice. The border of the bird area follows the border of the pond parcel (p.n.1627 k.ú. of the bald) up to its dam and from its west edge turns south along the field road to the intersection with road No II / 147. On this road, the border of the bird area passes through the settlement of Vřešná and the village of Nítovice to the southern edge of Kardashová Řečice, where it turns south after local communication towards Cikar.
From this communication it turns around 800 m behind the area of the Czech Republic in the eastern direction to an unpaved road, on which it passes through agricultural and forest land to the village of Monk and after passing through this village further after local communication to the village of Ratiboř. From Ratibora, the border of the bird region is directed after local communication through the municipalities of Roseč and Hatín to Plavska. In the village of Plavsko, it turns west on the road to the settlement of Šimanov, passes along it and continues along the field road along the right bank of the river Nežirka to the level of its confluence with the New River. Here he surpasses Nežarka and passes to the left bank of the New River in the place of solitude U Lapice, from where he passes south on the forest road through Nová Řadov to the result of this road on road I / 34.
On Road No I / 34, the border of the bird area continues approximately 100 m east to the bridge over the New River, from which it follows the New River flow in the southern direction to the Silver Bridge. From there it continues on the road No III / 1536 through the municipalities of Sříběc and Mníšek to Libořež, where it connects to communication No II / 153 in front of the village. The municipality of Libořeze passes the border after this communication in the direction of Příbraz and before the end of the village turns east on the local communication to the Huta settlement near Příbraze, where it follows the settlement at the crossing point of communication with the main draining ditch in the PR Losi Blato near Mirochov on the western boundary of the cadastral area of Lower Lhota near the Guard of Neřenka, which follows the northern direction to the point where the border of this cadastral area crosses with road II / 153. Following this road, the border of the bird area leads approximately 300 m east and then turns right on the field road towards the dam of the cancelled Blatsky pond. At the point of discharge of this pond passes under the air side of the dam and connects again to the boundary of the cadastral territory of Lower Lhota near the Guard of Neženka. Following the border of this cadastral territory, the border of the birds' area leads east and south in the forest complex Homolka to the point where the border intersects with Austria in the area of border milestones VI / 28 and VI / 29 on the Košnice stream under the Novomlín pond. The border between Austria and Austria then follows the border of the bird region in the southern direction to the starting point at the border line V / 69 east of the settlement of the Burning Lands.
Explanatory notes:
