DECLARATION
Czech Mining Office
of 25 April 1988
on selected mining installations
According to § 8 (5) (a) of the Czech National Council Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, the Czech Mining Authority provides:
Selected mine equipment
(1) Selected machinery, equipment, apparatus and equipment (hereinafter "selected mining equipment") for mining and mining activities are:
(a) mining machinery for mining and stamping, mechanised reinforcement, loaders, including anchoring and securing equipment, and mechanised shields;
(b) drilling sets and drilling machines for drilling with a diameter exceeding 800 mm;
(c) locomotives, rail-free machinery, conveyors and conveyors, including their anchorage equipment, when used underground;
(d) railway locomotives and towing trucks;
(e) heavy machinery;
(f) mining and fencing machines, track loaders, long-distance belt equipment with a width of 1800 mm or more;
(g) mining equipment for floating machinery,
(h) electrical equipment used in environments with a risk of explosion of flammable gases and vapours and flammable dust;
(i) breathing, reviving and self-rescue appliances, including their accessories;
(j) equipment for detecting and measuring the gaseous and dust components of mining air, including their accessories;
(k) hand-held fire extinguishers, fire extinguishers when used underground;
(l) refrigeration equipment, dusting equipment, if used underground;
(m) personal lamps,
(n) electrical equipment and electrical equipment providing underground security.
(2) In case of doubt whether it is a selected mining plant, the Czech Mining Office will decide.
Application for authorisation to use selected mining equipment
(1) The organisation shall submit an application for authorisation to use the selected mining equipment to the Czech Mining Authority no later than one month before the expected entry into service of the selected mining equipment.
(2) The application for authorisation to use selected mining equipment is accompanied by:
(a) a statement that the equipment complies with the requirements of occupational health protection and the safety requirements of generally binding legislation and technical standards; where exemptions relating to installations and copies of relevant decisions are permitted. If, in exceptional cases, the selected mining plant does not comply with the health requirements at work and the safety requirements of generally binding legislation and technical standards, the application shall be accompanied by an expert opinion from the organisation or expert established by the Czech Mining Authority. This assessment shall also include an assessment of alternative measures to ensure safety and health at work and safety of operations,
(b) the decision of the relevant national service or the certificate of the relevant ministerial service if the selected mining establishment is subject to the performance of the national or ministerial testing; in other cases, the application shall be accompanied by an expert opinion of the organisation or expert established by the Czech Mining Office,
(c) basic technical documentation containing:
1. a composite drawing,
2. kinematic diagram,
3. circuit diagram,
4. surveillance scheme for electrical equipment,
5. diagram of control circuits to ensure safety,
6. an inventory of electrical equipment used, indicating technical parameters,
7. technical conditions,
8. instructions for operation and maintenance,
(d) a binding assessment by the competent authority of the sanitary services.1)
(3) The Czech Mining Office shall decide on the organisation's application no later than one month after the date of receipt of the application, unless it decides on the verification operation in accordance with § 3.
Verification operation of selected mining installations
(1) The Czech Mining Office may order the verification operation of the selected mining plant before deciding on the application.
(2) The verification operation shall verify the safety, hygienic, technical and technological parameters of the selected mine equipment under conditions corresponding to the expected operation.
Changes to selected mining installations
Changes to selected mining equipment that could affect safety and health at work and safety of operation can only be made after prior approval of the Czech Mining Authority; Paragraph 2 and 3 shall apply mutatis mutandis.
Transitional provision
Authorisations to use selected mining equipment issued before the Decree is effective shall remain unaffected.
Repeal
They shall be deleted:
1. the Decree of the Czech Mining Office of 24 March 1980 No 2300 / 1980 issuing a list of selected machinery and electrical equipment (hereinafter referred to as "the selected equipment") whose verification operation and use in the underground requires the authorisation of the State Mining Administration and establishes a summary of the conditions for the issue of such permits,
2. the Decree of the Czech Mining Authority of 8 September 1980 No 2301 / 1980 issuing a list of machinery and electrical equipment (hereinafter referred to as "selected equipment"), whose verification operation and use on surface facilities, for extraction or transport of material, requires the authorisation of the State Mining Administration and provides for a summary of the conditions for the issue of such permits,
3. the Decree of the Czech Mining Authority of 21 June 1982 No 3576 / 1982 issuing a list of selected machinery and electrical equipment (hereinafter referred to as "the selected equipment") whose verification operation and use in the underground requires the authorisation of the State Mining Administration and provides for a summary of the conditions for the issue of such authorisations,
4. the Decree of the Czech Mining Office of 8 July 1971 No 3800 / 1971 on the construction and fitting of narrow-track locomotives and oil vans (Reg. in the amount of 39 / 1972 Coll.), as amended by the Decree of the Czech Mining Office of 25 November 1971 No 5954 / 1971.
Efficacy
This Decree shall take effect on 1 July 1988.
