Czech National Council
of 13 March 1990
on the use of the national emblem and the national flag of the Czech Republic
The Czech National Council decided on this law:
(1) The national emblem of the Czech Republic is entitled to use:
(a) Parliament's Chamber of Deputies, Parliament's Senate and the Legislative Office;
(b) President of the Republic and Office of the President of the Czech Republic,
(c) the Government and the Government Office;
(d) ministries and other administrative offices of the Czech Republic,
(e) higher local authorities, the capital of Prague and its urban areas, municipalities, cities and territorial subdivisions of the statutory cities and their urban areas or urban districts;
(f) courts, prosecutors, notaries and court executors,
(g) armed forces and security forces;
(h) diplomatic missions and consular offices of the Czech Republic.
(2) State museums, galleries and other state cultural and scientific institutions, schools, the Czech National Bank and other bodies and organisations may also be used by the Czech Republic.
(3) The national emblem may also be used in an appropriate and dignified manner by individual citizens, political parties and civil associations.
(4) The national emblem can be used on banknotes and coins of the Czech Republic.
(1) The following are used for the Great National Sign of the Czech Republic:
(a) on the relevant documents of Parliament, the Chamber of Deputies and the Senate, the President of the Republic and the Government;
(b) on the insignations of the mayors and mayors of the municipalities and cities referred to in Article 1 (e) and of the representatives of the higher local authorities, provided that a special law so provides;
(c) in the rooms where the authorities referred to in Article 1 (1) shall meet and act, in particular in the ceremonial halls, the court hearing and the election rooms;
(d) at the service uniforms of the staff of the bodies referred to in § 1 (1) or of members of the armed corps of the Czech Republic, to the extent and in the manner laid down by the special regulation;
(e) at the borders of the Czech Republic,
(g) on personal and official documents issued by the Czech State authorities,
(h) securities and other prices of the Czech Republic.
(2) A large national character is also used to designate buildings in which the institutions, organisations and institutions referred to in § 1 are located. The national character used in this way shall not be associated with a table bearing the name of the authority or organisation.
(3) The Czech Republic is also considered to be a large national emblem of its unique colour imitation of metal, stone, glass, ceramics or other material, if the image corresponds to the image of the Czech Republic.
(1) The small national emblem of the Czech Republic is used by the authorities and organisations referred to in § 1 (1) and (2) on documents, seals and official stamps.
(2) The seal or official stamp shall show a small national character within a circle, the circumference of which shall be briefly marked and the seat of the authority which uses the seal or stamp.
(3) The Charter, seals and official stamps with a small national emblem of the Czech Republic are used only if they contain the instrument of order or decision of the state authority of the Czech Republic, or if they are a document certifying important facts or establishing authorisations or obligations.
(4) Documents, seals and official stamps bearing the national emblem of the Czech Republic are not used in ordinary correspondence.
(1) The flag of the Czech Republic is used on occasions of public holidays and on other festive occasions on buildings in which the authorities and organisations referred to in Section 1 (1) are located.
(2) National flags may also be used in an appropriate and dignified manner by individual citizens and political parties and civil associations.
(3) If other flags are displayed, the national flag of the Czech Republic will be placed in the most honorable place.
(4) In the cases referred to in paragraph 1, the instruction to post the national flag of the Czech Republic is issued to the national authorities of the Czech Republic
(a) Ministry of Interior of the Czech Republic on official occasions of Republic importance,
(b) authorities of municipalities or parts thereof on official occasions of local importance.
(5) Until a special law provides otherwise, the President of the Chamber of Deputies shall decide on the use of national flags on Parliament's buildings.
The flag of the President of the Republic may be used to designate:
(a) the seat of the President of the Republic at the time of his presence in the Czech Republic;
(b) means of transport used by the President of the Republic on official occasions.
The State Seal of the Czech Republic can be used
(a) to seal international treaties;
(b) the credentials of diplomatic representatives;
(c) in other cases, if the law so provides, an international agreement or if it is customary.
(1) The national anthem of the Czech Republic can be played and sang on occasions of public holidays, memorable and important days and on other official and festive occasions, or if this is usual.
(2) The national anthem can be played and sung at the same time, or just played or just sang.
The use of national symbols of the Czech Republic is prohibited to show disrespect for these symbols.
The Ministry of Interior of the Czech Republic provides by decree details of the use of the national symbols of the Czech Republic, in particular:
(a) in which cases, the manner in which and on which the national emblem of the Czech Republic is used,
(b) in which cases and how the flag of the Czech Republic can be used instead of the flag of the state.
The Government may provide for transitional arrangements by regulation for the gradual replacement of the national emblem of the Czech and Slovak Federal Republic by the national emblem of the Czech Republic.
The President of the Czech Republic shall determine the details of the use of the national emblem of the Czech Republic in the Army of the Czech Republic.
This Act shall take effect on the day of its publication.
